At the September 25, 2006 Planning Commission meeting, the Commission reviewed your request for a minor
revision to an approved design review project at 1504 Alturas Drive, zoned R-1. The minor revision included
changing the roofing material from composition shingle roofing to Class A wood shingles, as shown on the
revised plans date stamped September 12, 2006.
The Planning Commission acknowledged receiving the request and noted that the revision was consistent with
the design previously approved.
The approved revisions shall meet all the requirements of the California Building Code and California Fire Code,
2001 edition, as amended by the City of Burlingame.

Summary: On May 10, 2004, the Planning Commission approved an application for conditional use permit
for re-emerging lots, design review, hillside area construction permit and special permit for an attached garage
for a new, two-story single family dwelling and attached garage at 1504 Alturas Avenue, zoned R-1(May 10,
2004 P.C. Minutes). A building permit was issued for the project on September 8, 2004, and construction is
underway.
On March 13, 2006, the Planning Commission approved an application for an amendment to the originally
approved project (March 13, 2006 P.C. Minutes). The changes included converting crawl space to floor area
and changes to the roof configuration and exterior elevations.
Requested change: Originally, the house was approved with composition shingle roofing. The applicant is
now requesting approval of Class A wood shingles for the roofing material. In a letter date September 11,
2006, the architect notes that he feels that wood shingle roofing will enhance the original design of the house.
The overall design of the house remains the same. Planning staff would note that because of the type of
revisions, it was determined that the change to roofing material, from composition shingle to wood shingle,
could be reviewed by the Commission as an FYI item. If the Commission feels there is a need for more study,
this item should be placed on an action calendar for a review and/or public hearing with direction to the
applicant.

Reference staff report March 13, 2006, with attachments. CP Monroe presented the report, reviewed criteria
and staff comments. Twenty five conditions were suggested for consideration.
Chair Auran opened the public hearing. George Sun, architect, represented the project and was available to
answer questions. There were no further comments and the public hearing was closed.
C. Deal stated that he had no objections to the changes proposed and moved to approve the application, by
resolution, with the following conditions: 1) that the project shall be built as shown on the plans submitted
to the Planning Department date stamped February 13, 2006, sheets A2.0, A2.1, A3.0 and A4.0 and date
stamped April 14, 2004, sheets A1.0, A1.1, A5.0, topographic map, C-2 and L1.0; 2) that any changes to
the size or envelope of the basement, first or second floors, which would include adding or enlarging a
dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall
be subject to design review; 3) that the conditions of the Chief Building Official's February 17, 2006,
memo, the Fire Marshal's February 21, 2006 and November 17, 2004, memos, the Recycling SpecialisYs
February 22, 2006 and November 17, 2004, memos, and the City Engineer's November 17, 2004 memos
shall be met; 4) that the 24" Weeping Willow tree located in the front of Lot #1 is approved for removal by
the City Arborist as per Code Section 11.06.060(c); 5) that the 43" Coastal Live Oak located on Lot #2,
immediately adjacent to Lot #1, shall not be removed and the property owner shall be responsible for
implementing and maintaining all tree protection measures , prior to any grading or demolition on the site.
The tree protection measures, as defined in the applicant's arborist report by the Green Jeannie (date stamped
January 6, 2004) which has been reviewed and approved by the City Arborist, shall be maintained on site

until after the final inspection and the City Arborist authorizes their removal; the contractor shall call for the
City Arborist to inspect the protection measures installed before a grading permit,shall be issued, and that the
property owner shall maintain the trees after construction as directed by the certified arborist's report; failure
to continually provide the tree protection and implementation of any of those requirements in the arborist's
report shall result in the property owner paying for an independent inspection of the site by an arborist
selected by the City; 6) that a certified arborist shall be on site during any demolition and grading or
digging activities that take place within the designated tree protection zones, and that a certified arborist
shall inspect the construction site once a week and certify in writing to the City Arborist and Planning
Department that all tree protection measures are in place and requirements of the conditions of approval are
being met; inappropriately stockpiled or stored material and equipment shall be moved immediately; and that
a certified arborist shall be given written authority by the developer and be obligated to stop all work on the
site should any activity violate any and all conditions of approval relating to the protection, conservation and
maintenance of trees on the site, and the City Arborist may also stop work for any violation of the
conditions related to the protection, conservation and maintenance of trees on the site; 7) that prior to
demolition or construction the 43" Coastal Live Oak located on right side of Lot #2, immediately adjacent to
Lot #1, shall be trimmed, raising the fringe only six feet over the existing roof line, this shall be done under
the direct supervision of a certified arborist at a time during the project determined by the City Arborist; 8)
that prior to demolition or construction 6" of mulch shall be placed 10' around the trunk of the 43" Coastal
Live Oak located on the right side of Lot #2, immediately adjacent to Lot #1, but shall not be placed directly
against the trunk; 9) that prior to demolition of the rear deck temporary barrier fencing shall be placed at
8' on the southwest side of the 43" Coastal Live Oak, and 28'on the northeast side of the trunk; 10) that
after the demolition of the rear deck, but prior to the construction of the new homes, protective barrier
fencing shall be placed as close to the drip line of the 43" Coast Live Oak as possible and shall remain in
place throughout the construction of both houses on Lot #1 and Lot #2; 11) that the protective barrier
fencing shall be a minimum of 4 feet high, and shall be made of pig wire, snow fence, or cyclone fence, with
steel stakes or pipes as posts; there shall be no storage of materials or equipment, unnecessary trenching,
grading or compaction within the protective barrier fencing; encroachment into these areas is forbidden; 12)
Tree Maintenance: The developer shall be responsible for maintenance during demolition and construction
work on the proj ect and for a 5-year maintenance program for the 43" Coastal Live Oak, including deep root
fertilizing, beginning upon final inspection. This maintenance program shall be founded upon the
recommendations of the January 6, 2004 �Green Jeannie report as well as such additional recommendations
as the developer shall receive from a certified arborist; 13) that for purposes of these conditions a certified
arborist means a person certified by the International Society of Arboriculture as an arborist; 14) that the
project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires
affected demolition, new construction and alteration projects to submit a Waste Reduction Plan and meet
recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a
demolition permit; 15) that demolition of the existing structures and any grading or earth moving on the
site shall be required to comply with all the regulations of the Bay Area Air Quality Management District;
16) that prior to scheduling the foundation inspection a licensed surveyor shall locate the property corners,
set the building envelope; 17) that prior to under floor frame inspection the surveyor shall certify the first
floor elevation of the new structure(s) and the various surveys shall be accepted by the City Engineer; 18)
that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof ridge
and provide certification of that height; 19) that prior to scheduling the framing inspection, the project
architect, engineer or other licensed professional shall provide architectural certification that the architectural
details such as window locations and bays are built as shown on the approved plans; if there is no licensed
professional involved in the project, the property owner or contractor shall provide the certification under
penalty of perjury; 20) that prior to final inspection, Planning Department staff will inspect and note
compliance of the architectural details (trim materials, window type, etc.) to verify that the project has been

built according to the approved Planning and Building plans; 21) that all air ducts, plumbing vents, and
flues shall be combined, where possible, to a single termination and installed on the portions of the roof not
visible from the street; and that these venting details shall be included and approved in the construction plans
before a Building permit is issued; 22) that the applicant shall comply with Ordinance 1503, the City of
Burlingame Storm Water Management and Discharge Control Ordinance; and that during demolition of the
existing residence, site preparation and construction of the new residence, the applicant shall use all
applicable "best management practices" as identified in Burlingame's Storm Water Ordinance, to prevent
erosion and off-site sedimentation of storm water runoff; 23) that the project shall meet all the requirements
of the California Building and Fire Codes, 2001 edition, as amended by the City of Burlingame; 24) that the
shutters shall be consistent with the size and shape of the windows; and 25) that all windows shall be true
divided light windows. The motion was seconded by C. Osterling.

