One Year Extension of Design Review, Hillside Area
Construction Permit and Special Permits
Address: 12 Vista Lane
Item No. 7a
Consent Calendar
Meeting Date: May 23, 2016
Request: Application for One -Year Extension of a previously approved application for Design Review, Hillside
Area Construction Permit and Special Permits for declining height envelope and attached garage
for a new, two-story single family dwelling with an attached two -car garage.
Applicant and Designer: Dreiling Terrones Architecture, Inc.
Property Owner: Jiangnang Zhang
General Plan: Low Density Residential
APN: 027-093-320
Lot Area: 10,537 SF
Zoning: R-1
Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15303 (a), which states that construction of a limited number of
new, small facilities or structures including one single family residence or a second dwelling unit in a residential
zone is exempt from environmental review. In urbanized areas, up to three single-family residences maybe
constructed or converted under this exemption.
Summary of Request: The applicant is applying for a One Year Extension of a previously approved application
for Design Review, Hillside Area Construction Permit and Special Permits for declining height envelope and
attached garage. The project included construction of a new, two-story single family dwelling and attached two -
car garage. The project was originally approved by the Planning Commission on May 11, 2015 (see attached
May 11, 2015 Planning Commission Minutes). The applicant has provided reduced sets of the approved plans,
date stamped May 5, 2016. There are no changes proposed to the originally approved project.
The Planning Commission approval of this application became effective on May 21, 2015. This approval is valid
for a period of one year during which time a building permit must be issued. An additional One Year Extension
may be considered by the Planning Commission. If the extension is not granted, the property owner must
reapply with a new application. The applicant's extension request letter, dated April 25, 2016, notes that the
property owner placed preparation of the construction plans on hold for economic reasons, but is now ready to
build the project. An application for a building permit was submitted on May 5, 2016; however a building permit
will not be issued by May 215t. Therefore, an application for a One Year Extension is now required.
Project Description of Previously Approved Project: The subject property at 12 Vista Lane is currently
vacant and measures 10,537 SF in area. The lot is located within the City of Burlingame boundaries but is
surrounded by properties located in San Mateo County (unincorporated land). Due to the downward slope on
the subject property, the house will appear to be single -story as viewed from Vista Lane. However, at the rear of
the lot the house will be two stories in height.
The project includes construction of a new, two-story single family dwelling and attached two -car garage. The
house and attached garage has a total floor area of 4,306 SF (0.41 FAR) where 4,472 SF (0.42 FAR) is the
maximum allowed.
The project includes an attached two -car garage which provides two covered parking spaces for the five -
bedroom house; one uncovered parking space (9' x 20') is provided in the driveway. The office room on the
lower floor qualifies as a bedroom since it is enclosed, measures 70 SF and contains a window. Three parking
spaces, one of which must be covered, are required for a five -bedroom house. All other Zoning Code
requirements have been met.

This project was approved by the Planning Commission on May 21, 2015. The Construction Document period was
put on hold by the owner, for economic reasons. The project documents were re -started in February
2016. We have submitted Construction Documents for a building permit, but we anticipate the plan check and
approvals process to extend beyond the one year from the original planning approval (5/21/2015).
We therefore are requesting a one-year extension for the Planning approval.

(33 noticed) Staff Contact: Ruben Hurin (This item was continued from the April 27,
2015 Planning Commission meeting.)
Commissioner Terrones recused from this item because he has a business relationship with the
applicant. Commissioner Gaul recused because he lives within 500 feet of the subject property.
Commissioner Sargent recused for non -statutory reasons.
All Commissioners had visited the project site. Chair DeMartini met with the applicant and the property
owner.
Senior Planner Hurin presented the staff report.
There were no questions of staff.
Chair DeMartini opened the public hearing.
Jacob Furlong represented the applicant.
> Change to project also included moving the stairwell inward to minimize the encroachment into the
declining height envelope along the left side property line.
> Reduced the depth of the garage to move the house further away from the tree.
Commission questions/comments:
> House was moved V-4", what was this based on? (Furlong: It was based on reducing the length of
the garage as much as possible and still meeting the parking requirement.)
> Were the story poles adjusted to reflect the revised project? (Furlong: Yes, story poles were
adjusted and certified.)
> Did you get a chance to share the plans with the neighbors? (Furlong: Yes, have met with the
adjacent neighbors.)
Public comments:
> None.
Chair DeMartini closed the public hearing.
Commission discussion:
> Very pleased with the changes made since the last meeting, including reducing the roof height
reconfiguring the stairway and pulling the house back from the oak tree. In favor of project.
> Made some improvements to reduce impacts on the tree.

> Question approval of the lot split, obvious then that you couldn't fit the house that was designed on
that lot without doing something to the tree. By accepting the lot split, they knew that part of the tree
would be removed. Based on the changes made to the project, removing a portion of the tree is
acceptable.
Chair DeMartini made a motion, seconded by Commissioner Loftis, to approve with the
conditions listed in the staff report. Chair DeMartini asked for a voice vote, and the motion
carried by the following vote:

C'everrt{on Program tlHe W1[er, His"hy C—mnhy. Requirements for Architectural Copper
Protect water quality during installation, cleaning, treating, and washing!
Copper from Buildings May Harm Aquatic Life
Copper can harm aquatic life in San Francisco Bay. Water that comes
into contact with architectural copper may contribute to impacts,
especially during installation, cleaning, treating, or washing. Patination
solutions that are used to obtain the desired shade of green or brown
typically contain acids. After treatment, when the copper is rinsed to
remove these acids, the rinse water is a source of pollutants.
Municipalities prohibit discharges to the storm drain of water used in the
installation, cleaning, treating and washing of architectural copper.
Building with copper
gutter and drainpipe.
Use Best Management Practices (BMPs)
The following Best Management Practices (BMPs) must be implemented to prevent prohibited
discharges to storm drains.
During Installation
• If possible, purchase copper materials that have been pre-patinated at the factory.
• If patination is done on -site, implement one or more of the following BMPs:
o Discharge the rinse water to landscaping. Ensure that the
rinse water does not flow to the street or storm drain.
Block off storm drain inlet if needed.
o Collect rinse water in a tank and pump to the sanitary
sewer. Contact your local sanitary sewer agency before
discharging to the sanitary sewer.
o Collect the rinse water in a tank and haul off -site for
proper disposal.
• Consider coating the copper materials with an impervious
coating that prevents further. corrosion and runoff. This will
also maintain -the desired color for a longer time, requiring
less maintenance.
prohibited discharge. The water must be
pumped and disposed of properly.
During Maintenance
Implement the following BMPs during routine maintenance activities, such as power washing the roof,
re-patination or re -application of impervious coating:
• Block storm drain inlets as needed to prevent runoff from entering storm drains
Discharge the wash water to landscaping or to the sanitary sewer (with permission from the local
sanitary sewer agency). If this is not an option, haul the wash water off -site for proper disposal.
Protect the Bay/Ocean and yourself!
If you are responsible for a discharge to the storm drain of non-
stormwater generated by installing, cleaning, treating or washing
copper architectural features, you are in violation of the municipal
stormwater ordinance and may be subject to a fine.
