Date: 04.21.98 Margaret Monroe, City Planner RESOLUTION APPROVING A SPECIAL PERMIT for REAL ESTATE USE RESOLUTION 12-98 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a special permit for real estate use in an existing office building at 1815 El Camino Real, Suites 1& 2, zoned C-1, APN 025-122-120; Frank 1. And L.I. Venturelli, property owners; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on April 13, 1998, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and a Categorical Exemption per Article 19, Section: 15303 - Class 1 - the operation repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing including but not limited to (a) interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2. Said special permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such special permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. / CHAIRMAN I, Jerry L. Deal, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the lei day of April, 1998, by the following vote: AYES: COMMISSIONERS NOES: COMMISSIONERS: DEAL, GALLIGAN, LUZURIAGA AND KEY NONE ABSENT: COMMISSIONERS: COFFEY, MINK AND WELLFORD EXHIBIT "A" Conditions of approval categorical exemption and special permit 1815 EL CAMINO REAL, SUITES 1 & 2 effective APRIL 20, 1998 that the real estate office shall be limited to 485 SF in Suites 1 & 2, at 1815 El Camino Real, as shown on the plans submitted to the Planning Department and date stamped February 20, 1998 (site plan, floor plan and parking plan); 2. that the real estate office shall not be open for business except between the hours of 9:00 a.m. to 5:00 p.m. Monday through Friday; 3. that the number of employees shall be a maximum of 2; 4. that any changes in operation, floor area, use, or number of employees, which exceeds the maximums as stated in these conditions shall require an amendment to this use permit; 5. that the on -site parking shall be used for employees on -site and their clients/customers without any charge to the users or the business; and 6. that the use and any improvements for the use shall meet all California Building and Fire Codes, 1995 Edition as amended by the City of Burlingame.