Reference staff report May 10, 2004, with attachments. Plr. Barber presented the report, reviewed criteria
and staff comments. Twenty-three conditions were suggested for consideration for lot 1 and twenty-six
conditions were suggested for consideration for lot 2. Noted that conditions of approval for both lots refer to
April 14, 2004, plans but should read Apri128, 2004, plans.
Chair Osterling opened the public hearing. Derek Chung, property owner, 1504 Alturas Drive and Michael
Jung, architect, 4075 Papazuan Way, Fremont, were available to answer questions. Mr. Chung noted that he
tried to address the Planning Commission's concerns, which were mostly on lot #2 regarding the 15%
driveway verses the 12% driveway. They decided to keep the 12% driveway. With the original plans they
had a 15% driveway proposed , then during the design review process with Jerry Winges he suggested
reducing the slope and thought it would be a better solution. Provided a cross section in the revised plans
that shows both a 12% and 15% to show the difference between the two. Decided that the 12% slope was a
better alternative for the following reasons: 1) safety for a better approach; 2) appears cleaner from the street
without a big drop down; 3) practicality, don't want cars to scrape when entering and exiting the driveway.
Lot #2 has three retaining walls, the north wall steps down, is a terraced wall, 3'6" at the lowest point and
10' at the highest point. Planning on planting vine plants to cover the wall, blue star creeper and rosemary,
he submitted a picture. The wall will also have a stone veneer to soften the appearance. The neighbors at

1500 Alturas originally had a concerns with the ash trees proposed, however have changed the ash to
flowering cherry and now the neighbor is happy.
Commission stated they would like to see all the windows be true divided light windows. Stated that do not
like shutters that don't fit the size and shape of the window they are hung next to, would like to this as a
condition of approval. Commission noted that due to the driveway slope on lot #2 there are places where the
retaining wall will be 12' tall, can anything be done to reduce the height of the walls. Owner shouldn't
expect a flat driveway on a hillside property. Retaining wall on north side is a problem, need to reduce
height and appearance. Will be better and safer construction and will reduce difficulty with drainage
problems if you bring driveway lower. Don't build a 12' retaining wall if you don't have to. Mr. Jung
responded that after final construction when the footing is burred and the site is graded it won't appear to be
12 feet, the terrace was created to reduce the vertical appearance of the retaining walls. The 15% slope for a
driveway run that is this short makes for an uncomfortable transition to a flat garage slab. Commission
noted that up to a 20% driveway slope is allowed with a conditional use permit. The driveway has a 35'
length, should sink house down like the house on either side, reduce plate heights to 9 feet and increase
driveway slope. There were no further comments and the public hearing was closed.
Commission discussion: would like to see condition added that requires handing digging for base and
arborist supervision during the construction of the concrete walkway near the Redwood tree, and that this
walkway should be changed to pavers; big improvement on this project with design review, visual impact
has been addressed, would like to add a condition that true divided light windows be installed, overall
support project.
C. Keighran moved to approve the application, by resolution, with the following conditions as amended
during Commission discussion. The motion was seconded by C. Auran.
Chair Osterling called for a roll call vote on the motion to approve the conditional use permit for re-
emerging lots, and the design review, hillside area construction permit and special permit for attached garage
for both lots 1 and 2. The motion failed on a 2-4-1 (Cmrs. Bojues, Brownrigg, Osterling and Vistica
dissenting and C. Keele absent) roll call vote.
Discussion on the motion: can not support the proj ect, it is fundamentally flawed; o.k. with the house on the
right, but there are a lot of unresolved issues with the house on the left, are going to need to push it back.
Commission consulted with CA Anderson and asked if the project can be divided, can Commission just vote
to approve lot 1 and continued lot 2. CA Anderson stated that yes the project can be divided, but in order to
approved lot 1 Commission must also take action to approve conditional use permit for approval of the re-
emerging lots.
Commission gave the following direction to the applicant for lot 2:
• Need to lower driveway by increasing the slope to 15% and reduce the plates on the first and second
floors to 9 feet; and
May need to push the house back, that might cause trouble with the two protected trees on the lot, but
this is a large house and applicant may be forced to reduce to the size of the house to address this
issue.
C. Vistica made a motion to continue the action on lot 2 until the applicant has revised the plans and moved
to approve the application for the conditional use permit for re-emerging lots and approve the application
for lot #1 only for design review, hillside area construction permit and special permit for a an attached

garage byresolution, with the following conditions as amended during Commission discussion: 1) that the
project shall be built as shown on the plans submitted to the Planning Department date stamped April 14,
2004, sheets A1.0 through A5.0, topo, C-2 and L1.0, site plan, floor plans, roof plan, building elevations,
grading and drainage plan, and landscape plan; 2) that any changes to the size or envelope of the basement,
first or second floors, which would include adding or enlarging a dormer(s), moving or changing windows
and architectural features or changing the roof height or pitch, shall be subject to design review; 3) that the
conditions of the Recycling Specialist's, Fire Marshal's, and the City Engineer's November 17, 2004 memos
shall be met and the City Arborist's December 11, 2003 memo shall be met along with the approved
arborist's report date stamped January 6, 2004; 4) that the 24" Weeping Willow tree located in the front of
Lot #1 is approved for removal by the City Arborist as per Code Section 11.06.060(c); 5) that the 43"
Coastal Live Oak located on Lot #2, immediately adjacent to Lot #1, shall not be removed and the property
owner shall be responsible for implementing and maintaining all tree protection measures , prior to any

projects to submit a Waste Reduction Plan and meet recycling requirements; any partial or full demolition of
a structure, interior or exterior, shall require a demolition permit; 15) that demolition of the existing
structures and any grading or earth moving on the site shall be required to comply with all the regulations of
the Bay Area Air Quality Management District; 16) that prior to scheduling the foundation inspection a
licensed surveyor shall locate the property corners, set the building envelope; 17) that prior to under floor
frame inspection the surveyor shall certify the first floor elevation of the new structure(s) and the various
surveys shall be accepted by the City Engineer; 18) that prior to scheduling the roof deck inspection, a
licensed surveyor shall shoot the height of the roof ridge and provide certification of that height; 19) that

