(Action alternatives and required findings for a use permit are attached at the end of this staff report.) Affirmative action should be by resolution; the City Attorney will prepare a resolution reflecting Council�s action for adoption at its next meeting. The reasons for any action should be clearly stated for the record. Planninct Commission Action At their meeting on February 26, 1990 the Planning Commission held.a public hearing and voted 6-0 (Commission Graham absent) to grant a special permit for Alamo Rent-A-Car to use the 2.5 acre lot at 840 Cowan Road for auto storage. There were nine conditions required, one addressing relocating the required landscaping to the front of the site to be consistent with the 25' front setback required in the area was added by the Planning Commission after their review. The Commissioners� comments focused on the need to have the landscaping at the front of the lot to help screen the parking areas, appreciation of the parking use in this area where uses generating parking is a real problem, a berm is needed so that the cars are less obvious, only a narrow strip of landscaping is needed at the rear since no one sees it or uses it; 25 � comparable to the required building setback was suggested; fencing should include slats to further screen the views of cars and should be placed at the back of the landscaped area and along the side and rear property lines; the motion for approval included the statement that the conditions (as revised) make the project acceptable: l. that the site shall be developed and improved as shown on the plans submitted to the Planning Department and date stamped February 5, 1990 except that 15 easily accessible parking spaces shall be designated on site for employee use and the site shall be relaid out to facilitate loading and unloading of car carrier/vehicle transport trucks on site; 2. 3. that the conditions of the City Engineer�s memo of January 3, 1989, revised January 16, 1989, shall be implemented; , that the 2.5 acre site shall be regraded to drain toward the street and paved; j1 , �� , 2 4. that the site shall only be used for off-site auto storage by Alamo Rent-A-Car to be used in conjunction with their facility at 1470 Bayshore Highway and no part of the site shall be sublet to another business for any use; 5. that no cars shall be rented, washed, serviced or �epaired on this site nor shall customers be dropped off or picked up from this site; 6. that the storage area shall operate between 6:00 A.M. and 10:00 P.M. daily except that no cars shall be transferred to or from the storage area to the rental facility at 1470 Bayshore Highway between the A.M. peak (7:00 A.M. to 9:00 A.M.) and P.M. peak (4s30 P.M. to 5:30 P.M.) traffic hours; 7. that 10� landscaping shall be provided on the 2.5 acre site including a 25� landscaped and bermed area parallel to the street of sufficient height to screen the view of parked cars from pedestrians and vehicles passing by on the street, the remaining required landscaped area may be placed at the rear of the property; an opaque fence no higher than 8� shall be placed along the rear of the 25� deep front landscaped area parallel to the street and along the remaining sides of the 2.5 acre site; all landscaping shall be irrigated with an automatic system and shall be maintained by the tenant, all landscaping, irrigation systems and plant material shall be approved by the Director of Parks for compliance with these conditions before installation and inspected at the completion of installation; 8. that any change to the manner, hours or any other aspect of this operation or termination of the Alamo use at either 840 Cowan Road or 1470 Bayshore.Highway shall result in review of both use permits; and 9. that this conditions thereafter BACKGROUND: use shall be in six months or upon complaint. reviewed for compliance wi�h the (August, 1990), every two years Alamo Rent-A-Car located at 1470 Bayshore Highway/778 Burlway Road is requesting a conditional use permit in order to use a 2.5 acre parcel for a car rental fleet storage area at 840 Cowan Road, zoned M-1 (to be used in association with their car rental facility on Bayshore Highway/Burlway Road) (Code Sec. 25.43.030-d & r). The entire site will be paved and 300 automobiles stored for rental from Alamo�s Bayshore Highway site. The storage lot will be open from 6:00 A.M. to 10:00 P.M. daily. No employees will report to work at the storage yard; however, as many as 15 employees may work there in the course of a day. No �auto maintenance or repair work will be done at 840 Cowan Road although damaged rental vehicles may be stored there temporarily. Alamo will � � � ' 3 also keep a tow truck on site and expects, on average, seven car carriers to visit the site each day. This 2.5 acre site has an access easement across it to a city pump station. Conditions on the permit require that this access be retained and unobstructed at all times. In the past this site has been used as an adjunct to the Dollar Rent A Car site at 1815 Bayshore Highway. In February, 1979 Dollar Rent A Car received a special permit to use the eastern half of the site for employee parking and auto storage. The other half of the site (western) was left vacant and subject in the future to a separate use permit application. Dollar was required to find the additional space because of the impact their use on the Bayshore Highway site was having on their neighbors. Their site had a second access to Cowan Road so no employee or storage traffic impacted Bayshore