SUBJECT: SPECIAL USE PERMIT FOR A COURIER SERVICE AT 845 COWAN
ROAD, ZONED M-1, FOR TNT SKYPAK, INC.
TNT Skypak is requesting a special use permit to operate a courier
service in an 11,616 SF portion of a 13,552 SF office/warehouse
building at 845 Cowan Road. The service operates 24 hours a day Monday
through Saturday, 9:00 A.M, to 6:00 P.M Sunday. Staffing varies
depending upon the day of the week and the time of the day. The
largest number of employees on site at one time appears to be Monday
and Friday when there will be 28 employees which will increase to 31 on
site from about 8:00 A.M. to 5:00 P.M. The business now operates 11
vans but expects to operate 13 from this site in the future. Eleven
vans will leave and make deliveries throughout the service area, two
will go back and forth to the airport throughout the day. There are 34
parking spaces on site but 10 of these are designated by its use permit
for the deli also located in this building. TNT is proposing as a part
of this application to provide 14 fenced parking spaces on an adjacent
property at the rear of the building next door located at 837 Cowan
Road. This property is in the same ownership as 845 Cowan Road.
Currently this area is being leased by a car rental agency for fleet
storage. However, this fleet storage area was not a requirement of the
car rental agency's (Pacific Car Rental) use permit issued September 9,
1966.
City Staff Review
City staff have reviewed the application. The Chief Building Inspector
(September 3, 1985 memo) had no comments. The Fire Marshal (September
4, 1985 memo ) noted that no vehicles should be allowed to park inside
the warehouse and that shrubs around the sprinkler connection should be
removed and the connection and riser pipe should be painted red, extend
sprinkler heads through the drop ceiling in all portions of the
building the heads do not currently penetrate, provide central station
monitoring of sprinkler system and system to have five year certifica-
tion test completed.
Planning staff would note that although the property at the rear where
the additional 14 parking spaces are proposed is in the same ownership,
the lots have not been merged. Therefore this parking is off premise.
This lot could be independently developed and thus leave TNT Skypak

without these needed spaces. The applicant and landlord have agreed to
develop a legal agreement tying the leases for the two properties
together. The area proposed to be leased is about 60' deep (front to
back). The parking stalls in this area will not be to code standards.
This may be a problem for van drivers when they park their own cars in
the area.
With the 14 spaces there would be 38 spaces available for TNT Skypak
use. It appears in the worst case that they could have 31 employees
and 13 vans on site at one time. This would be six spaces short if the
van drivers did not park where the vans were parked. If van drivers
did park in the van storage area, there would be seven spaces for
visitors, future growth, etc. The area used by the vans would be
fenced for overnight security.
Applicant's Letter
The applicant submitted two letters initially, August 23, 1985. In
these letters she addresses the number of employees by shift, the
expected growth potential (two additional vans, three additional
employees) and the patterns of trips durinq the day (7:30 A.M. and 4:30
to 7:30 P.M.). According to the letter midday deliveries are made to
regional collection points by a van or two from Burlingame. They
conclude future growth will be in satellite offices around the Bay Area
with consolidated shipments being taken from Burlingame to these
locations. In the future the Burlingame location will become an
administrative and consolidation center.
Commission Study Questions
At study review the Commission asked a number of questions about this
proposal (Planning Commission minutes, September 23, 1985). There are
a few isolated instances of off-premise parking in the M-1 zone. The
only one currently operating is IJational Rent A Car in the Rollins Road
area which uses two sites on the same street which are separated by one
lot. The Commission approved an off-premise use at Alamo Rent A Car so
that they could use a portion of an immediately adjacent Amfac parking
lot in exchange for leasing a portion of a warehouse originally
intended for auto storage to Amfac. In the end this use permit was not
pursued by the property owners.
TNT Skypak indicates that there are currently 11 vans in the fleet.
They anticipate this will increase by two, then stabilize.
In a letter of October l, 1985 from the applicant they state that the
lunch room provided is the "plug in" variety. It will include various
vending machines and a microwave.
Planninq Commission Action
The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution. The Commission should state
clearly the reasons for any action taken. At the public hearing the
following conditions should be considered:
1. that the conditions of the Fir� Marshal's September 4, 1985 memo
and the City Engineer's October 9, 1985 memo shall be met;

2. that the air courier service at this location shall be limited to
11,616 SF of building area, a maximum of 31 employees per shift, a
maximum of 13 vans and operating 24 hours a day Monday through
Saturday, 9:00 A.M, to 6:00 P.M. Sunday and as described in the TNT
Skypak, Inc. representative's letters of August 23, 1985 with
attachment and October 1, 1985;
3. that the air courier service operating at this location shall have
use of 24 on-site parking spaces and 14 parking spaces in a fenced
area on an adjacent property behind 837 Cowan Road; the lease for
this adjacent parking area shall be coterminus with the lease of
the building area at 845 Cowan Road and should the lease on this
additional parking be terminated so shall this use permit;
4. that any changes in operation which cause an increase in any of the
items addressed in this use permit shall require an amendment to
this use permit; and
5. that this use permit shall be reviewed for compliance with all its
conditions in one year (October 1985).