Dear Mr. Sun,
Since there was no appeal to or suspension by the City Council, the March 13, 2006, Planning Commission
approval of your applications for amendment to design review, hillside area construction permit and special
permit for an attached garage became effective March 23, 2006. This application was to allow modifications to a
new two-story single family dwelling on 1504 Alturas Drive, zoned R-1.
The March 13, 2006, minutes of the Planning Commission state your application was approved with the
following conditions:
that the project shall be built as shown on the plans submitted to the Planning Department date stamped
February 13, 2006, sheets A2.0, A2.1, A3.0 and A4.0 and date stamped April 14, 2004, sheets A1.0,
A1.1, A5.0, topographic map, C-2 and L1.0;
2. that any changes to the size or envelope of the basement, first or second floors, which would include
adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the
roof height or pitch, shall be subject to design review;
3. that the conditions of the Chief Building Official's February 17, 2006, memo, the Fire Marshal's February
21, 2006 and November 17, 2004, memos, the Recycling Specialist's February 22, 2006 and November
17, 2004, memos, and the City Engineer's November 17, 2004 memos shall be met;
4. that the 24" Weeping Willow tree located in the front of Lot #1 is approved for removal by the City
Arborist as per Code Section 11.06.060(c);
5. that the 43" Coastal Live Oak located on Lot #2, immediately adjacent to Lot #1, shall not be removed
and the property owner shall be responsible for implementing and maintaining all tree protection
measures , prior to any grading or demolition on the site. The tree protection measures, as defined in the
applicant's arborist report by the Green Jeannie (date stamped January 6, 2004) which has been reviewed
and approved by the City Arborist, shall be maintained on site until after the final inspection and the City
Arborist authorizes their removal; the contractor shall call for the City Arborist to inspect the protection
measures installed before a grading permit shall be issued, and that the property owner shall maintain the

trees after construction as directed by the certified arborist's report; failure to continually provide the tree
protection and implementation of any of those requirements in the arborist's report shall result in the
properly owner paying for an independent inspection of the site by an azborist selected by the City;
6. that a certified arborist shall be on site during any demolition and grading or digging activities that take
place within the designated tree protection zones, and that a certified arborist shall inspect the
construction site once a week and certify in writing to the City Arborist and Planning Department that all
tree protection measures are in place and requirements of the conditions of approval are being met;
inappropriately stockpiled or stored material and equipment shall be moved immediately; and that a
certified arborist shall be given written authority by the developer and be obligated to stop all work on the
site should any activity violate any and all conditions of approval relating to the protection, conservation
and maintenance of trees on the site, and the City Arborist may also stop work for any violation of the
conditions related to the protection, conservation and maintenance of trees on the site;
7. that prior to demolition or construction the 43" Coastal Live Oak located on right side of Lot #2,
immediately adjacent to Lot #1, shall be trimmed, raising the fringe only six feet over the existing roof
line, this shall be done under the direct supervision of a certified arborist at a time during the project
determined by the City Arborist;
8. that prior to demolition or construction 6" of mulch shall be placed 10' around the trunk of the 43"
Coastal Live Oak located on the right side of Lot #2, immediately adjacent to Lot #1, but shall not be
placed directly against the trunk;
9. that prior to demolition of the rear deck temporary barrier fencing shall be placed at 8' on the southwest
side of the.43" Coastal Live Oak, and 28'on the northeast side of the trunk;
10. that after the demolition of the rear deck, but prior to the construction of the new homes, protective
barrier fencing shall be placed as close to the drip line of the 43" Coast Live Oak as possible and shall
remain in place throughout the construction of both houses on Lot #1 and Lot #2;
11. that the protective barrier fencing shall be a minimum of 4 feet high, and shall be made ofpig wire, snow
fence, or cyclone fence, with steel stakes or pipes as posts; there shall be no storage of materials or
equipment, unnecessary trenching, grading or compaction within the protective barrier fencing;
encroachment into these areas is forbidden;
12. Tree Maintenance: The developer shall be responsible for maintenance during demolition and
construction work on the project and for a 5-year maintenance program for the 43" Coastal Live Oak,
including deep root fertilizing, beginning upon final inspection. This maintenance program shall be
founded upon the recommendations of the January 6, 2004 Green Jeannie report as well as such
additional recommendations as the developer shall receive from a certified arborist;

All site improvements and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

CEQA Status: Article 19. Categorically Exempt per Section: 15303 - Class 3- construction and location of
limited numbers of new, small facilities or structures including (a) single-family residences not in conjunction
with the building of two or more such units. In urbanized areas, up to three single-family residences may be
constructed or converted under this exemption.
History: On May 10, 2004, the Planning Commission approved an application for design review, hillside area
construction permit and special permit for attached garage for a new, two-story single family dwelling at 1504
Alturas Drive, zoned R-1 (formerly known as 1504 Alturas Drive, Lot 1) (May 24, 2004 P.C. Minutes). A
building permit was issued for the project on September 8, 2004. The project is currently under construction.
Revisions Requested: The applicant is now requesting an amendment to the previously approved design review
application for a new two-story single family dwelling with an attached garage. The applicant submitted a letter
and revised plans, dated February 13, 2006, explaining the changes to the project. A set of the originally
approved and proposed plans has been included for comparison. The applicant notes that during construction it
was discovered that a portion of the lower level crawl space has a higher ceiling than originally planned. In
addition, several changes are proposed to the exterior elevations and roof configuration. The following is a
summary of revisions proposed:
Convert crawl space to floor area in lower level: Crawl space adjacent to the office in the lower floor
with a ceiling height originally proposed at 5'-10" would be converted to a library and bathroom with a
ceiling height of 7'-6". The total area converted from crawl space to living area is 309 SF. A new
window would be added to this room (see Lower Level Floor Plan and Rear Elevation).
Increase in Iloor area: With this application, the applicant is proposing to reduce portions of the interior
volumes in the living room and loft area to be less than 12'-0" in height (see building sections, sheet
A4.0). As a result, the net increase in floor area on this lot would be 32 SF. This amendment application
would increase the total floor area on the site from 3,842 SF (0.43 FAR) to 3,874 SF (0.43) where 3,955
SF (0.44 FAR) is the maximum allowed (81 SF below the maximum allowed FAR). The proposed
increase in floor area is not visible since it is within the approved lower level which is partially below
grade and is located at the center of the house.
Front Elevation: Roof pitch above entry porch and dining room increased from 9:12 to 12:12 (see
revised Front Elevation, sheet A3.0). This revision does not change the overall building height.
Rear Elevation: There is a discrepancy in the originally approved plans. The architect notes in his letter,
dated February 13, 2006, that the originally approved Rear Elevation shows the roof above the kitchen
intersecting with the large main roof. If the project is built with the approved 10'-0" plate height at this
location, it will not intersect with the main roof causing the main roof to abruptly cut short and hang
above the kitchen roof. As a solution, the architect is proposing to increase the plate height in the kitchen
by 2'-6" (from 10'-0" to 12'-6") so that the kitchen roof will intersect with the main roof as originally
intended.

