RESOLUTION APPROVING CATEGORICAL EXEMPTION, SPECIAL PERMIT and
PARKING VARIANCES
RESOLUTION-25-98
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
a special permit for the expansion (addition of 20 SF) of an existing restaurant on unclassified land
and parking variances for the number of parking spaces and parking space dimensions at 1190
California Drive zoned Unclassified APN• Portions of 026-234-010 and 093-361-010• Public
Utilities Commission of the City and County of San Francisco Water Department 425 Mason St.
#3 San Francisco CA 94102 and Peninsula Corridor Joint Powers Board of the State of
California P.O. Box 7791 San Francisco CA 94120 property owners
WHEREAS, said matters were heard by the Planning Commission of the City of
Burlingame on June 8, 1998, at which time it reviewed and considered the staff report and all
other written materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission
that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will not have a significant effect on the
environment, and Categorical Exemption per Article 19, Section: 15301 - Existing Facilities,
Class 1(e2), Additions to existing structures provided that the addition will not result in an
increase more than 10,000 SF if the project is in an area where all public services and facilities
are available to allow for maximum development permissible in the General Plan and the area in
which the project is located is not environmentally sensitive is hereby approved.
2. Said special permit and parking variances are approved, subject to the conditions set
forth in Exhibit "A" attached hereto. Findings for such special permit and parking variances are
as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the
records of the County of San Mateo. f

the Planning Commission held on the 88h day of June, 1998, by the following vote:

effective JUNE 8, 1998
1. that the project be developed in accordance with the plans submitted and date stamped May
29, 1998 sheets Al.l site plan, A4.1 east, west and south elevations, and A4.2 north
elevation and site section; and plan sheet date stamped May 6, 1998, existing restaurant
renovation;
2. that the present 9 parking spaces south of the restaurant on the Peninsula Joint Powers
Board land shall be converted to one disabled accessible, three parking stalls 13' x 9', one
15' X 9' and four parking stalls 20' x 9' and that the applicant shall retain for 10 years a
lease with the City and County of San Francisco (Water Department) for the landscape area
beginning at the corner of California and Broadway south to the drive way into the
CalTrans parking area and for the improvement, maintenance and use for parking of an
area 68 feet long and 18 feet deep south of the driveway parallel to California Drive and
the right to use the joint driveway for back up area; or if the lease on either of these two
areas in separate ownership is terminated by either side then the variance for parking for
a restaurant use on the Peninsula Joint Powers Board property is voided;
3. that all parking stalls be clearly stripped (3 Joint Powers Board 9' X 13' "Small cars
Only", and all spaces leased from San Francisco Water shall be painted to indicate they are
for "Compact Cars";
4. that the applicant shall be responsible for the relocation of any and all utilities in the public
right-of-way that may be affected by the expansion of the restaurant;
5. that the conditions of the City Engineer's May 11, 1998 memo (requiring all lease
agreements be signed and approved before issuing a building permit); Fire Marshal's May
11, 1998 memo(requiring a fire extinguishing system for the kitchen); and the Streetscape
Manager's memo of May 11, 1998, (requiring that flowering pear trees and ground cover
be installed where landscaping is shown on the site plan along the California Drive
frontage, that two metal dark green trash receptacles of the streetscape design be installed,
one at the font entrance and one at the corner of California Drive and Broadway at a
location as selected by the City Engineer, and damaged sidewalk shall be replaced with
colored concrete in a grid pattern which matches the streetscape plan) shall be met;
6. that irrigation installed according to the requirements of the city and as approved and
inspected by the Senior Landscape Inspector shall be placed within all required landscaped
areas;
7. that appropriate signs and/or stripping to clarify shall be installed to designate restaurant
parking spaces on both Joint Powers Board land and City and County of San Francisco land
leased by the applicant;

8. that employees shall not park in the designated parking spaces land leased by the applicant
and designated for restaurant patrons;
9. that the restaurant shall not be open for business except between the hours of 11:30 a.m.
to 10:00 p.m. Monday through Thursday, 11:30 a.m. to 11:00 p.m. Friday,11:30 a.m.
to 11:00 p.m. Saturday and 9:00 a.m. to 10:00 p.m. Sunday, with a maximum of 12
employees (including the owner) at this site at any one time;
10. that the operator or owner of the property shall apply for and obtain approval of an
amended special permit before any of the following occurs: intensification of the use of the
property, including any outdoor seating; substantive departure from the plans and conditions
approved under this special permit; and reduction in parking spaces, including any
reduction or elimination of parking on the property leased from the Peninsula Joint Powers
Board or the City and County of San Francisco or loss of lease rights to the landscaped
area along California Drive leased from the City and County of San Francisco;
11. that a disabled accessible van parking space shall be installed in the parking lot north of
Broadway on land leased from the Peninsula Joint Powers Board; all disabled parking
spaces provided on the site shall meet California Building Code requirements as amended
by the City of Burlingame;
12. that the project shall meet all the requirements of the California Building and Fire Codes,
1995 edition, as amended by the City of Burlingame; and
13. that this permit shall be subject to review in one year ( June 1999) and each year thereafter
or upon complaint.
