The Regular Meeting of the Planning Commission was held in the City Hall at
7:45 p.m. Thursday, June 29, 1944.

There appeared at this meeting a group of property owners comprising the fol-

Mr. Quinn, speaking for this group, said that they desire to enter a vigorous protest
with respect to the remodeling or reconstruction of a residence on Cypress Avenue,
near Barriolhet Avenue, where a residential structure has been remodeled or recon-
structed only three feet from the front property line. City Attorney Karmel was present
and stated that he being familiar with the subject, outlined it substantially as follows:
The property referred to is included in the triangular area known as the old Ackerman
Estate from which the family moved away years ago and the main house was rented out as
a rest home. Subsequently, the City Council on the recommendation of the Chief of the
Fire Department, condemned the old residence and it was torn down leaving two old, small
structures on the property, one of which is now the subject of the present complaint.
Mr. Karmel said that the present situation is evidently the result of a misunderstand-
ing between the owner and Building Inspector Matson which evidently arose from a con-
versation they had in which the owner claims he made inquiry about obtaining a permit
and the building inspector claiming that he was told the reconstruction cost would not
exceed 50% of the value of the building, stated that a formal permit was not necessary.
At this point, Mr. Quinn representing the protestants, said that none of the neighbors
have any objection whatever to the remodelled structure on which they estimate that
possibly $2,500 has been spent in making it attractive, but they do earnestly protest
what they believe is a violation of the set -back ordinance; that if the location of the
building complied with the set -back ordinance, they would have no complaint. After con-
siderable discussion Commissioner Coles moved and Commissioner Dr. Macomber seconded
that a motion be entertained that the Planning Commission recommends to the City Council
that it take steps to have the structure moved to conform to the set -back ordinance.
After further discussion this motion was carried by an affirmative vote of all the com-
missioners present.
Commissioner Coles inquired as to the disposition of the letter to the City
Council under date of May 8, suggesting that consideration be given to an ordinance to
set up a reserve for capital outlay funds, and the Secretary was instructed to make in-
quiry of the Council on this subject.

Chairman Mitchell noted that Clyde Manwell of the Burlingame Chamber of
Commerce was present and invited him to address the Commission on a subject in which he
is interested. Mr. Manwell stated that he is Chairman of the Post -Jar Planning Commit-
tee of the Burlingame Chamber of Commerce and that his group favors a study and the
preparation of definite projects for post-war development in keeping with the high-class
residential character of the community. After some discussion on this subject Chairman
Mitchell stated that the Planning Commission would be pleased to have Mr. Manwell attend
the meetings and instructed the Secretary to add Mr. Manwell's name to the mailing ii..t
to receive notices of the Planning Commission meetings.
Councilman Roth and City Attorney Karmel referred again to the subject of the
letter of May 8, 1944., regarding the setting up of a reserve for capital outlay funds,
which had been received and read before the council and said that it was placed on the
agenda for attention as soon as possible.
Chairman Mitchell also inquired about the letter to the City Council from the
Planning Commission May 29, 19,44 regarding the suggestion for rezoning the North
Broadway area and California Drive. Councilman Roth was present and stated that com-
munication also was received by the Council and that it too will receive attention as
soon as possible.
. Councilman Roth referred to an inspection he has made of the Lang duplex de-
velopment on the Bayshore Highway and the residence now under construction on Lot 5.
Building Inspector Matson reported that the duplexes comply with the government regula-
tions and that Mr. Lang has evidenced a cooperative spirit regarding the garden work
which he agreed to do, and as a matter of fact, has already performed a considerable
amount of such work, which is still going on at the present time. With reference to the
residence under construction on Lot 5, Building Inspector Fatson reported that he has
checked the work done and it fully complies with the city ordinances.
