Date: 10 29.9 Margare Monroe City Pla er RITITLLING -ACTUAL COUNTS MISSING ON ORIGINAL RESOLUTION APPROVING CATEGORICAL EXEMPTION AND SPECIAL PERMIT RESO-15-98 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a Categorical Exemption has been proposed and application has been made for a Special Permit for for take-out food associated with an existing grocery store use at 1477 Chapin Avenue, zoned C-1, Subarea B-1, Weiman Syndicate, property owner, APNS: 029-122-010 & -020; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on ril e 1 1998 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption, per CEQA Article 19, Section 15301 - Existing facilities, Class 1(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2. Said Special Permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such Special Permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CHAIRMAN I, Jerry L. Deal , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 2 7th day of -April , 1998 , by the following vote: AYES: COMMISSIONERS: COFFEY, DEAL, GALLIGAN, LUZURIAGA AND KEY NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: MINK AND WELLFORD EXHIBIT "A" Conditions of approval Categorical Exemption and Special Permit 1477 Chapin Avenue effective MAY 4, 1998 that the project shall be built as shown on the plans submitted to the Planning Department and date stamped March 12, 1998, Site Plan, Floor Plan, Elevations, and Landscape Plans; 2. that the conditions of the Chief Building Inspector's March 16, 1998 memo, the Fire Marshal's March 16, 1998 memo, the City Engineer's March 16, 1998 memo and the Streetscape Manager's March 24, 1998 memo shall be met; that the store may not be open for business except during the hours of 7:00 a.m. to 10:00 p.m., seven days a week without amendment to this permit; that the applicant shall purchase and maintain at least daily, more often if necessary, two trash receptacles, one to be placed inside the door to the store, and one of the type selected by the Burlingame Avenue streetscape study to be placed on the sidewalk along Chapin Avenue at a location as approved by the City Engineer; 5, that the applicant shall remove once a day or more frequently, if determined to be necessary by the City, all take-out debris on the sidewalk, in the gutter, and in planters in front of the store along El Camino Real and Chapin Avenue, and within 50' of the property the store is located on in each direction; and 6. that the use and any improvements for the use shall meet all California Building and Fire Codes, 1995 Edition as amended by the City of Burlingame.
