Date: 09.10.98 Margar t Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND DESIGN REVIEW RESO-45-98 RESOLUTION APPROVING CATEGORICAL EXEMPTION and DESIGN REVIEW RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for special permits to construct a detached accessory structure with a window 4 ft from the rear 12= r y line and a portion of the structure to be used for recreational puposes at 1445 Cortez Avenue, zoned R-1 APN• 026-041-090; Paul E. Broeker and Shirley E. Lee, proper y owners; Whereas, said matters were heard by the Planning Commission of the City of Burlingame on August 24, 1998, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and a Categorical Exemption per Article 19, Section: 15303 - Class 3 - New construction or Conversion of Small Structures Class 3(e), Accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences is hereby approved. Said special permits are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such special permits are as set forth in the minutes and recording of said meeting. It is further directed that a certified copy of this resolution be recoroed in the official cords of the County of San Mateo. I, Dave Luzuriaga, Secretary of the Planning Commission (of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 24th day of August, 1998, by the following vote: AYES: COMMISSIONERS: LUZURIAGA, BOJUES AND VISTICA NOES: COMMISSIONERS: KEY ABSENT: COMMISSIONERS: COFFEY AND KEIGHRAN ABSTAIN: COMMISSIONER: DEAL Ss�--C RE..j-,q Q4 EXHIBIT "A" Conditions of approval categorical exemption and special permits 1445 CORTEZ AVENUE effective SEPTEMBER 09, 1998 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped August 3, 1998, Sheet G-1, Site Plan, Floor Plan and Elevations; and 2. that the conditions of the City Engineer's July 6, 1998 memo shall be met; 3 that the accessory structure shall never be used for accessory living or sleeping purposes; shall never include a kitchen, and shall not include plumbing or a toilet without an amendment to this special permit; and the parking area shall never be divided; and 4 that the project shall meet all the requirements of the California Building and Fire Codes, 1995 edition, as amended by the City of Burlingame.
