Date: 09.10.98 M Wz Margar t Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION and SPECIAL PERMITS RESOLUTION-43-98 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for special permits to allow an accessory structure in excess of 600 SF, roof height of accessory structure exceeding 10'-0" skylight higher than 10'-0" above grade and for a portion of the accessory structure to be used for recreational purposes work/storage area) at 33 Arundel Road, zoned R-1 APM 029-291-090 John Sudano,property owner; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on August 10, 1998, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and Connnission that: by this Planning On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and a Categorical Exemption per Article 19, Section: 15303 - Class 3 - New Construction or the Conversion of Small Structure including (e) accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences is hereby approved. Said special permits are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such special permits are as set forth in the minutes and recording of said meeting. It is further directed that a certified copy of this resolution be recordedtinAe official records of the County of San Mateo. f}C,r CHAIRM I, Dave Luzuriaga, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 1 Oth day of August, 1998, by the following vote: AYES: COMMISSIONERS: COFFEY, LUZURIAGA, BOJUES AND KEIGHRAN NOES: COMMISSIONERS: KEY ABSENT: COMMISSIONERS: VISTICA AND DEAL ABSTAIN: COMMISSIONERS: VISTICA xl/f sr-cRE%4 R EXHIBIT "A" Conditions of approval categorical exemption and special permits 33 ARUNDEL ROAD effective SEPTEMBER 9, 1998 that the project shall be built as shown on the plans submitted to the Planning Department date stamped June 25, 1998, Sheet G-1; 2. that the conditions of the Senior Engineer's June 29, 1998 memo shall be met; 3. that use of the structure shall be limited to off-street parking for vehicles and a work/storage area, and that the accessory structure shall never be used, rented, or converted into a second dwelling unit and that there shall be no sewer or water services connected to the accessory structure; and 4. that the project shall meet all the requirements of the California Building and Fire Codes, 1995 edition, as amended by the City of Burlingame.
