January 11, 1946 The Regular Meeting of the Planning Commission was held in the City Hall at 7:45 p.m. Thursday, January 10, 1946. MElk3ERS PRESENT: Mitchell Coles Stivers Shattuck ABSENT: idacomber Broom Chairman Mitchell presiding. OTHERS PRESENT: City Attorney Karmel Councilmen Hunt and Harris Mayor Dahl City Engineer Longson Building Inspector Watson Rockwell Stone appeared to protest the rezoning of his property on Howard Avenue from "business" to the "apartment house" classification. He spoke at length on this subject, stating he had owned the property for approximately thirty-six years, and although it has been mostly developed for apartment, he has had in wind a business development there when the opportunity offered. For some time, he said that he was un- der the impression that he had been penalized by paying higher taxes for many years while his property was zoned for "business", but he stated at this meeting that he had been misinformed regarding the taxes and that he withdraws his formal statements in that connection. It was brought out in the discussion that the other property owners in the immediate area had not received notices of the public hearing to rezone the property. It was concluded that the matter should.be held over until such notices have been mailed to the other property owners. The petition of Mrs. F. K. Kennedy to resubdivide Lot 12, Block #t55 Easton Tract k5, was presented. After consideration a motion was regularly made an unanimously voted to grant permission to resubdivide according to the engineer's map submitted Vith the petition providing that the owner is to installthe necessary sewer line and other utilities at her own expense. IVir. Hardy, owner of the property on E1 Camino, North of Adeline Drive, ap- peared in favor of removing the eucalyptus trees in front of his property stating that he would be willing to leave the elm trees. The Planning Commission stated as a matter of general policy it is not in favor of the removal of the ornamental trees along E1 Camino Real and the subject was referred to the Park Superintendent for a report at a later meeting. Dr. Peterson appeared and stated that he had practised dentistry on Broadway for five years before joining the Navy. He is now out of the Navy and inquired as to the general policy of the Planning Commission in permitting a cientai office in an apart- ment house on E1 Camino Real. Dr. Peterson said that now he is out of the Navy and he desires to return to the Broadway area and he is thinking of buying a lot on the West side of El Camino Real North of Broadway, where he would plan to build an apartment house to include a dental office. He would not be a resident in the premises. Dr. Frank Lorenz was present and spoke in favor of Dr. Peterson's plan. After discussion Dr. Peterson was informed that the Planning Commission does not look with favor upon business offices on El Camino Real and he indicated that he will possib-y look for another location in the Broadway area. Heinz appeared with a petition and a .nap proposing to resubdivide Lots 11 2, and 3, Block 50, at the corner of E1 Camino Real and Adeline Drive. In the discus- sion of the subject it was brought out that the proposed resubdivision would create a new lot at the rear of the three lots referred to and thereby cut off access to the sewer and all of the utilities which are installed in the 10' alley. When this was pointed out to Mrs. Heinz, she indicated that she was not aware of this situation and was apparently satisfied that her project in its present form could not be approved by the Planning Commission. Mr. Whitman, the purchaser of the former Strung property on Burlingame Avenue adjoining the telephone building, appeared with his architect and drawings showing the proposed stores of the arcade type to be build on this property extending through to Chapin Avenue. After discussion the Planning Commission indicated that it mould look with favor upon such development which, however, would include embracing at least that part of Chapin Avenue in business use for which it is not now zoned. City Attorney Karmel advised Mr. Whitman about the procedure for filing the petition for a variance with the City Clerk, who will set a date for a hearing before the Planning Commission. lr. Hardy appeared with plans for a proposed apartment house on Lot 4, Block 51, E1 Camino Real which, after discussion was approved by the Commission, and the Secretary was authorized to signify approval on the permit when it is issued by City Building Inspector Watson. Chairman Mitchell brought up the increasing need for the proposed limited com- mercial zone in the Howard Avenue area as part of a Master Plan for the city. The map of the proposed limited commercial zone was discussed with City Engineer Longson, who stated he believed that he could complete the final details and have the map ready for the next meeting of the Planning Commission, A The meeting adjourned at 10:50 p.m. D.
