Date: 06.02.98 Iat Y U ll t I�C_— Margar tMonroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION and VARIANCE RESOLUTION-20-98 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a height variance for 35'-0" in height for a second story addition where 30'-0" is the maximum allowed at 2304 Poppy Drive, zoned R-1. APN• 027-144-020 ; _Jesse and Rosanna Myres 2304 Poppy Drive property owner and applicant: WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on May 26, 1998 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption per Article 19, Section 15301 Class 1 consists of the operation, repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing, including but not limited to: (1) 50 percent of the floor area of the structures before the addition, or 2,500 square feet, whichever is less is hereby approved. 2. Said variance is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such variance are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CHAIRMAN I, Jerry Deal , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 26th day of May , 1998 , by the following vote: AYES: COMMISSIONERS: NOES: COMMISSIONERS: ABSENT: COMMISSIONERS COFFEY, BOJUES, KEICHRAN, VISTICA AND KEY NONE NONE ABSTAIN: COMISSIONERS: DEAL AND LUZURIACA EXHIBIT "A" Conditions of approval categorical exemption and variance 2304 POPPY DRIVE effective JUNE 1, 1998 that the project shall be built as shown on the plans submitted to the Planning Department and date stamped May 12, 1998, except that the trim on all windows shall match that of the existing house and there shall be no skylights facing the street; and that the project as built shall meet all the requirements of the California Building and Fire Codes 1995 edition as amended by the City of Burlingame.
