Categorically Exempt per Section: 15301 - Existing facilities, Class 1(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances. Previous Use: Automobile Rental, Offices and Warehouse Proposed Use: Automobile Rental and Warehouse Allowable Use: Automobile Rental subject to performance standards with a special permit. Summary: The applicant, Dollar Rent A Caz, Inc., is requesting amendments to special permits to reestablish and reconfigure an existing automobile rental business at 1801- 1831 Bayshore Highway and 840 Cowan Road, zoned O-M. History: A special permit was first granted for a car rental agency at 1815 Bayshore Highway in 1969. In 1978, the special permit was amended to include car storage at a parcel located behind 1831 Bayshore Avenue. In 1979, a special permit was approved for property at 840 Cowan Road to provide additional vehicle storage for the Dollar Rent A Car business at 1815 Bayshore Highway. In 1979, an special permit amendment was granted to authorize the sale of used rental cars on the front portion of the lot located at 1801 Bayshore. This area is no longer used for-�ental car sales, and that permit will be revoked as a part of this action. The applicant now wants to use the previous car sales area as customer parking and rental vehicle storage. Within the last few years, Dollar Rent A Car has been leasing the property at 1831 Bayshore Highway for their corporate offices. Since this was an office use, no special permit was required. Current Proposal: The cunent special permit application is to operate Dollar Rent A Car as a sole tenant business on these 4 properties and to consolidate all previous approvals. While operating as a sole tenant on three of the properties (totaling 4.81 acres), they are not in common ownership so will not be merged, therefore the uses of each interrelated site are outlined below: ' AMENDMENT TO SPECIAL PERMITS I801-1831 Bayshore Highway & 840 Cowan Road 1831 Bayshore Highway - The existing office building on this site will be used for regional offices and as a tour center to process car rental transactions for pre-sold tour travelers. There are two spaces for pazking of two tour buses and two handicap parking spaces adjacent to the building. The paved azea behind the building along Cowan Road will continue to be used for rental car storage for 45 cars. 1815 Bayshore Highway - The existing building will be remodeled and a porkion of the building fronting on Bayshore Highway will be demolished to accommodate a maintenance, cleaning, servicing and fueling facility for the rental fleet vehicles. Some car rental storage and customer parking (23 spaces) will also be provided on this site. 1801 Bayshore Highway - There is an existing warehouse building on the site which is used by Crossroads Espresso. This use will remain, and the required 12 parking spaces for this building will be designated adjacent to the building. The remainder of the parking spaces on the site will be used for customer and employee parking (20 spaces) for the Dollar Rent A Car facilities at 1815 & 1831 Bayshore Highway and for rental vehicle storage (12 spaces). This site is not included in the 0.7 acre minimum acreage to meet the criteria for car rental use in the O-M district since Dollar Rent A Car is not the sole tenant of the site. 840 Cowan Road - This site is currently used for rental vehicle storage (storage for 300 cars) and employee parking (15 parldng spaces). The area is to be used for de-fleeting and in-fleeting staging of the rental vehicles. All cars will be off loaded and loaded onto car carriers on this site. The entire Dollaz Rent A Car facility will consist of a 10,000 SF building to be used as a tour center and corporate offices, a 6000 SF building for servicing rental car vehicles, 28 employee/customer parking spaces and 5 handicap parking spaces at 1801 and 1815 Bayshore Highway; a loading area to accommodate two tour buses at 1831 Bayshore Highway, 15 employee parking spaces at 840 Cowan Road, 67 parldng spaces for rental vehicle storage at 1801-1831 Bayshore Highway, and storage for 300 rental vehicles at 840 Cowan Road, a total of 4.81 acres. The existing Crossroads Espresso Warehouse and its required 12 parking spaces will remain on the western portion of the site at 1801 Bayshore Highway. There will be a total of 46 employee/customer parking spaces and storage for 367 rental vehicles for the Dollar Rent A Car facility. The average monthly rentals are projected to be 1305 vehicles; therefore car storage is provided for 28% of the fleet. The automobile rental facility will be open for business seven days a week from 6:00 a.m. to 11:00 p. m. Currently there aze 24 full-time employees and 1 part-time employee on weekdays before 5:00 p.m., and 1 full-time employee after 5:00 p.m. On weekends, there are two full time employees before 5:00 p. m. and 1 full-time employee after 5:00 p. m. In two years, the there is expected to be 32 full- time and 1 part-time employees on weekdays before 5:00 p. m. , and 4 full-time employees after 5:00 p.m. It is expected that there will be 6 full-time employees before 5:00 p.m. and 2 full-time employees after 5:00 p. m. on weekends. There are cunently a maximum of 60 visitors/customers per day who come to the site. This number is expected to increase to 80 people in 2 years and to 100 people in 5 years. A maximum of 47 people are expected to be on site at any one time. There are also six, 18-passenger buses and one cargo van which will bus customers from the airport to the site. No lazge deliveries to the site for this business are expected. E ' AMEN`DMENT TO SPECIAL PERMITS 1801-I83I Bayshore Highway & 840 Cowan Road The O-M zoning district specifies that automobile rental businesses require a special permit and must meet the following minimum standards. 