RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SIDE SETBACK
VARIANCE
RESOLUTION-19-98
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for si e
setback variance for an accessory stnicture located forward of the rear thirty percent of the length of the lot
lines at 1005 Drake Avenue zoned R-1 APN 026-185-110 Melanie P Mountanos. property owner;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on May
26, 1998, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
Article 19. Section: 15303 - construction and location of new, small facilities or structures - (e) accessory
(appurtenant) structures including garages, carports, patios, swimming pools and fences.
2. Said variance is approved, subject to the conditions set forth in Exhibit "A" attached hereto.
Findings for such variance is as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held
on the 26th day of May, 1998 , by the following vote:
AYES: COMMISSIONERS: COFFEY, DEAL, LUZURIAGA, BOJUES, KEIGHRAN AND KEY
NOES: COMMISSIONERS: VISTICA
ABSENT: COMMISSIONERS: NONE
EXHIBIT "A"
Conditions of approval for categorical exemption and variance.

effective JUNE 1, 1998
1. that the project shall be built as shown on the plans submitted to the Planning Department
date stamped April 9, 1998;
2. that the conditions of the Chief Building Official's April 13 and April 21, 1998 memos
shall be met;
3. that should the pool equipment ever be abandoned or the swimming pool removed or
rebuilt the pool equipment enclosure shall be removed and in no case shall this structure
ever be used to house a toilet, sink or for any living purpose;
4. that gutters shall be placed on the pool structure to insure that drainage is contained on the
property;
5. that the structure shall be adequately insulated so that the noise level at property line shall
not be increased by 5 dBA;
6. that the vent pipe shall be painted a non -reflective color to match the roof color of the
structure; and
7. that the project shall meet all the requirements of the California Building and Fire Codes,
1995 edition, as amended by the City of Burlingame.
