HomeMy WebLinkAbout824 Alpine Avenue - Staff Reporto� ��� / P.C. 3/12/90 Item �� MEP�10 TO: PLANNING COMMISSION FROM: CITY PLANNER SUBJECT: EXTENSION OF A SPECIAL PERMIT TO CONVERT AN EXISTING ACCESSORY STRUCTURE TO STORAGE USE AT 824 ALPINE AVENUE� ZONED R-1 Tony De Angelis, property owner, is reguesting an extension to the special permit he received February 23, 1989 (Planning Commission Resolution No. 6-89) to convert an existing accessory structure used as an illegal second unit to storage use at 824 Alpine Avenue, zoned R-1. The original request was for special permits for an oversized accessory structure (500 SF permitted, 504 SF requested); windows within 10' of property line (windows proposed within 3�-3" and 8� oi property line); and storage area in excess of 10� of the gross floor area of the house (169 SF allowed, 504 SF proposed). In 1987 the accessory structure had been used for dwelling purposes. Code enforcement commenced when a building inspector found plumbing being extended to the accessory structure without a building permit. (October 12, 1988 City Attorney wrote a letter confirming the red tag and instructing the applicant to apply to the city.) The only other permits for this site, beside the original permit in 1948, was for corrections to the garage drain in February, 1987 (Building Permit #k2637) resulting from a sewer lateral test required on sale of property. Staff Review City staff have reviewed this request. There were no changes to the comments or requirements of the Chief Building Inspector (January 18, 1989) or City Engineer (January 18, 1989) in their previous memos. However, since this is a code enforcement matter, they and the Planning Department feel that the applicant should be given a definite time limit on completing this work. He should be required to take out a building permit within 30 days and complete work within 60 days. If these deadlines are not met the City Attorney will pursue legal action to have the property owner return the structure to the way it was built in 1948 as an open lanai use. If a use p�rmit extension is not granted the City Attorney will proceed immediately with legal action. Applicant�s Letter In his application for an extension (February 22, 1990) Tony De Angelis states he is asking to raise the floor even throughout the building and put in dry wall for a storage unit in the back yard.in order to upgrade an existing structure in the rear yard. There will be no exterior changes to the structure in the rear yard but he will be able to park his car in the garage. He comments he has z not had the financia� �bility in the past year to complete the project in a professionai m;��ner. Findinas for a Special Permit Extension In order to grant an extansion the Plann,ing Commission must find tk�e following conditions ��ist on the propErty (Code Sec. 25.52.020 a-c: (a) the proposed us�, at the proposed location, will not be detrimental or injurious to pr�,perty or improvements in the vicinity, and will not �� detrimental to the public health, safety, general weifare�, or conveni�n�e; (b) the proposed use will be loc�ted and conducted in a manner in accord with the Burlingame genEral plan and the purposes of this title; (c) the planning comr6lission may impose such reasonable conditiuns or restricticns as it deems necessary to secure the purposes of this t:tle and to assure operation of the u�e in a manner c�mpa�ib?e with the aesthetics, mass, bulk and character of existing and potential uses on adjoining propert�es in tre general vicinity. Planni�a Commission Action The Planning Cornmission shoulc� hold a public hearing. Affirmative action should be by resolution and will be recorded with the title to td:e property. The reason for any action should be clearly stated for the record. Since this structure had a bathroom at one time, if this structure is to be approved to remain in any form, the following needs to be done: 1. Completely remove all gas, sewer and water pipes and connec- tions heading to�the structure at the house. Plugging of connections will not be accepted. 2. CP Monroe reviewed details of the request, background of construction and use of this structure since 1958, staff review, Planning staff comment, applicant�s letters, study meeting questions. Three conditions were suggested for consideration at the public hearing. Commission/applicant discussion: is all_this_storage area needed, would applicant object to removing interior walls; applicant stated he did not want to remove the fireplace/barbecue, he would like to brick it in and cement it, the partitions are part of the structure; he has several hobbies, particularly gardening, with a need for storage space, the garage is very small, no one has been living in the accessory structure since he purchased the property, he asked for a letter regarding the status of the accessory structure but never received one, the previous owner now lives out of state. Special Permits are required for the size of the structure, (504 SF proposed, 500 SF allowed); windows on the structure within 10� of property line, (windows proposed within 3�-3" and 8� of property line); and storage area in excess of 10� of the gross floor area of the house (504 SF proposed, 169 SF allowed) [Code Sections 25.60.010 b,i, and 1]. This accessory structure was constructed in 1958 and consisted of a 345 SF lanai with a 131 SF storage shed attached to it. Over the years this structure has been enclosed and enlarged by 28 SF, plumbing and electricity has been added to it and it has been used as living area. The applicant is proposing to remove all plumbing in the structure and use it for storage use only. 5taff Review