Left Elevation: The originally approved Left Elevation shows a continuous roof plan from the master
bedroom down to the toilet room in the master bathroom, making the plate height at this location less
than 6'-6". The architect is proposing to introduce another roof above the toilet room to provide a 9'-0"
plate height to match the plate height in the master bedroom.
Revised Project Summary: The applicant is requesting an amendment to an approved design review, hillside
area construction permit and special permit for an attached garage for a new two-story single family dwelling at
1504 Alturas Drive, zoned R-1. With this application, the proposed floor area would be 3,874 SF (0.43 FAR)
where 3,955 SF (0.44 FAR) is the maximum allowed (81 SF below the maximum allowed FAR). The subject
property slopes from the front to the rear, so street level is nearly even with the second floor elevation. On-site
parking required for this five-bedroom house (2 covered and 1 uncovered parking spaces) will be met in the
attached two-car garage, which requires a special permit.

Staff Comments: See attached. Planning staff would note that since this request is an amendment to a
previously approved project and the increase in floor area is within the footprint of the house, the amendment
request was taken directly to the consent calendar. If the Commission requires any additional information before
action, this item can be continued or discussed as a regular action item.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
1. Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Required Findings for Hillside Area Construction Permit: Review of a hillside area construction permit by
the Planning Commission shall be based upon obstruction by construction of the existing distant views of nearby
properties. Emphasis shall be given to the obstruction of distant views from habitable areas within a dwelling
unit (Code Sec. 25.61.060).
Findings for a Special Permit: In order to grant a special permit for an attached garage the Planning
Commission must find that the following conditions exist on the property (Code Section 25.51.020 a-d):
(a) The blend of mass, scale and dominant structural characteristics of the new construction or addition are
consistent with the existing structure's design and with the existing street and neighborhood;
(b) the variety of roof line, facade, exterior finish materials and elevations of the proposed new structure or
addition are consistent with the existing structure, street and neighborhood;
(c) the proposed project is consistent with the residential design guidelines adopted by the city; and
(d) removal of any trees located within the footprint of any new structure or addition is necessary and is
consistent with the city's reforestation requirements, and the mitigation for the removal that is proposed is
appropriate.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be by resolution and include findings for amendment to design review, hillside area construction permit
and special permit for attached garage. The reasons for any action should be clearly stated. At the public hearing
the following conditions should be considered, including those from the original approval (revised conditions in
italics):
1. that the project shall be built as shown on the plans submitted to the PlanningDepartment date stamped
February 13, 2006, sheets A2.0, A2.1, A3.0 and A4. 0 and date stamped Apri114, 2004, sheets A1.0, A1.1,
AS.O, topographic map, C-2 and L1.0;

2. that any changes to the size or envelope of the basement, first or second floors, which would include
adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the
roof height or pitch, shall be subject to design review;
3. that the conditions of the Chief Building Official's February 17, 2006, memo, the Fire Marshal's February
21, 2006 and November 17, 2004, memos, the Recycling Specialist's February 22, 2006 and November
17, 2004, memos, and the City Engineer's November 17, 2004 memos shall be met;
4. that the 24" Weeping Willow tree located in the front of Lot #1 is approved for removal by the City
Arborist as per Code Section 11.06.060(c);
5. that the 43" Coastal Live Oak located on Lot #2, immediately adjacent to Lot #1, shall not be removed
and the property owner shall be responsible for implementing and maintaining all tree protection
measures , prior to any grading or demolition on the site. The tree protection measures, as defined in the
applicant's arborist report by the Green Jeannie (date stamped January 6, 2004) which has been reviewed
and approved by the City Arborist, shall be maintained on site until after the final inspection and the City
Arborist authorizes their removal; the contractor shall call for the City Arborist to inspect the protection
measures installed before a grading permit shall be issued, and that the property owner shall maintain the
trees after construction as directed by the certified arborist's report; failure to continually provide the tree
protection and implementation of any of those requirements in the arborist's report shall result in the
property owner paying for an independent inspection of the site by an arborist selected by the City;
6. that a certified arborist shall be on site during any demolition and grading or digging activities that take
place within the designated tree protection zones, and that a certified arborist shall inspect the
construction site once a week and certify in writing to the City Arborist and Planning Department that all
tree protection measures are in place and requirements of the conditions of approval are being met;
inappropriately stockpiled or stored material and equipment shall be moved immediately; and that a
certified arborist shall be given written authority by the developer and be obligated to stop all work on the
site should any activity violate any and all conditions of approval relating to the protection, conservation
and maintenance of trees on the site, and the City Arborist may also stop work for any violation of the
conditions related to the protection, conservation and maintenance of trees on the site;
7. that prior to demolition or construction the 43" Coastal Live Oak located on right side of Lot #2,
immediately adjacent to Lot #1, shall be trimmed, raising the fringe only six feet over the existing roof
line, this shall be done under the direct supervision of a certified arborist at a time during the project
determined by the City Arborist;
8. that prior to demolition or construction 6" of mulch shall be placed 10' around the trunk of the 43"
Coastal Live Oak located on the right side of Lot #2, immediately adjacent to Lot #1, but shall not be
placed directly against the trunk;
9. that prior to demolition of the rear deck temporary barrier fencing shall be placed at 8' on the southwest
side of the 43" Coastal Live Oak, and 28'on the northeast side of the trunk;
10. that after the demolition of the rear deck, but prior to the construction of the new homes, protective
barrier fencing shall be placed as close to the drip line of the 43" Coast Live Oak as possible and shall
remain in place throughout the construction of both houses on Lot #1 and Lot #2;

11. that the protective barrier fencing shall be a minimum of 4 feet high, and shall be made of pig wire, snow
fence, or cyclone fence, with steel stakes or pipes as posts; there shall be no storage of materials or
equipment, unnecessary trenching, grading or compaction within the protective barrier fencing;
encroachment into these areas is forbidden;
12. Tree Maintenance: The developer shall be responsible for maintenance during demolition and
construction work on the project and for a 5-year maintenance program for the 43" Coastal Live Oak,
including deep root fertilizing, beginning upon final inspection. This maintenance program shall be
founded upon the recommendations of the January 6, 2004 Green Jeannie report as well as such
additional recommendations as the developer shall receive from a certified arborist;
13. that for purposes of these conditions a certified arborist means a person certified by the International
Society of Arboriculture as an arborist;
14. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction Plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit;
15. that demolition of the existing structures and any grading or earth moving on the site shall be required to
comply with all the regulations of the Bay Area Air Quality Management District;
16. that prior to scheduling the foundation inspection a licensed surveyor shall locate the property corners, set
the building envelope;
17. that prior to under floor frame inspection the surveyor shall certify the first floor elevation of the new
structure(s) and the various surveys shall be accepted by the City Engineer;
18. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof
ridge and provide certification of that height;
19. that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as window
locations and bays are built as shown on the approved plans; if there is no licensed professional involved
in the project, the property owner or contractor shall provide the certification under penalty of perjury;
20. that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the proj ect has been built according
to the approved Planning and Building plans;
21. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination
and installed on the portions of the roof not visible from the street; and that these venting details shall be
included and approved in the construction plans before a Building permit is issued;
22. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management
and Discharge Control Ordinance; and that during demolition of the existing residence, site preparation
and construction of the new residence, the applicant shall use all applicable "best management practices"
as identified in Burlingame's Storm Water Ordinance, to prevent erosion and off-site sedimentation of
storm water runoff;

