Date: 02.03.98 Margaret Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION and SIDE SETBACK VARIANCE RESO-3-98 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a side setback Y�rt1S& for the enclosure of an existing patio located within '- " of the interior id rp overty line of a�ngr lot at 1701 Ouesada WU,_zoned R-1, APN: 025-191-110; Jeffrey B. and Susan Jean Kocko , property owners: WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on January 26, 1998, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption per Article 19, Section 15301 Class 1 - operation, repair, maintenance, or minor alteration of existing public or private structure, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing, including but not limited to: (e) additions to existing structures provided that the addition will not result in an increase of more than: (1) 50 percent of the floor area of the structures before the addition, or 2,500 square feet, whichever is less, is hereby approved. 2. Said side setback variance is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such side setback variance are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the offic'al records of the County of San Mateo. ,t �e- CHAIRMAN I, Jerry L. Deal, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 226th day of January, 1998 , by the following vote: AYES: COMMISSIONERS: COFFEY, DEAL, GALLIGAN, LUZURIAGA AND KEY NOES: COMMISSIONERS: MINK ABSENT: COMMISSIONERS: WELLFORD S TARY EXHIBIT "A" Conditions of approval categorical exemption and side setback variance 1701 QUESADA WAY effective FEBRUARY 2, 1998 1. that the project shall be built as shown on the plan submitted to the Planing Department date stamped December 5, 1997 (sheets 1-9) with the wall of the proposed addition no closer than 3'-2" to the property line, and all exterior walls of the addition shall be built of one hour fire rated construction with no openings; 2. that, if required by the Building Department based on the construction plans submitted, the applicant shall complete a property line survey by a licensed surveyor; 3. that there shall be one unobstructed parking space in the garage which measures 10'- 0"W x 20'-0"L; 4. that the sunscreen presently attached to the eave and property line fence shall be removed within 20 days; and 5. that the project shall meet all the requirements of the California Building and Fire Codes, 1995 edition, as amended by the City of Burlingame.
