SUBJECT: SPEGTAL PER�1IT TO ALLOW Fl CAR RENTAL AGENCY.IN THE M-1 DISTRICT
AT 826 COWAN ROAD (BUILDING B)
Stanley Plog, the applicant, is requesting a special use permit for a car rental
operation in a 5,000 SF building in the �1-1 District at 826 Cowan Road, Building B.
He is proposing to operate a 25 to 30 car fleet from the building at the rear of .
the site. He would employ seven to eight people on weekdays and two to five people
on weekends. Customers would be shuttled to and from the site in company cars.
Thirty-three parking spaces are provided on the site, about 20 of them clearly to
be used for car storage purqoses. The front of the building on the site is currently
vacant.
City staff have reviewed this request. The City Engineer (December 23, 1983 memo)
notes that off-loading of vehicles shall be done on site and that if servicing or .
washing is to be done on site the applicarit must receive approval of the Building
and Engineering Departments before commencing such operations. The Chief Building
Inspector (December 30, 1983 memo) notes repairs necessary to bring the building up
to the B�1 occupancy requirements,of the UBC. B-1 occupancy is necessary because
vehicles will� be stored inside the building. Ed Williams, Fire Inspector, (December 9,
1983 memo and January 4, 1984 memo) notes the building complies with the Q-1 occupancy
for the Uniform Fire Code.
Dr. Plog submitted a letter (December:l3, 1983) addressing the request. He refers
to the application noting that his car.rental operation features select imported
cars which are we11 maintained. In addition they provide a lot of personal service
to their customers. They have experience operating at Los Angeles International
Airport. further he states that they�will be doing minor servicing (lubrications,
oil changes and changing parts on site). They intend.to improve the appearance of
the building (paint) and clean up and improve the landseaping around Building B.
A letter (December 9, 1983) was also received from Eric Coivan (property owner)
indicating his awareness and agreement to the car rental use.
Staff has some concerns regarding car rental use at this site as proposed. Based on
the applicant's Rent-A-Car Questionnaire there wi:ll be an average of 15 rental cars
on site,during weekdays and 25 on weekends. In addition there will be an average of
five employees on site weekdays and ± four employees on site weekends. Thus, on
average, there will be on-site parking demand of 20 on weekdays and 29 on weekends.
There are 33 spaces on site shown on the plans; however, some of these spaces will
be very difficult to use on a regular basis (e.g., spaces 16 through 21). It is not
clear if the applicant intends to provide on-site parking for his employees. Since
employee parking has been a critical problem in other car rental agencies and the
Cowan Road area generally is impacted in parking, staff preference would be for
required on-site employee parking. This employee parking should be provided in
spaces which would"not subject employee vehicles to a higher than.average chance
of damage and easy enough access ttiat the spaces v��ould be used regularly.

Staff is also concerned about the security of cars stored in spaces 18 through 28.
At no ti me can the remai n i ng 10 feet of �tfie exi sti ng: concrete. dri veway �be rel i ed
on for regular access'to these or.other. spaces, since the driveway-is located on an
adjoining property�which could be developed in the future. This future:development
could affect the access to parking�at the rear of 826 Cowan. Si,nce�this applicant
shows necessary storage parking in the 10 foot portion of�the.driveway on the
826 Cowan site, the future access to these spaces needs�to�be.addressed. The
applicant. is intending to_use thi�s site in the�short term until he finds a permanent
home in Burlingame or some other city adjacent to the airport:. The conditions below
address these concerns.
The'Burlingame Rent-A-Car Agenc.ies.map_shows the.existing.car rental agencies in.the
city and the proposed site at 826 Cowan Road, #16. Of the 16 agencies., 12 are east
of Highway 101 and three are on or.very near Cowan Road.
The Planning Commission should:hold a public hearing. At the hearing the following
conditions should be co'nsidered:
1. that the coaditions of;the City Engineer.'s.memo:(December: 23, 1983) and
the Chief Building Inspector's memo (December 30, 1983) be met;
2. that the business be operated as defined in the Rent-A=Car Questionnaire
and limited to the hours.of 6:30.A.M. to 11:30 P..M. seven days a week
with no more than eight employees on'site weekdays and�five employees
on weekends;
3.� that the minimum of five easi.ly accessible on-site parking spaces be
permanently designated and�reserved for employee parking;
�4. that:should development occur on the site adjacent.to the existing
20 foot concrete driveway the four. storage parking spaces will be
elimina:ted and.the fleet reduced by four cars;
5. that-this use permit will be reviewed for compliance with the conditions-
in nine months time (October 1984); and
6. that"this permit shall expire in February, 1986.

not be available for nighttime users, will not overflow into neighboring parking
because we are meeting the parking requirements (will have four employees and provide
four spaces). Mr. Bryant commented: this intensification of use would bring savers
who would also shop on Broadway; financiaT institutions only stop pedestrian traffic
when there are two or more in a row. There were no further audience comments and
the public hearing was closed.
Commission discussion: city policy in such cases to record a resolution of Planning
Commission action and the requirement that parking be maintained as a part of the
property; the 12' access alley; concern about preserving the city's retail commercial:
diversity; uncomfortable with a trade-off on parking, would not like to see this
become a practice in the city; desire to see a1T sites remain rented, many small
businesses have to move when the lease expires because of economics, a savings and
loan would be able to pay the rent and improve the property, support the application.
Applicant was asked about the proposed administrative of.fices ta be located elsewbere
in Burlingame. Michael Heron discussed the various administrative departments which
would be located in these offices, employing approximately 15 people to start and an
expectation of employing 60 new people in two to three years. He commented on
approvals received from regulatory agencies and Portola's need for one branch office
within a relatively short distance of' the administrative offices. He also pointed
out there were a number of retail es.tablishments between;the financial institutions
on Broadway and the proposed site. He discussed Portola's market study and in-depth
search for space for the branch office in Burlingame.
Further Commission discussion: more concerned about impacting parking in the area
than about the use; concern about providing off-site parking; Broadway deserves as
much retail merchandising space as possible; customers of the savings and loan would
be short term users of available parking; do not think this is the most ideal location
for a savings and loan, there might be other areas more suited to its needs, would
have negative impact on the surrounding businesses. �
C. Giomi moved to deny the special permit.. Second C. Schwalm; motion approved on a
4-2 roll call vote, Cers Cistulli and Garcia dissenting, C. Leahy absent. C. Giomi
then moved to deny the parking variance. Second.C. Schwalm;.motion obtained a 3-3
roll call vote, Cers Cistulli, Garcia, Schwalm dissenting, C. Leahy.absent. Variance
effectively denied for failure to obtain a majority vote. Appeai procedures were
advised.

SUBJECT: 826 COWAN ROAD, PROPOSED CAR RENTAL OPERATION
Dr. Stanley Plog called today and discussed.Planning Gommission concerns with
accessibility of parking stalls at the rear of his proposed rental facility. He
explained.that those stalls will not be used on a regular basis. He wanted to
show the same parking layout which had previously been reviewed by the Commission
for a body shop at this location. He said his.on-site fleet is usually very small
except on holidays when�they have excess cars on site and so only the front stalls
will be used regularly.
He further explained that:the parking:inside the building is primarily for overnight
storage of his more expensive cars. During the day the garage will be generally
vacant.
He was aware also of Commission concerns with the amount of traffic that will be
created. He said that his heaviest business.occurs between 6:30 - 9:30 P.M. when
air flights from the East Coast arrive at the airport. He will bring documentation
of this to the hearing.