Reference staff report May 10, 2004, with attachments. Plr. Barber presented the report, reviewed criteria
and staff comments. Twenty-three conditions were suggested for consideration for lot 1 and twenty-six
conditions were suggested for consideration for lot 2. Noted that conditions of approval for both lots refer to
April 14, 2004, plans but should read Apri128, 2004, plans.
Chair Osterling opened the public hearing. Derek Chung, property owner, 1504 Alturas Drive and Michael
Jung, architect, 4075 Papazuan Way, Fremont, were available to answer questions. Mr. Chung noted that he
tried to address the Planning Commission's concerns, which were mostly on lot #2 regarding the 15%
driveway verses the 12% driveway. They decided to keep the 12% driveway. With the original plans they
had a 15% driveway proposed , then during the design review process with Jerry Winges he suggested
reducing the slope and thought it would be a better solution. Provided a cross section in the revised plans
that shows both a 12% and 15% to show the difference between the two. Decided that the 12% slope was a
better alternative for the following reasons: 1) safety for a better approach; 2) appears cleaner from the street
without a big drop down; 3) practicality, don't want cars to scrape when entering and exiting the driveway.
Lot #2 has three retaining walls, the north wall steps down, is a terraced wall, 3'6" at the lowest point and
10' at the highest point. Planning on planting vine plants to cover the wall, blue star creeper and rosemary,
he submitted a picture. The wall will also have a stone veneer to soften the appearance. The neighbors at

1500 Alturas originally had a concerns with the ash trees proposed, however have changed the ash to
flowering cherry and now the neighbor is happy.
Commission stated they would like to see all the windows be true divided light windows. Stated that do not
like shutters that don't fit the size and shape of the window they are hung next to, would like to this as a
condition of approval. Commission noted that due to the driveway slope on lot #2 there are places where the
retaining wall will be 12' tall, can anything be done to reduce the height of the walls. Owner shouldn't
expect a flat driveway on a hillside property. Retaining wall on north side is a problem, need to reduce
height and appearance. Will be better and safer construction and will reduce difficulty with drainage
problems if you bring driveway lower. Don't build a 12' retaining wall if you don't have to. Mr. Jung
responded that after final construction when the footing is burred and the site is graded it won't appear to be
12 feet, the terrace was created to reduce the vertical appearance of the retaining walls. The 15% slope for a
driveway run that is this short makes for an uncomfortable transition to a flat garage slab. Commission
noted that up to a 20% driveway slope is allowed with a conditional use permit. The driveway has a 35'
length, should sink house down like the house on either side, reduce plate heights to 9 feet and increase
driveway slope. There were no further comments and the public hearing was closed.
Commission discussion: would like to see condition added that requires handing digging for base and
arborist supervision during the construction of the concrete walkway near the Redwood tree, and that this
walkway should be changed to pavers; big improvement on this project with design review, visual impact
has been addressed, would like to add a condition that true divided light windows be installed, overall
support project.
C. Keighran moved to approve the application, by resolution, with the following conditions as amended
during Commission discussion. The motion was seconded by C. Auran.
Chair Osterling called for a roll call vote on the motion to approve the conditional use permit for re-
emerging lots, and the design review, hillside area conshuction permit and special permit for attached garage
for both lots 1 and 2. The motion failed on a 2-4-1 (Cmrs. Bojues, Brownrigg, Osterling and Vistica
dissenting and C. Keele absent) roll call vote.
Discussion on the motion: can not support the project, it is fundamentally flawed; o.k. with the house on the
right, but there are a lot of unresolved issues with the house on the left, are going to need to push it back.
Commission consulted with CA Anderson and asked if the project can be divided, can Commission just vote
to approve lot 1 and continued lot 2. CA Anderson stated that yes the project can be divided, but in order to
approved lot 1 Commission must also take action to approve conditional use permit for approval of the re-
emerging lots.
Commission gave the following direction to the applicant for lot 2:
• Need to lower driveway by increasing the slope to 15% and reduce the plates on the first and second
floors to 9 feet; and
May need to push the house back, that might cause trouble with the two protected trees on the lot, but
this is a large house and applicant may be forced to reduce to the size of the house to address this
issue.
C. Vistica made a motion to continue the action on lot 2 until the applicant has revised the plans and moved
to approve the application for the conditional use permit for re-emerging lots and approve the application
for lot #1 only for design review, hillside area construction permit and special permit for a an attached

encroachment into these areas is forbidden; 12) Tree Maintenance: The developer shall be responsible for
maintenance during demolition and construction work on the proj ect and for a 5-year maintenance program
for the 43" Coastal Live Oak, including deep root fertilizing, beginning upon final inspection. This
maintenance program shall be founded upon the recommendations of the January 6, 2004 Green Jeannie
report as well as such additional recommendations as the developer shall receive from a certified arborist;

Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration
projects to submit a Waste Reduction Plan and meet recycling requirements; anypartial or full demolition of
a structure, interior or exterior, shall require a demolition permit; 15) that demolition of the existing
stnzctures and any grading or earth moving on the site shall be required to comply with all the regulations of
the Bay Area Air Quality Management District; 16) that prior to scheduling the foundation inspection a
licensed surveyor shall locate the property corners, set the building envelope; 17) that prior to under floor
frame inspection the surveyor shall certify the first floor elevation of the new structure(s) and the various
surveys shall be accepted by the City Engineer; 18) that prior to scheduling the roof deck inspection, a
licensed surveyor shall shoot the height of the roof ridge and provide certification of that height; 19) that
prior to scheduling the framing inspection, the project architect, engineer or other licensed professional shall
provide architectural certification that the architectural details such as window locations and bays are built as
shown on the approved plans; if there is no licensed professional involved in the project, the property owner
or contractor shall provide the certification under penalty of perjury; 20) that prior to final inspection,
Planning Department staff will inspect and note compliance of the architectural details (trim materials,
window type, etc.) to verify that the proj ect has been built according to the approved Planning and Building
plans; 21) that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that these venting details
shall be included and approved in the construction plans before a Building permit is issued; 22) that the
applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management and
Discharge Control Ordinance; and that during demolition of the existing residence, site preparation and
construction of the new residence, the applicant shall use all applicable "best management practices" as
identified in Burlingame's Storm Water Ordinance, to prevent erosion and off-site sedimentation of storm
water runoff; 23) that the project shall meet all the requirements of the California Building and Fire Codes,