1. the use is the sole tenant and only occupant of any building or area on the site; 2. the site has a minimum size of .7 (seven-tenths) of an acre; 3. pazking is provided on site for storage of at least 25 percent of the cars rented monthly, based on an annual average for the site; 4. parking is provided on site for all employees and customers; and 5. the use meets all the other requirements of development in the district, including peak hour trip generation at critical intersections as defined in the Traffic Analyzer and Specific Area Plan for the Bayfront/Anza Areas. Since there is no expansion of the use beyond what was previously at the site, and no new or expanded buildings aze proposed, there will be no increase in vehicle trips. Therefore, it was determined that an analysis of the traffic impacts of this project using the Traffic Analyzer is not required. There are two buildings which will be used for the automobile rental business, and the use is the sole tenant of each building. The combined acreage of the Bayshore site is 2.31 acres, and the Cowan Road site consists of 2.5 acres, a total of 4.81 acres where 0.7 acre is the minimum required. As noted in the attached letter from Dollar Rent A Car date stamped August 29, 1997, the average number of vehicles rented is 1305 per month. This results in a requirement of storage for 326 vehicles (25 % of 1305 rentals per month). There is storage space on the two sites for a total of 367 vehicles (28 % of the fleet on a monthly average). In addition, a total of 46 employee/customer parking spaces are provided on the two sites (maximum of 32 employees expected per shift). Since there will be no additions to buildings or no new buildings proposed, the Bayfront Development Design Guidelines do not apply. In addition, the landscaping requirements of the O-M district only apply when structures aze added or expanded. However, the applicant is proposing to increase the amount of landscaping along the frontage at 1801 Bayshore Highway, and to maintain the exisdng landscaping on the balance of the sites. The landscaping requirements for 840 Cowan Road were a part of the previous use permit and have been met. Staff Comments: The City Engineer notes (August 1, 1997 memo) that a special encroachment permit may be required for the illuminated monument sign shown along Bayshore Highway, and that an encroachment permit will be required for any new curb/gutter and driveway installation or driveway widening. The City Engineer also notes (September 2, 1997 memo) 1) a concern that storage for airport car rental continues for pollar Rent A Car, the traffic problems by that use will remain without revenue from the use; 2) that proper signing for parking space assignment is needed; 3) a traffic signal is being considered at Cowan Road and Bayshore Highway, and this facility should participate in its portion of the cost based on their traffic use; 4) the sign at the entrance on Bayshore may be in the public right-of- way and must be relocated, the sidewalk is not shown on Bayshore, show details; 5) show traffic pattern proposed by shuttle buses, there is a median in Bayshore Highway so no left turns are possible. The Chief Building Inspector and the Fire Mazshal had no comments on the project. 3 ' AMEIVDMENT TO SPECIAL PERMITS I801-1831 Bayshore Highway & 840 Cowan Road Planning staff would note that on a site visit the week of August 25, 1997, a car carrier was observed unloading vehicles on the street in front of 840 Cowan Road, an activity which blocks the free, safe flow of traffic on Cowan Road. Also, these sites although used together for this activity are independently owned; therefore interlocking use permits will be required to insure that when the use leaves one of the sites, all the others will be automatically up for review so that the deficiencies caused by the change can be addressed on the remaining sites or the operation/use changes to accommodate. Plans should show how car carriers will unload and load vehicles on the 840 Cowan Road site and what provisions will be made for their continued access to the area. To be providecl out of total requirecl parking 25 � of average monthly rentals = Storage for 326 vehicles Study Meeting: At the September 8, 1997 Planning Commission study meeting, the commission asked staff to clarify which conditions will apply to specific sites and which to all sites, and how will the flexibility for the whole use be achieved. Staff has prepared the conditions so that there is an overall condition applied to each property which ties all of the properties together into one special permit, and specific conditions are applied to each address. Since this special permit application is for one activity on several parcels which aze interdependent on each other, it was determined that it was best to make sure that the properties be tied together in one special permit. If any of the properties is removed from the operation, this special permit would become null and void, and a new special permit would be required to make sure that all requirements for the use were met on the remaining property. The Commission asked what the City revenue is from this site now and what will it be if this project is developed. The City Finance Director has indicated that sales tax information on individual properties is confidential, and cannot be provided to the Commission. The Commission also asked how many cars are rented from this site now, and how many will be rented from it after the changes. The applicant has responded in the attached letter date stamped September 16, 1997. Dollar Rent A Car averages 1015 rentals per month of cars stored at this site. However, all the rental contracts have been written at the airport, therefore the city receives no sales tax from these transactions. After this change, about 1305 rental contracts a month for pre-sold tours will be signed in Burlingame at 1831 Bayshore Highway. 