Date: 04.07.98 Margaret Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SIDE SETBACK VARIANCES RESOLUTION-10-98 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a Categorical Exemption has been proposed and application has been made for iS de Setback Variances for for a remodel and second floor addition at 1228 Cortez Avenue, zoned R-1, Stephen R. Johnson and Alisa M. Ruiz -Johnson property owners, APN• 026-155-190; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on March 23, 1998 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption, per CEQA Article 19, Section 15303, construction and location of limited numbers of new, small facilities or structures including (a) single-family residences not in conjunction with the building of two or more such units is hereby approved. 2. Said Side Setback Variances are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such Side Setback Variances are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CHAIRMAN I, Jerry L. Deal , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 23rd day of March , 1998 , by the following vote: AYES: COMMISSIONERS: COFFEY, CALLICAN, LUZURIACA AND REY NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: MIND AND WELLFORD ABSTAIN: COMMISSIONERS: DEAL EXHIBIT "A" Conditions of approval Categorical Exemption and Side Setback Variances 1228 Cortez Avenue effective APRIL 7, 1998 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped February 20, 1998, sheets 1 through 4 and sheet 6; 2. that the maximum elevation at the top of the roof ridge shall not exceed a height of 30'-0" as measured from the average elevation at the top of curb along Cortez Avenue (elevation +99.8'), and that the top of the second floor and the final roof ridge shall be surveyed and approved by the City Engineer as the framing proceeds and prior to final framing and roofing inspections. Should any framing exceed the stated elevation at any point it shall be removed or adjusted so that the final height of the structure with roof shall not exceed the maximum height shown on the approved plans; that the left and right side property lines shall be surveyed to verify the existing first floor setback; that the conditions of the Fire Marshal's, Chief Building Official's and City Engineer's February 2, 1998 memos shall be met; and 5. that the project shall meet all the requirements of the California Building and Fire Codes, 1995 edition, as amended by the City of Burlingame. 2