Attached is an application for license to do business in the
city of Burlingame as an Air Courier Service. We currently
hold a license to operate from 850 Mahler Road, Burlingame.
However, we understand that a new license is required before
we can move to our new premises. Our new address will be:
837 Cowan Road
Burlingame, CA 94010
These new premises are more suitable for our present and future
business needs.
Our facilities are open 24 hours Monday through Saturday with
a majority of our staff (office) leaving by 6:00 P.M. Sunday
our hours are 9:00 A.M to 6:00 P.M.
See attached staff activity record for breakdown.
We operate 11 pick-up and delivery vans, two in the South Bay,
two in the City of San Francisco, one in the East Bay and one
in the North/East Bay. These vehicles leave the premises at
approximately 9:00 A.M. (Monday through Friday) and return
at approximately 7:30 P.M.
Additionally we operate two airport run vans; these vans
shuttle to and from the airport throughout the day.
As far as expansion is concerned we are looking at perhaps an
additional two drivers, two sales personnel and additional ad-
ministrative staff to support the expansion of business.

We wish to make a statement regarding the anticipated
usage of premises at 839 Cowan Road, Burlingame, CA 94010
and to elaborate on our plans for development.
The business our company operates is the movement of
time-sensitive documents and small packages to primarily, in-
ternational destinations. The requirements of our clientele
call for their collections to be made as late as possible in
the business day and deliveries to be made as early as
possible.
In order to accomodate these needs our drivers have left
our premises at 0730 to complete their deliveries and do not
return to our premises before 1830. In many instances this
return is delayed until 1900 to 1930. Our drivers therefore
have little impact on the Cowan Road traffic situation.
Any material coming in during the day for delivery is trunked
to the various drivers by a single vehicle.
With regard to our development over the foreseeable future,
we anticipate a steady growth in our levels of business.
Our growth will be largely decentralized in a satellite form.
We envisage various locations in the Bay Area being developed
as operation centres and consolidated shipments being driven
back to Burlingame by one or two vehicles.
In this manner, our growth will allow flexibility without
the i trinsic oblems of massive centralization. Our
prem'ses on Cdw Road will hence be used as an administrative
and onsolida'ti n centre.

My understanding is that this proposal includes an expected employee level of
from 21 to 30, between 7:00 AM and 6:00 PM. This site has only 24 spaces
available as the existing deli has 10 spaces of the 34 assigned to it.
About 39 spaces is code requirement for the 11,600 SF of lease area.
Also, it appears that this use may be an increase in traffic generated by
this courier use. An office space this size may average -�about 135 trips
per week day. The trips generated by this use are not clearly defined.
If the employees average 3 to 4 trips per day there would be 60 to 90 trips
plus their customers and vans. Eleven vans could generate 2 to 3 trips per
day (22 to 33). The two (2) airport runs could average 32 or more trips
per day. This totals about 115 to 155 trips per day, similar to an average
office use. However, I suspect that since tliis is a courier service that
the van trips may be significantly higher. I suggest that the applicant
submit a trip count by hour based on present and future business projections.
The reason.I am pointing this out is the cumulative effect that increased
traffic demands places on the Bayfront area by increased uses. Of particular
concern is the increased office useage which has a distinct impact on the
peak hour demands. The bayfront roadway network capacity was predicated
on continued use of this area as originally developed.
If approved,.I suggest that the Commission place the following conditions:

We wish to make a statement regarding our parking require-
ments to continue doinc� business in the city of Burlingame
as an Air Courier Company.
Our 5 year lease with a 5 year option is structured to
include 14 ad�acent �ark.ing space5 for our needs.
There are 24 "Ori-site°t parking spaces and l4 "Off-site"
parking. Two of the total of 38 spaces ineludes two spaces
for compact cars and t�ao space� for visitor parking.
Due to the nature o� our business we get very little
visitor tra�fic.
The 14 off--site �arkinc� spaces will be shared with Pacific
Car Rental fahich. the landlord i5 providing a partition to
accomodate our needs.
We operate 11 �ick up and delivery vans. Two in the South
Bay, two in the city of San Francisco, two in the East Bay
a.nd two in the North/East Bay.
Additionally we operate two airport run vans. These shuttle
to and frorn the ai:rport throughout the day.
We are a 24 hour o�era�tion NYonday through Saturday and
9--6 on Sunday. During our peak business hours the total
ca:r5 on si.te is appraximately 20 cars.

