Date: ��08.04.98 Marg e Monroe, City Pi RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SPECIAL PERMIT RESOLUTION-36-98 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a special permit for yoga classes at 1816 Magnolia Avenue , zoned C-1, Frank J. & L.I. Venturelli,12roperty owners; APN: 025-122-120 WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on July 27, 1998 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15301, existing facilities, Class 1(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2. Said special permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such special permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. AL PRMAN I, Dave Luzuriaga , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 27th day of Lulv_, 1998 , by the following vote: AYES: COMMISSIONERS: COFFEY, KEY, LUZURIAGA, BOJUES, KEIGHRAN,VISTICA-AND DEAL NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: NONE :.:.- EXHIBIT "A" Conditions of approval categorical exemption and special permit 1816 Magnolia Avenue effective AUGUST 3, 1998 1. that the yoga studio shall be limited to 1090 SF at 1816 Magnolia Avenue as shown plans submitted to the Planning Department and date stamped June 11,1998, Site Plan and Floor Plans (8 1/2" x 11", 8 1/2" x 14" and 11" x 17"); 2. that the yoga studio may not be open for business except during the hours of 8:00 a.m. to 8:00 p.m., Monday through Friday and 9:00 a.m. to 6:00 p.m. Saturdays and Sundays with a maximum of one full-time and one part-time employee and 25 students for a maximum of 27 people on site at any one time; 3. that the conditions of the Chief Building Inspector's June 15, 1998 memo and the Fire Marshal's June 15, 1998 memo shall be met; 4. that any changes in operation, floor area, use, number of employees or number of students, which exceeds the maximums as stated in these conditions shall require an amendment to this use permit; and 5. that the use and any improvements for the use shall meet all California Building and Fire Codes, 1995 Edition as amended by the City of Burlingame. r7
