(6S0) 69Cr7200 Following a public hearing Council reversed the Planning Commission's denial of this request and approved your application with the following conditions: 1. that the project shall be built as shown on the revised plans submitted to the Planning Department date stamped May 14, 1998, (site plan, east elevation, west elevation, floor plan, south and north elevation) except that there shall be only one skylight, 2' X 4' , on the rear elevation and only one skylight, 2' X 4' on the side elevation, all sky lights shall be tinted to reduce night light glow; 2. that the conditions of the Chief Building Official and Senior Engineer's May 4, 1998 memos shall be met; 3. that use of the structure shall be limited to off-street parking for vehicles, and that the accessory structure shall never be used, rented, or converted into a second dwelling unit; and that there shall be no sewer or water services connected to the accessory structure; and 4. that the 13" oak tree that must be removed shall be replaced, before the building permit is finaled, with a substantial tree (i.e., 24" box), which will screen the neighbor adjacent to the side property line nearest the new garage; and June 11, 1998 721 Walnut Avenue page -2- 5. that the project shall meet all the requirements of the California Building and Fire Codes, 1995 edition, as amended by the City of Burlingame. All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