Highway. (Dollar now proposes to relocate out of Burlingame. They will not relinquish the use of 840 Cowan until they have relocated the car rental portion of their business.) In March, 1989 Dollar Rent A Car submitted an application to use the western half of the 840 Cowan Road site for storage of new cars and used cars being rotated in and out of their fleet. This use was approved with the limitation that it was to be associated only with Dollar Rent A Car. The required improvements were never made to the western portion of the site by Dollar, although they did fence the area. The use of this site by Alamo impacts two existing use permits, Dollar Rent A Car at 1815 Bayshore Highway and Alamo Rent-A-Car at 1470 Bayshore Highway/778 Burlway Road. Dollar�s use permit on this site wi11 expire when Alamo begins to use it under the new use permit. This will also terminate the Dollar use permit to operate a car rental agency at 1815 Bayshore Highway since this permit is linked to the availability and use of the Cowan Road site. The Alamo use of the Cowan Road site also needs to be tied to Alamo�s use of their site at 1470 Bayshore Highway since use of the Cowan Road facility is allowing some intensification of the use at the Bayshore/Burlway Alamo car rental site. Alamo has requested an increase in fleet size (cars rente� from the Bayshore/Burlway site) of 300 cars and an increase in employees by five. These increases have already occurred because they have been using a storage facility elsewhere in the city. We have been enforcing on them because they have no permit to use the other site for car storage. In this review process it also became clear that they had exceeded the fleet size and maximum employee numbers of their original use permit (July, 1983). City Council may vote in favor of an applicant�s request. If the action is a variance, use permit, fence exception or sign exception, the Council must make the findings as required by the code. Findings must be particular to the given property and request. Actions on use permits should be by resolution. A majority of the Council members seated during the public hearing must agree in order to pass an affirmative motion. 2. City Council may deny an applicant�s request. The reasons for denial should be clearly stated for the record. 3. City Council may deny a request without prejudice. This action should be used when the application made to the City Council is not the same as that heard by the Planning Commission; when a Planning Commission action has been justifiably, with clear direction, denied without prejudice; or when the proposed project raises questions or•issues on which the Council would like additional information or additional design work before acting on a project: Direction about additional information required to be given to staff, applicant and Planning Commission should be made very clear. Council should also direct whether any subsequent hearing should be before the Council or the Planning Commission. State law requires that council annually review the investment policy for city funds. COUNCIL COMMITTEE REPORTS Council of Mayor's Legislative Committee: Councilwoman O'Mahony reported on recent State legislation reviewed at the Legislative Committee meeting; Senator Kopp and Assemblywoman Speier were present and argued the proposed southern crossing of the bay. Peninsula Water Agency: Councilwoman O'Mahony reported on a recent meeting at which there was not a quorum and the county's reluctance to form a JPA with other counties. NEW BUSINESS Schedule Hearinq: Mayor Lembi scheduled an appeal hearing for March 19 for Alamo Rent-A-Car at 840 Cowan Road. Parking Structure: Mayor Lembi announced that the new parking structure ribbon cutting ceremony was scheduled for Friday, March 9 at 9:00 a.m. ACKNOWLEDGMENTS a. CP Monroe reviewed details of the request, present use of the site by Dollar Rent A Car, staff review, Planning staff comment, applicant's letters, study meeting questions. CP noted a change to statement in the staff report (page 3): storage on the Alamo Bayshore/Burlway site will remain at 225 cars in addition to the 300 cars at the Cowan Road site. Eight conditions were suggested for consideration at the public hearing. Discussion: all CE's requirements of the Dollar permit are included in the conditions; add to condition #5 ". .. washed, serviced, or repaired ..."; hours during which vehicles shall not be transferred should be the same in the conditions for 840 Cowan and 1470 Bayshore/778 Burlway, i.e., 7:00 A.M. to 9:00 A.M. and 4:30 � ,, � �� Burlingame Planning Commission Minutes Page 5 February 26, 1990 P.M. to 5:30 P.M.; concern about creating an eyesore with chain link fence and weeds (CP noted plans include that 10� of the site will be landscaped with required irrigation, the rest of the site will be paved, landscaping plans must be approved by the Director of Parks). Further comment: possibility of opaque fencing, would like to improve appearance in this area; damaged vehicle�:will be visible, something should be done to screen them with fencing and maintain the landscaping; landscaping always seems to be on the drainage channel, would rather see more landscaping in the front, even placing a berm 4� high would help in screening. Chm. Ellis opened the public hearing. Lester Meu, representing Alamo Rent-A-Car was present. He stated the circumstances of the application have been well described by the City Planner. Alamo has asked him to request a continuance if there are operational issues and/or