Discussion: Planning staff's suggestion that the carport be reduced to
13' x 20' which would allow room to park one car but would decrease the
encroach�nent into the front setback by 6', resulting in a variance
request or 3' only; proposed use for the new structure adjacent to the
carport; ossibility of enlarging existing garage. ,��
Tony Garist , applicant, advised he has a three bedroo"�home, the new
construction will be a living room/dining room area, e could extend
this roof lin which would improve the appearance q� the carport. He
had no objecti n to staff's suggestion to reduce i�he carport to 13' x
20' and felt wi ening the existing garage to me�� the code requirement
for two cars wou d be very expensive and that �ackup area would be
limited. ,r� .
Chm. Garcia opened t e public hearing. B�atrice Marino, 750 Walnut
Avenue advised this l t was created abou�t� 1955. There were no further
audience comments and =ahe public heari� was closed.
C. Giomi found there wer�exception '� circumstances in this unusual
flag lot; that the varianc is nec ssary for the preservation and
enjoyment of a property rig��t of he owner, this is one of the few ways
he could improve his property; at it would not be detrimental to
other property owners, no com aints have been received from the
neighbors, extending the roo l��;ne would be a benefit to the house and
adjacent properties; and th t it�would not.adversely affect the zoning
plan of the city, the lot ill rert�ain R-1 and the variance will upgrade
parking in the R-1 zone. C. Giomi`�,�noved to grant this variance with
F the following condition :(1) that ��k�e carport be designed to be 13' x
20' allowing 10' clea of the firepla�e in which to park a car; and
(2) that the maximum eight of the com�.leted carport structure not
exceed 12' from gr e and be designed t�;�meet all the requirements of

motion approved a 5-1 roll call vote, C�s� Jacobs dissenting, C. Leahy
absent. Appeal procedures were advised. �

allowable dish size to be very restrictive; with such a restrictive
ordinance are 't the constitutional rights of the property owne� being
violated? It was noted this installation went in without com�'liance
with local law s requirement for a special permit; Mr. Kreig.er stated
they had used a subcontractor who neglected to apply for �a�permit.
Commissioner co ent. the city has recently spent consi��rable money to
underground utilities along California Drive, this ant�'`nna is a visual
obstruction in th same area where cable is availabl g� Applicant noted
that a satellite �sh offers many more signals and s`�ations than cable
TV; he felt homeow ers will want to take advantage,�of this capability
and will then face �he problem of complying with�he city's ordinance.
A Commissioner point d out the applicant's prob�.em is not the size of
the dish but its loc tion which is visible to nyone driving down
California Drive.
Chm. Garcia opened the ublic hearing. T re were no audience
comments. Mr. Kreiger elt one issue wh'ch might be addressed is
whether or not complaint have been re� ived; the homeowner has
received none. Mr. Nicho s advised t-at if the dish were relocated to
the northeast corner near he fence elow the fence line, the fence
would block reception; if it clear the fence the house would be in
the way; if it were mounted on a ole in the middle of the backyard
with trees spaced around it he rees would block it; the dish must be
turned toward California Driv to pick up the eastern satellites.
Further Commission comment:�con ern that approval of this one dish
would set a precedent for future applications; it would seem the code
is too restrictive to put,�a satel ite dish on this site; there are many
zoning restrictions which limit pr perty owners, they are established
for the common good and�limit ever ne; this property owner has a
unique problem because of the size o his lot. There being no further
comment, Chm. Garcia�closed the publi hearing.

C. Jacobs moved to'deny this special pe mit. Second C. Giomi. Comment
on the motion: th'ere were no complaints rom immediate neighbors, this
is a code enforcement problem, city staf did receive complaints about
the installation of this antenna; would no want to deny anyone his
constitutiona� rights but think in this cas the overall good outweighs
the constitutional rights o£ the property ow er. Motion approved on a
6-0 roll c�11 vote, C. Leahy absent. Appeal rocedures were advised.

We wi11, have at our disposal a total. of 38 parking spaces.
24 on site spaces and 14 off site which the 14 off site
spaces has been incorporated in the lease.
We have currently reached our maximum employee growth for
our Burlingame qperati,on.� Internal growth will be more
so�histicated technology and methodplogy (i.e. computer systems)
�ahich will in.crease productivity of existing instead of
a,dding employees. Also future expansion is pro�ected out
into othe� �aX Area c�ties.
Our l,unch rQom �'acili�kie� wi�,l be for employees only. This
wa,11 be a"plug in" facility (i.e. cof�ee machine, microwave
etc. ) . �

�ollows: 9 van� leave the premises at approximately 9:00 am
and return apprQximately 7:00 pm. These van� are delivering