REVISION STATEMENT
We have discovered that part of the lower level crawl space has a higher ceiling than ariginally
envisioned, thus providing additional living spaces. In addition, we have discovered that there are
discrepancies with the exterior elevations and the roof plan: in particular, the roof over the kitchen area at
the rear elevation, and the roof over the master toilet bathroom area at the ]eft elevation.
We are requesting for additional living spaces on the lower level for a library, and a bathroom. We are
reducing the interior volume in the living room and loft area on the main leveL The net square footage
increase from the currently approved design is 32 square feet, and this does not increase the footprint of
the approved design.
The approved rear elevation design shows that the roof over the kitchen area intersects with the large
main roo£ If we maintain the current plate height at 10', the large main roof will not intersect with the
kitchen roof, and the main roof will abruptly cut short and hang in mid air above the kitchen roof. We
feel this is not an acceptable design. We are proposing to increase the kitchen plate height by 2'-6" so that
the kitchen roof will intersect with the main roof, and this will maintain the currently approved rear
elevation design.
On the left side elevation, it shows that the roof is a continuous plane from the master bedroom down to
the master toilet bathroom; this will make the plate height less than 6'-6". We are proposing to introduce
another roof over the master toilet bathroom, and it is not on the same plane as the roof over the master
bedroom; this will make the plate height same as the master bathroom and bedroom at 9'-0".

RESOLUTION APPROVING CATEGORICAL EXEMPTION, AMENDMENT TO
DESIGN REVIEW, HILLSIDE AREA CONSTRUCTION PERMIT AND SPECIAL
PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
amendment to design review, hillside area construction permit and special permit for an attached
arg�a e for modifications to a new, two-story sin�le family dwelling at 1504 Alturas Drive, zoned
R-1, Derek and Amy Chun�, 140 Laurel Avenue, Millbrae, CA, 94030 property owners, APN:
027-061-060;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
March 13, 2006, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and categorical exemption, per CEQA Article 19, Section 15303 - Class 3-
construction and location of limited numbers of new, small facilities or structures
including (a) single-family residences not in conjunction with the building of two or more
such units. In urbanized areas, up to three single-family residences may be constructed or
converted under this exemption, is hereby approved.
2. Said amendment to design review, hillside area construction permit and special permit for
an attached garage are approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such amendment to design review, hillside area
construction permit and special permit for an attached garage are as set forth in the
minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

Conditions of approval for categorical exemption, amendment to design review, hillside area
construction permit and special permit for an attached garage.

1. that the project shall be built as shown on the plans submitted to the Planning Department
date stamped February 13, 2006, sheets A2.0, A2.1, A3.0 and A4.0 and date stamped
April 14, 2004, sheets A1.0, A1.1, A5.0, topographic map, C-2 and L1.0;
2. that any changes to the size or envelope of the basement, first or second floors, which
would include adding or enlarging a dormer(s), moving or changing windows and
architectural features or changing the roof height or pitch, shall be subject to design
review;
3. that the conditions of the Chief Building Official's February 17, 2006, memo, the Fire
Marshal's February 21, 2006 and November 17, 2004, memos, the Recycling Specialist's
February 22, 2006 and November 17, 2004, memos, and the City Engineer's November
17, 2004 memos .shall be met;
4. that the 24" Weeping Willow tree located in the front of Lot #1 is approved for removal
by the City Arbarist as per Code Section 11.06.060(c);
5. that the 43" Coastal Live Oak located on Lot #2, immediately adjacent to Lot #1, shall
not be removed and the property owner shall be responsible for implementing and
maintaining all tree protection measures , prior to any grading or demolition on the site.
The tree protection measures, as defined in the applicant's arborist report by the Green
Jeannie (date stamped January 6, 2004) which has been reviewed and approved by the
City Arborist, shall be maintained on site until after the final inspection and the City
Arborist authorizes their removal; the contractor shall call for the City Arborist to inspect
the protection measures installed before a grading permit shall be issued, and that the
property owner shall maintain the trees after construction as directed by the certified
arborist's report; failure to continually provide the tree protection and implementation of
any of those requirements in the arborist's report shall result in the property owner paying
for an independent inspection of the site by an arborist selected by the City;
6. that a certified arborist shall be on site during any demolition and grading or digging
activities that take place within the designated tree protection zones, and that a certified
arborist shall inspect the construction site once a week and certify in writing to the City
Arborist and Planning Department that all tree protection measures are in place and
requirements of the conditions of approval are being met; inappropriately stockpiled or
stored material and equipment shall be moved immediately; and that a certified arborist
shall be given written authority by the developer and be obligated to stop all work on the
site should any activity violate any and all conditions of approval relating to the
protection, conservation and maintenance of trees on the site, and the City Arborist may
also stop work for any violation of the conditions related to the protection, conservation
and maintenance of trees on the site;

7. that prior to demolition or construction the 43" Coastal Live Oak located on right side of
Lot #2, immediately adjacent to Lot #1, shall be trimmed, raising the fringe only six feet
over the existing roof line, this shall be done under the direct supervision of a certified
arborist at a time during the project determined by the City Arborist;
8. that prior to demolition or construction 6" of mulch shall be placed 10' around the trunk
of the 43" Coastal Live Oak located on the right side of Lot #2, immediately adjacent to
Lot #1, but shall not be placed directly against the trunk;
9. that prior to demolition of the rear deck temporary barrier fencing shall be placed at 8' on
the southwest side of the 43" Coastal Live Oak, and 28'on the northeast side of the trunk;
10. that after the demolition of the rear deck, but prior to the construction of the new homes,
protective barrier fencing shall be placed as close to the drip line of the 43" Coast Live
Oak as possible and shall remain in place throughout the construction of both houses on
Lot # 1 and Lot #2;
11. that the protective bamer fencing shall be a minimum of 4 feet high, and shall be made of
pig wire, snow fence, or cyclone fence, with steel stakes or pipes as posts; there shall be
no storage of materials or equipment, unnecessaxy trenching, grading or compaction
within the protective barrier fencing; encroachment into these areas is forbidden;
12. Tree Maintenance: The developer shall be responsible for maintenance during demolition
and construction work on the project and for a 5-year maintenance program for the 43"
Coastal Live Oak, including deep root fertilizing, beginning upon final inspection. This
maintenance program shall be founded upon the recommendations of the January 6, 2004
Green Jeannie report as well as such additional recommendations as the developer shall
receive from a certified arborist;
13. that for purposes of these conditions a certified arborist means a person certified by the
International Society of Arboriculture as an arborist;
14. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction Plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
15. that demolition of the existing structures and any grading or earth moving on the site
shall be required to comply with all the regulations of the Bay Area Air Quality
Management District;