significant changes to the project, in this way they could investigate and work with staff to determine if they want to go ahead with purchase of the property, they would rather do this than appeal a decision later. There were no audience comments and the public hearing was closed. Commission discussion/comment: would like to see a plan showing more landscaping to the front of the property which would help screen parking areas from the street; parking on Cowan is an extreme problem, there is a lot of on-street parking now, like the proposed use of this site for parking; would suggest some type of berming, 4-1/2 � to 5� high, so that cars are not seen to such an extent from the street, prefer the strip along the front to be wider and strip along the back narrower; seems logical to require landscaping further into the property, possibly 25�, at the front and take a comparable amount of space off the back as long as applicant still has space to park cars. Commission discussion continued concerning a fence with slats, height of berm; Park Department with its knowledge could work with the applicant to maximize the berm within the limifs of good landscaping and oversee planting between curb and the 25� setback line, leave it to the Park Department to maximize the effects. Staff pointed out at the building permit stage landscaping and irrigation plans must be approved by the Park Department. With the statement the conditions make the use acceptable and compatible in this area, C. There were no audience omments and t e public hearing was closed. �' ''� T . �, i ' P.C. 2/26/90 Item # 7 MEMO T0: PLANNING COMMISSION FROM: SUBJECT: CITY PLANNER SPECIAL PERMIT FOR AN AUTO STORAGE FACILITY FOR ALAMO RENT-A-CAR AT 840 COWAN ROAD. ZONED M-1 Alamo Rent-A-Car (located at 1470 Bayshore Highway/778 Burlway Road) is requesting a conditional use permit in order to use a 2.5 acre parcel for a car rental fleet storage area in association with their car rental facility at 840 Cowan Road, zoned M-1 (Code Sec. 25.43.030-d and r). The entire area will be paved and 300 automobiles stored on site for rental from Alamo�s Bayshore Highway site in Burlingame. The facility will be open for transfer of vehicles seven days a week from 6:00 A.M. to 10:00 P.M. No employees will report to work at the storage yard but during the hours of operation 15 will be on site for the delivery and removal of vehicles. The site is presently being used by Dollar Rent A Car for employee parking, off-site vehicle storage, delivery of new and removal of old fleet vehicles. The site is used as an adjunct to the Dollar car rental site at 1815 Bayshore Highway which has a secondary access to Cowan Road. Staff Review City staff reviewed this request and had no comments except to note that the same Building, Fire and Engineering conditions required of Dollar Rent A Car storage use at this site should be applied to Alamo storage use. Planning staff would note that in his use permit request the applicant notes the following: the use will be only for Alamo overflow parking; truck carriers will be used to deliver and take away vehicles and they will unload on the storage site; the use will not affect the city's access to the storm drainage station; no customers or visitors will be allowed on the property; employees will not park on the site; the unpaved portion of the site will be paved; the property will be fenced, there will only be one business using the site (Alamo Rent-A-Car). A letter from a representative of the corporation owning the 840 Cowan site (Caruso letter, January 19, 1990) acknowledges that at the time Alamo begins using the site at 840 Cowan for auto storage the Dollar Rent A Car facility at 1815 Bayshore Highway will cease to be used for car rental. The Dollar corporation may continue to use the building as a corporate or general office use for a period before relocating out of Burlingame altogether. A�plicant' s Letter , , In their letter supporting their application and request Steven Elkin (January 19, 1990 letter) comments that they will only move '1. ; , 'S ; � -2- cars during the A.M. (7:00-8:00 A.M.) and P.M. (6:30-7:30 P.M.) peak hours when necessary. (Note: The Public Works Department comments that the traffic peak in the area in the A.M. is 7:00 to 9:00 A.M. and the P.M. peak is 4:30 to 5:30 P.M.) Mr. Elkin notes that the cars will be moved between 840 Cowan and 778 Burlway Road/1470 Bayshore Highway. In a subsequent letter (February 2, 1990) Mr. Elkin notes that the location of the storage area on Cowan Road will have little effect on the operation of Alamo since this just represents a relocation of the storage activity from another site. He states there will be no increase in number of employees, no customers will park there, no shuttle buses will stop there, the size of Alamo�s rental fleet will not increase and the level of activity on the Burlway/Bayshore Highway site will stay the same. In support, Rick Caruso representing the property owner (January 19, 1990 letter) notes that Dollar Rent A Car will cease their rental operation on Bayshore Highway when Alamo occupies the site at Cowan Road, although Dollar may continue to use the site for an office use for a limited time. Findincrs for a Conditional Use Permit In order to grant a conditional use permit the Planning Commission must find that the following conditions exist on the property (Code Sec. 