4 ' AMENbMENT TO SPECIAL PERMITS I801-1831 Bayshore Highway & 840 Cowan Road The Commission notes that the O-M district requires that there be a specific site size and that the car rental operator be the sole tenant, how does this apply to the Crossroads Expresso site where there is already one business on the site, is this an existing nonconforming use? The O-M district requires a minimum 0.7 acre site for a car rental facility, but it doesn't require that it be on one pazcel. The property at 1801-1831 Bayshore Highway actually consists of four separate parcels, combined they total 2.31 acres; the site at Cowan Road consists of 6 parcels totaling 2.5 acres. A portion of the Crossroads F�cpresso site has been used by Dollaz Rent-A-Car site since 1980 and therefore the dual use of this site is existing nonconforming. Staff would note that this portion of the site is not needed to meet the zoning requirement for a minimum 0.7 acre site, and there is adequate parking for the Crossroads Expresso building designated on the site. The Commission also noted that they are providing required parking on separate sites, can the 0.7 acre requirement be met on different sites, and have we allowed off-site parking. The site at 1801 Bayshore consists of 0.77 acre, 1815 Bayshore consists of 0.64 acre, 1831 Bayshore consists of 0.90 acre, and 840 Cowan Road consists of 2.5 acres. As noted above, it is not required that the 0.7 acre minimum be met on each separate parcel, since the special permit will require all parcels to operate interdependently. It should be noted that although some employee parking is designated at the 1801 Bayshore site and the Cowan Road site, as proposed each property meets its own on-site parking requirement (based on building square footage and use). The storage of cazs and the employee parking at 840 Cowan Road is in excess of the minimum requirement. The Commission noted that the previous use pernut on the Cowan Road site showed layout that provided for car delivery trucks to load and unload on site, asked how this is provided in this application, and asked that this be notetl on the current plans. The applicant has submitted revised plans for the Cowan Road site date stamped September 16, 1997 showing a location for car carriers to load and unload and the arrangement of storage areas to accommodate this truck access and loading/unloading. Findings for a Special Peimit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution and should include findings. The reasons for any action should be clearly stated. If at any time, the supporting activity for car rental on any one of the properties is suspended or revoked, rental car use on all of the other properties shall also be suspended or revoked unless the City expressly provides otherwise in writing; 2. that the use of 1801 Bayshore Highway shail be as shown on the plans submitted to the Planning Department and date stamped August 26, 1997, Sheets A-0, A-1.1, A-2, A-2.2, A-2.4, A-3.0, M-1, LA1 and Ref, and Sheet A-1, Site Plan, date stamped August 29, 1997; 3. that 12 parking spaces shall be designated on this site, as shown on the site plan date stamped August 29, 1997, with spaces X-E1 through X-E11 designated on this site and space X-E12 which crosses the property line and is partially located on the 1815 Bayshore Highway site, to be used by the existing warehouse building so long as that use remains on that site, and if the use in that building changes, the appropriate number of parking spaces on site shall be designated for that building; 4. that the remaining parking spaces on the site shall be designated and used for 18 employee parking spaces on this site for the rental car facility and 9 employees spaces which cross property lines and are shared with the site at 1815 Bayshore Highway; and 12 spaces for rental fleet vehicle storage, as designated on the site plan, Sheet A-1, date stamped August 29, 1997; 5. that all the conditions of the City Engineer's August 1, 1997 and September 2, 1997 memos shall be met and/or complied with in the future as required; and 6. that the use and any improvements for the use on this site shall meet all the requirements of the California Buildirig and Fire Codes, 1995 Editioq as amended by the City of Burlingame and all the applicable requirements ofNPDES. 1815 Bayshore HighwaX (Lot 3, Block 2, East Millsdale Industrial Park No. 1, RSM 50/24 & 25 and Adjacent Portion of Bayshore Highway Abandoned; APN 024-401-500) 1. that the special use pernut for rental car use on 1801 Bayshore Highway, 1815 Bayshore Highway, 1831 Bayshore Highway and 840 Cowan Road is only being granted by the City because of the interrelationship of activity for that use on each and every one of the properties as described in the plans submitted to the Planning Department date stamped August 26 and 29, 1997 and September 16, 1997, including any letters and staff reports describing the physical operation and use of these sites individually and together. C. Galligan indicated that as a business relationship with the applicant and would abstain from any debate or action on is application. He felt it was pertinent to know this since there will not be a full co ' sion seated by the next meeting. REED TRUST AND CENTURY INVESTMENTS, INC., PROPERTY OWNERS).