16. that prior to scheduling the foundation inspection a licensed surveyor shall locate the
property corners, set the building envelope;
17. that prior to under floor frame inspection the surveyor shall certify the first floor
elevation of the new structure(s) and the various surveys shall be accepted by the City
Engineer;
18. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the
height of the roof ridge and provide certification of that height;
19. that prior to scheduling the framing inspection, the project architect, engineer or other
licensed professional shall provide architectural certification that the architectural details
such as window locations and bays are built as shown on the approved plans; if there is
no licensed professional involved in the project, the property owner or contractor shall
provide the certification under penalty of perjury;
20. that prior to final inspection, Planning Department staff will inspect and note compliance
of the architectural details (trim materials, window type, etc.) to verify that the project
has been built according to the approved Planning and Building plans;
21. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a
single termination and installed on the portions of the roof not visible from the street; and
that these venting details shall be included and approved in the construction plans before
a Building permit is issued;
22. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm
Water Management and Discharge Control Ordinance; and that during demolition of the
existing residence, site preparation and construction of the new residence, the applicant
shall use all applicable "best management practices" as identified in Burlingame's Storm
Water Ordinance, to prevent erosion and off-site sedimentation of storm water runoff;
23. that the project shall meet all the requirements of the California Building and Fire Codes,
2001 edition, as amended by the City of Burlingame;
24. that the shutters shall be consistent with the size and shape of the windows; and
25. that all windows shall be true divided light windows.

Since there was no appeal to or suspension by the City Council, the May 10, 2004 Planning Commission
approval of your applications for conditional use permit for re-emerging lots, design review, hillside area
construction permit and special permit for an attached garage became effective May 20, 2004. This application
was to allow the construction of a new two-story single family dwelling on 1504 Alturas Drive on lot 1(5), zoned
R-1. The application for lot 2(6) was not approved at this hearing and was continued.
The May 10, 2004 minutes of the Planning Commission state your application for lot 1(5) was approved with the
following conditions:
1) that the project shall be built as shown on the plans submitted to the Planning Department date stamped
April 14, 2004, sheets A1.0 through A5.0, topo, C-2 and L1.0, site plan, floor plans, roof plan, building
elevations, grading and drainage plan, and landscape plan;
2) that any changes to the size or envelope of the basement, first or second floors, which would include
adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the
roof height or pitch, shall be subject to design review;

that the conditions of the Recycling Specialist's, Fire Marshal's, and the City Engineer's November 17,
2004 memos shall be met and the City Arborist's December 11, 2003 memo shall be met along with the
approved arborist's report date stamped January 6, 2004;
that the 24" Weeping Willow tree located in the front of Lot #1 is approved for removal by the City
Arborist as per Code Section 11.06.060(c);.
5) that the 43" Coastal Live Oak located on Lot #2, immediately adjacent to Lot #1, shall not be removed
and the property owner shall be responsible for implementing and maintaining all tree protection
measures , prior to any grading or demolition on the site. The tree protection measures, as defined in the
applicant's arborist report by the Green Jeannie (date stamped January 6, 2004) which has been reviewed
and approved by the City Arborist, shall be maintained on site until after the final inspection and the City
Arborist authorizes their removal; the contractor shall call for the City Arborist to inspect the protection
measures installed before a grading permit shall be issued, and that the property owner shall maintain the

trees after construction as directed by the certified arborist's report; failure to continually provide the tree
protection and implementation of any of those requirements in the arborist's report shall result in the
property owner paying for an independent inspection of the site by an arborist selected by the City;
6) that a certified arborist shall be on site during any demolition and grading or digging activities that take
place within the designated tree protection zones, and that a certified arborist shall inspect the
construction site once a week and certify in writing to the City Arborist and Planning Deparhnent that all
tree protection measures are in place and requirements of the conditions of approval are being met;
inappropriately stockpiled or stored material and equipment shall be moved immediately; and that a
certified arborist shall be given written authority by the developer and be obligated to stop all work on the
site should any activity violate any and all conditions of approval relating to the protection, conservation
and maintenance of trees on the site, and the City Arborist may also stop work for any violation of the
conditions related to the protection, conservation and maintenance of trees on the site;
7) that prior to demolition or construction the 43" Coastal Live Oak located on right side of Lot #2,
immediately adjacent to Lot #1, shall be trimmed, raising the fringe only six feet over the existing roof
line, this shall be done under the direct supervision of a certified arborist at a time during the project
determined by the City Arborist;
8) that prior to demolition or construction 6" of mulch shall be placed 10' around the trunk of the 43"
Coastal Live Oak located on the right side of Lot #2, immediately adjacent to Lot #1, but shall not be
placed directly against the trunk;
9) that prior to demolition of the rear deck temporary barrier fencing shall be placed at 8' on the southwest
side of the 43" Coastal Live Oak, and 28'on the northeast side of the trunk;
10) that after the demolition of the rear deck, but prior to the construction of the new homes, protective
bamer fencing shall be placed as close to the drip line of the 43" Coast Live Oak as possible and shall
remain in place throughout the construction of both houses on Lot #1 and Lot #2;
11) that the protective barrier fencing shall be a minimum of 4 feet high, and shall be made of pig wire, snow
fence, or cyclone fence, with steel stakes or pipes as posts; there shall be no storage of materials or
equipment, unnecessary trenching, grading or compaction within the protective barrier fencing;
encroachment into these areas is forbidden;
12) Tree Maintenance: The developer shall be responsible for maintenance during demolition and
construction work on the project and for a 5-year maintenance program for the 43" Coastal Live Oak,
including deep root fertilizing, beginning upon final inspection. This maintenance program shall be
founded upon the recommendations of the January 6, 2004 Green Jeannie report as well as such
additional recommendations as the developer shall receive from a certified arborist;
13) that for purposes of these conditions a certified arborist means a person certified by the International
Society of Arboriculture as an arborist;
14) that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction Plan

and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit;
15) that demolition of the existing structures and any grading or earth moving on the site shall be required to
comply with all the regulations of the Bay Area Air Quality Management District;
16) that prior to scheduling the foundation inspection a licensed surveyor shall locate the property corners, set
the building envelope;
17) that prior to under floor frame inspection the surveyor shall certify the first floor elevation of the new
structure(s) and the various surveys shall be accepted by the City Engineer;
18) that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof
ridge and provide certification of that height;
19) that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as window
locations and bays are built as shown on the approved plans; if there is no licensed professional involved
in the project, the property owner or contractor shall provide the certification under penalty of perjury;
20) that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built according
to the approved Planning and Building plans;
21) that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination
and installed on the portions of the roof not visible from the street; and that these venting details shall be
included and approved in the construction plans before a Building permit is issued;
22) that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management
and Discharge Control Ordinance; and that during demolition of the existing residence, site preparation
and construction of the new residence, the applicant shall use all applicable "best management practices"
as identified in Burlingame's Storm Water Ordinance, to prevent erosion and off-site sedimentation of
storm water runoff;
23) that the project shall meet all the requirements of the California Building and Fire Codes, 2001 edition, as
amended by the City of Burlingame;
24) that the shutters shall be consistent with the size and shape of the windows; and
25) that all windows shall be true divided light windows.
Reimbursement of the remainder of your design review deposit has been processed and will be mailed to you
under separate cover.
All site improvements and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one

year may be considered by the Planning Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.