City staff have reviewed this request. The Fire Marshal (January 4, 1989 memo) had no comments. The Chief Building Inspector (January 18, 1989 memo) and the City Engineer (January 18, 1989 memo) note that if the building will be used for storage purposes, the existing barbecue inside the structure must be removed. In addition, all gas, sewer and water pipes to the accessory structure must be cut off at the main dwelling unit and the pipes leading to the accessory structure must be removed. In addition, the City Engineer is requesting that whatever pipes remain in the walls of the accessory structure, that each end of those pipes be plugged with concrete. It is also noted that all electrical except for one light fixture and one light switch must be removed. Planning staff would note that this project came to our attention as a code enforcement matter in June, 1988 when the Building Department found that work was being done to the structure without permits. A stop work order was issued and all construction activity has ceased for the time being. Applicant�s Letter In his letter date stamped January 13, 1989, the applicant notes that he purchased the property in April, 1986. When he bought the property there was someone living in the accessory structure. This structure was completely enclosed, the walls were sheetrocked and approximately 2/3 of the structure had a concrete floor. The remaining 1/3 of the structure had a raised -continued- � 1 `t • _4 floor and was used as a bedroom. The structure also had a toilet and sink at the rear. The applicant explains that he would like to remove the plumbing, raise the floor level with that in the bedroom and sheetrock the walls in order to use the structure for storage. The applicant notes that in its present condition the structure cannot be used for storage purposes. Study Ouestions At study on January 23, 1989 the Planning Commission reviewed this project and asked several questions. Enclosed in the packet is a reduced copy of the site plan which identifies the location of the existing garage on the property. This garage is 10�-2" x 20�. Regarding the preferred method for removing the plumbing to the structure, the City Engineer has noted that simply plugging the pipes is not sufficient since they can easily be unplugged and hooked up again. The preferred method would be to cut off the pipes going to the accessory structure at the main dwelling and then whatever pipes remain in the walls of the accessory structure, to have them plugged with concrete at both ends. The applicant has submitted a letter (date stamped February 3, 1989), in which he explains that he needs to raise the floor in the accessory structure to the same level as that in the bedroom in order to avoid having water seep into the structure during the rainy season. He also notes that the walls need to be sheetrocked in order to elliminate pests from entering the facility from the ground and from the floor vents. He is requesting to be allowed to use this structure for storage because there is not enough storage room available on his property, and currently he is having to rent storage space at a self-storage facility. THREE SPECIAL PERMITS TO USE AN ACCESSORY STRUCTURE FOR STORAGE PURPOSES AT 824 ALPINE AVENUE ZONED R-1 Requests: clarify why the walls will be sheetrocked if the structure is only for storage; why is the present structure unusable for storage; where is the garage on the property; is it better to remove or plug the pipes. Item set for public hearing February 14, 1989. 2. TWO VARIANCES AND A SPECIAL PERMIT FOR CONSTRUCTION OF A GARAGE AT 825 LINDEN AVENUE ZONED R-1 Requests: is garage in the rear 300 of the lot; letter from applicant addressing why his lot is unique; clarify overall depth of the garage; clarify distance from house to the garage; response from applicant to CE�s comment that space A cannot be used; is there a fence in front of the qarage between garage and street. TENTATIVE AND FINAL PARCEL MAP TO COMBINE LOTS 8, 9, 12 AND 13, BLOCK 17, 270 EAST LANE AND 255/257 MYRTLE ROAD Reference Engineering staff report, 1/23/89, with attachments. CE Erbacher reviewed this request to combine four lots into one lot in order to allow construction on the combined site. Area is zoned C-2 and is currently vacant. Staff recommended the map be forwarded to Council for approval. Responding to Commissioner question, CE advised this lot is not supporting any other businesses. Chm. Jacobs opened the public hearing. Stephen Cohn, property owner, 401 Primrose Road (business address) was present. There were no audience comments and the public hearing was closed. C. Garcia moved to recommend this tentative and final parcel map to City Council for approval. Motion was seconcled by C. Harrison and approved on a 6-0 roll call vote, C. Gi��iui absent. February 1, 1989 T0: BURLINGAME PLANNING DEPARTMENT RE: STORAGE UNIT AT 824 ALPINE Herein is the response to questions posed by the planning commission at thier January 23, 1989 meeting: 1) How large is the attached garage? 20' by 10'2". 2) Why is a raised floor required? During the winter months there is occasional seepage of water onto the concrete floor. This makes the room unfit for storage as it allows items placed in storage to get wet. By elevating the floor to the level of the floor in the old bedroom this problem is eliminated. 3) Why do the walls need to be sheet rocked? To eliminated pests from entering the storage facility, from the ground and floor vents. Additional comment: Curren�ly I maintain a ren�ed s�orage space at U-Stor-It, because there is not enough s�orage here. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo.
