Dear Property Owner,
The Planning Division has reviewed your request for a new detached accessory dwelling unit
and determined that the proposed project complies with the requirements set forth in
Burlingame Municipal Code Chapter 25.48.030 (Accessory Dwelling Units). The legal status of
your new detached accessory living unit at 129 Costa Rica Avenue, zoned R-1, is subject to the
following conditions of approval:
that the project shall be built as shown on the plans submitted to the Planning Division
and date stamped June 1, 2022 and that the accessory dwelling unit shall be restricted
to no more than 850 SF or 1,000 SF (for two-bedrooms or more units;
2. that prior to issuance of a building permit for the new accessory dweliing unit, a deed
restriction shall be filed with the County Recorder. The deed restriction shall state that
the accessory dwelling unit shall not be sold separately from any part of the property on
which it is located; and that it is restricted to the standards specified in the Accessory
Dwelling Unit municipal code provision 25.48.030;
3. that demolition or removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shall
be required to comply with all the regulations of the Bay Area Air Quality Management
District;
4. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects
to submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
5. that the project shall meet all the requirements of the California Building and Uniform
Fire Codes, in effect at time of building permit submittal, as amended by the City of
Burlingame; and

6. that the accessory dwelling unit permits may be revoked on any one or more of the
following grounds:
a. The accessory dwelling unit requirements are not being met; or
b. The accessory dwelling unit is no longer used for residential purposes; or
c. The parking required is no longer provided; or
d. The primary single-unit dwelling on the site is purposely demolished.
All site improvements and construction work will require a separate appiication to the Building
Division. This approval is valid for two years during which time a building permit must be
issued (building permit must be issued by July 7, 2024). One extension of up to one year may be
considered by the Community Development Director if a written application and filing fee is submitted
to the Planning Division at least 30 days prior to the expiration date of the initial Planning approval.
The decision of the Community Development Director is a final administrative decision pursuant to
Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of
competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter
time is required pursuant to state or federal law.