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the planning commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Stuciy Ouestions The Planning Commission reviewed this request at study on February 13, 1990 (Planning Commission Minutes, February 13, 1990). Commissioners asked several questions. Key was a comparison of the proposed Alamo use to the presently approved Dollar use. Dollar Rent A Car obtained two permits to use the area now being applied for by Alamo. In February, 1979 Dollar received a special permit to use the eastern half (about one acre) of the site for employee parking and auto storage with no limitation on the number of � � � 'i � -3- vehicles to be stored or number of employees to park (action letter to Mr. Rondon, February 21, 1979). This action included installing irrigation, landscaping and relocating a street light. In addition they were not to block access to the easement to the PG&E substation. Auto transports were to be loaded and unloaded on site and any additional improvements (to the other half of the site) were to require a new application, review and approval by the city. The request for use of the other half of 840 Cowan Road did not come until March, 1989 (action letter to Mr. Saunders, March 23, 1989). In 1989 the city allowed the expansion of the auto storage use to the westerly half of the site. The specific use was for storage of new cars intended for the rental fleet and used cars from the fleet to be shipped away. The applicant was allowed to fence the site. Employees were to park on site in designated spaces and all vehicles owned by Dollar were to be parked inside the fence. The City Engineer required unobstructed and always available access to the pump station, replacement of damaged curb and gutter, regrading of the site to drain to the street and all improvement plans to be approved by the Public Works Department. Auto storage on the westerly portion of the site was limited to 175 cars. The use of the westerly area was limited to Dollar Rent A Car. Finally a one year review was required. Alamo�s proposal differs from Dollar�s in that they intend to use the entire 2.5 acre site (easterly and westerly halves) for storage of 300 vehicles. Alamo expects to store new, used and some damaged cars on the site. Damaged cars will not be on the site very long. The storage will be supplemental to the use several blocks distant on Bayshore Highway. The storage on the Alamo Bayshore/Burlway Road site will be reduced from 225 to 50 and the fleet size will be increased from 1,000 to 1,300 vehicles. Dollar did not do auto detailing on the 840 Cowan site, nor will Alamo. Alamo has a permitted detailing facility at their Bayshore/Burlway Road operation. Dollar was required to provide space for their employees to park at 840 Cowan Road because they provided no space at their Bayshore facility. Alamo presently is required to provide parking on site for 35 employees at 1470 Bayshore Highway and for an additional 35 employee spaces when this business expanded to require them. No employee parking is proposed for the off-site storage area except for the 15 employees who might be working there during a given shift. Alamo expects to park one tow truck and have, on average, seven car carriers visit the site per week. The present use of 840 Cowan Road is as an adjunct to the Dollar Rent A Car operation located at 1815 Bayshore Highway. The Dollar Bayshore site has vehicular access to Cowan Road, so vehicles moving back and forth to storage do not have to go on Bayshore Highway. Dollar intends to close this car rental facility and relocate it to another city. They will stop renting cars on the Bayshore Highway site before Alamo commences to use 840 Cowan Road. Dollar will continue a general office use on the Bayshore site until they relocate entirely out of Burlingame. , ., � ,� ' ; , PlanninQ Commission Action �_ The Planning Commission should hold a public hearing. Affirmative action should be by resolution with findings. The reason for any action should be clearly stated for the record. At the public hearing the following conditions should be considered: 1. that the site shall be developed and improved as shown on the plans submitted to the Planning Department and date stamped February 5, 1990 except that 15 easily accessible parking spaces shall be designated on site for employee use and one site shall be relaid out to facilitate loading and unloading of car carrier/vehicle transport trucks on site; 2, that the conditions of the City Engineer's memo of January 3, 1989, revised January 16, 1989, shall be implemented; � 3. that the 2.5 acre site shall be regraded to drain toward the street and paved; 4. that the site shall only be used for off-site auto storage by Alamo Rent-A-Car to be used in conjunction with their facility at 1470 Bayshore Highway and no part of the site shall be sublet to another business for any use; 5. that no cars shall be rented, washed or repaired on this site nor shall customers be dropped off or picked up from this site; 6. that the storage area shall operate between 6:00 A.M. and 10:00 P.M. daily except that no cars shall be transferred to or from the storage area to the rental facility at 1470 Bayshore Highway between the A.M. peak (7:00 A.M. to 9:00 A.M.) and P.M. peak (4:30 P.M. to 5:30 P.M.) traffic hours; 7, that any change to the manner, hours or any other aspect of this operation or termination of the Alamo use at either 840 Cowan Road or 1470 Bayshore Highway shall result in review of both use permits; and 8, that this use shall be reviewed for compliance with the conditions in six months (August, 1990), every two years thereafter or upon complaint.