RESOLUTION APPROVING CATEGORICAL EXEMPTION, CONDITIONAL USE PERMIT FOR
RE-EMERGENCE OF TWO PARCELS, DESIGN REVIEW, HIILSIDE AREA CONSTRUCTION
PERMIT AND SPECIAL PERMIT FOR AN ATTACHED GARAGE
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
conditional use permit for re-emergence of two parcels, design review, hillside area construction
permit and special permit for an attached garage for a new two-stor ���le familv dwellin� at 1504
Alturas Drive, Lot 1(5), zoned R-1, Derek and Amv Chun , pro e�rty owners, APN: 027-061-050;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on May
10, 2004, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial
evidence that the project set forth above will have a significant effect on the environment,
and categorical exemption, per CEQA Article 19, Section: 15304 Class 4-(c) filing of
earth into previously excavated land with material compatible with the natural features of
the site; and Article 19. Categorically Exempt per Section: 15303 - Class 3- construction
and location of limited numbers of new, small facilities or structures including (a) single-
family residences not in conjunction with the building of two or more such units. In
urbanized areas, up to three single-family residences may be constructed or converted
under this exemption.
2. Said conditional use permit, design review, hillside area construction permit and special
permit are approved, subject to the conditions set forth in Exhibit "A" attached hereto.
Findings for conditional use permit, design review, hillside area construction permit and
special permit are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be r� ded in the official xecords
of the County of San Mateo. �

Effective May 20, 2004
1) that the project shall be built as shown on the plans submitted to the Planning Department
date stamped April 14, 2004, sheets A1.0 through A5.0, topo, C-2 and L1.0, site plan, floor
plans, roof plan, building elevations, grading and drainage plan, and landscape plan;
2) that any changes to the size or envelope of the basement, first or second floors, which
would include adding or enlarging a dormer(s), moving or changing windows and
architectural features or changing the roof height or pitch, shall be subject to design review;
3) that the conditions of the Recycling Specialist's, Fire Marshal's, and the City Engineer's
November 17, 2004 memos shall be met and the City Arborist's December 11, 2003 memo
shall be met along with the approved arborist's report date stamped January 6, 2004;
4) that the 24" Weeping Willow tree located in the front of Lot #1 is approved for removal by
the City Arborist as per Code Section 11.06.060(c);
5) that the 43" Coastal Live Oak located on Lot #2, immediately adjacent to Lot #1, shall not
be removed and the property owner shall be responsible for implementing and maintaining
all tree protection measures , prior to any grading or demolition on the site. The tree
protection measures, as defined in the applicant's arborist report by the Green Jeannie (date
stamped January 6, 2004) which has been reviewed and approved by the City Arborist,
shall be maintained on site until after the final inspection and the City Arborist authorizes
their removal; the contractor shall call for the City Arborist to inspect the protection
measures installed before a grading permit shall be issued, and that the property owner shall
maintain the trees after construction as directed by the certified arborist's report; failure to
continually provide the tree protection and implementation of any of those requirements in
the arborist's report shall result in the property owner paying for an independent inspection
of the site by an arborist selected by the City;
6) that a certified arborist shall be on site during any demolition and grading or digging
activities that take place within the designated tree protection zones, and that a certified
arborist shall inspect the construction site once a week and certify in writing to the City
Arborist and Planning Department that all tree protection measures are in place and
requirements of the conditions of approval are being met; inappropriately stockpiled or
stored material and equipment shall be moved immediately; and that a certified arborist
shall be given written authority by the developer and be obligated to stop all work on the
site should any activity violate any and all conditions of approval relating to the protection,
conservation and maintenance of trees on the site, and the City Arborist may also stop
work for any violation of the conditions related to the protection, conservation and
maintenance of trees on the site;

7) that prior to demolition or construction the 43" Coastal Live Oak located on right side of
Lot #2, immediately adjacent to Lot #1, shall be trimmed, raising the fringe only six feet
over the existing roof line, this shall be done under the direct supervision of a certified
arborist at a time during the project determined by the City Arborist;
8) that prior to demolition or construction 6" of mulch shall be placed 10' around the trunk of
the 43" Coastal Live Oak located on the right side of Lot #2, immediately adjacent to Lot
#1, but shall not be placed directly against the trunk;
9) that prior to demolition of the rear deck temporary barrier fencing shall be placed at 8' on
the southwest side of the 43" Coastal Live Oak, and 28'on the northeast side of the trunk;
10) that after the demolition of the rear deck, but prior to the construction of the new homes,
protective barrier fencing shall be placed as close to the drip line of the 43" Coast Live Oak
as possible and shall remain in place throughout the construction of both houses on Lot #1
and Lot #2;
11) that the protective barrier fencing shall be a minimum of 4 feet high, and shall be made of
pig wire, snow fence, or cyclone fence, with steel stakes or pipes as posts; there shall be no
storage of materials or equipment, unnecessary trenching, grading or compaction within the
protective barrier fencing; encroachment into these areas is forbidden;
12) Tree Maintenance: The developer shall be responsible for maintenance during demolition
and construction work on the project and for a 5-year maintenance program for the 43"
Coastal Live Oak, including deep root fertilizing, beginning upon final inspection. This
maintenance program shall be founded upon the recommendations of the January 6, 2004
Green Jeannie report as well as such additional recommendations as the developer shall
receive from a certified arborist;
13) that for purposes of these conditions a certified arborist means a person certified by the
International Society of Arboriculture as an arborist;
14) that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction Plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
15) that demolition of the existing structures and any grading or earth moving on the site shall
be required to comply with all the regulations of the Bay Area Air Quality Management
District;

16) that prior to scheduling the foundation inspection a licensed surveyor shall locate the
property corners, set the building envelope;
17) that prior to under floor frame inspection the surveyor shall certify the first floor elevation
of the new structure(s) and the various surveys shall be accepted by the City Engineer;
18) that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height
of the roof ridge and provide certification of that height;
19) that prior to scheduling the framing inspection, the project architect, engineer or other
licensed professional shall provide architectural certification that the architectural details
such as window locations and bays are built as shown on the approved plans; if there is no
licensed professional involved in the project, the property owner or contractor shall provide
the certification under penalty of perjury;
20) that prior to final inspection, Planning Department staff will inspect and note compliance of
the architectural details (trim materials, window type, etc.) to verify that the project has
been built according to the approved Planning and Building plans;
21) that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that
these venting details shall be included and approved in the construction plans before a
Building permit is issued;
22) that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance; and that during demolition of the existing
residence, site preparation and construction of the new residence, the applicant shall use all
applicable "best management practices" as identified in Burlingame's Storm Water
Ordinance, to prevent erosion and off-site sedimentation of storm water runoff;
23) that the project shall meet all the requirements of the California Building and Fire Codes,
2001 edition, as amended by the City of Burlingame;
24) that the shutters shall be consistent with the size and shape of the windows; and
25) that all windows shall be true divided light windows.
