Project Description: The existing single-story house with attached garage contains 2,029 SF of floor area and
has finro bedrooms. There is also a 292 SF second unit onsite that was legalized through the second unit
amnesty program in 2001. No changes are proposed to the second unit. The existing nonconforming lot
coverage is 2,331 SF where 2,200 SF is the maximum allowed.
The applicant is proposing to decrease the width of the playroom by 2'-1" and remove a chimney structure at the
rear, reducing the lot coverage from 2,331 SF (42.4%) to 2,255 SF (41 %). The applicant is also proposing to add
a 367 SF second story. With the proposed changes to the building footprint and the addition of the second story,
the floor area onsite will increase from 2,228 SF (0.41 FAR) to 2,527 SF (0.46 FAR) where the zoning code
allows a maximum of 2,860 SF (0.52 FAR). The project is 333 SF below the maximum allowed FAR.
With the addition, the number of existing bedrooms in the main structure will increase from three (3) to four (4)
(the playroom is considered a bedroom). Two parking spaces, one of which must be covered, are required for
the main structure. One uncovered parking space is required for the second dwelling unit. The existing attached
garage (9'-1 ° x 20'-3" clear interior dimensions) is non-conforming in width and the applicant has submitted an
application for a Parking Variance. Two uncovered spaces (9' x 20' each) are provided in the driveway. All other
Zoning Code requirements have been met. The applicant is requesting the following applications:
■ Design Review for a second story addition to a single family dwelling (CS 25.57.010, a, 5);
■ Variance for covered parking space width (9'-1" existing and proposed, where 10' is the minimum
required) (CS 25.70.030); and
■ Variance for a left side setback to the first story (5'-1" proposed where 6'-0" is required) (CS 25.28.072c).

Design Review Study Meeting: At the Planning Commission design review study meeting on December 8,
2008, the Commission had several comments and suggestions regarding this project (December 8, 2008
Planning Commission Minutes). The Commission voted to continue the item with direction to have the project
designer present when the item is rescheduled as a Design Review Study item. The property owner submitted a
response letterand revised plans (Sheets A-1, A-2, and A-5), date stamped December 19, 2008. Please referto
the copy of the December 8, 2008, Planning Commission minutes included in the staff report for the list of
Planning Commission concems.
One issue raised by the Planning Commission at the December 8th hearing was whether a Variance is required
for lot coverage. When a project is not adding additional lot coverage where it does not currently exist and is
decreasing lot coverage overall, it is considered an existing nonconforming condition, and staff does not require
the applicant to seek a Variance.

Dear Commissioners:
Thank you for you time to review my project. I read the minutes and listened meeting recordings.
Based on your comments, I made these changes to my project:
1. Replace the exisring concrete pario in my backyard with pavers to increase pervious area.
2. New windows will be metal or vinyl cladding wood frame.
3. The proposed second floor will have 6 feet side setback.
4. Create 1 ft step-up on the side wall and 1 ft bump-out on the back wall, adding complexity
to the addition.
I fully understand your comments about that the addirion is not well integrated. I have consulted
many designers including 3 AIA members, such as the local architect Jerry Winges. None of them
could produce a well integrated sketch without tearing down the whole roof, if not the whole house.
My house is located in a modest area, and the addition is hidden in my backyard with many tall trees.
It does not have the same visual impact as a corner house on the hill. On the other hand, we are new
to Burlingame and bought our house at the very top of the market trying to accommodate growing
family. A complete retrofit is far beyond overstretching. I hope you can be flexible on this issue.

The Planning Commission is required by law to make findings as defined by the City's Ordinance
(Code Section 25.54.020 a-d). Your answers to the following questions can assist the Planning
Commission in making the decision as to whether the findings can be made for your request.

a. Describe the exceptional or extraordinary circumstances or conditions applicable to
your property which do not apply to other properties in this area.
The existing left side setback is only 3 feet. Current planning code requires 6 feet.
b. Explain why the variance request is necessary for the preservation and enjoyment of a
substantial property right and what unreasonable property /oss or unnecessary
hardship might resu/t from the denial of the application.
The proposed design will increase left side setback from 3' to 5'-1". It is only 11 inches short from code
requirement but is a substantial improvement over the existing condition. It also meets Declining Height
Envelope and fire separation requirement.
On the other hand, the existing area which is used as a play room is 18'-2" wide. Losing 3 feet in width will
be a huge blow to the function of the room. If I keep the existing lst story wall with 3' setback and build
2nd story wall with 6' setback, it will be a serious structural problem to support the 2nd story wall.
c. Explain why the proposed use at the proposed location will not be detrimental or
injurious to properfy or improvements in the vicinity or to public health, safety,
general welfare or convenience.
The addition will reduce lot coverage and increase the side setback from 3' to 5'-1"
which is also good for fire separation. The existing shrub and trees in the backyard are
about 20 feet tall, blocking the view to neighbor. No trees will be removed and no new
pavement in the backyard.
d. How will fhe proposed project be compatible with the aesthetics, mass, bulk and
character of the existing and potential uses on adjoining properties in the general
viciniiy?
The addition actually reduces lot coverage and increases the side setback. It is located at
the rear of the house and only adds four feet to the total height, so it's hardly noticeable
from the street.

My house is located in a modest area of Burlingame, one block from the El Camino Real. The other
side of Albemarle way is occupied by semi detached houses, mostly two-story. On my side of the
street, the 2 neighbors next door also have two-story houses. Actually the proposed addirion will be
hardly noticeable from the street, because it is behind the garage and adds less than 4 feet to the total
height. In my back yard, there are trees along the fence as tall as 50 feet, so there is no new concern
of view blockage or shading. When I spoke with my neighbors and show them project drawings, their
feedbacks were supportive.
My house only has 2 bedrooms. My parents, both in their 70s, have not visited me since I moved to
USA simply because I cannot accommodate them. So I need the third bedroom, and I hope I can
build it as soon as possible. On the other hand, my child really enjoys the 18x22 feet playroom which
I try to preserve. The project will increase the side setback from 3' to 5'-1 ". It is only 11" short of the
code requirement but it will sarisfy the fire separarion requirement, greatly simplify structural design
and provide mnumum width for the second floor en-suite and the first floor playroom.
As far as the window selection, I choose the vinyl windows with longer warranty, better energy
performance (see attachment) and almost the same look as vinyl clad wood window. Equipped with
wood moldings and interior screens, there is little visible difference between these two types of
windows.
My project has a limited scope and budget. It cannot be compared to multi-million dollar mansions in
other parts of town. But I hope I could have the equal opportunity to enjoy the life in our beautiful
Burlingame.

While the project appears to not require sprinklers based upon proposed addition
and remodel, the project is close. Be advised where more than one (1) addition
and/or alteration for which building permits are required are made within a two
(2) year period and said alterations are made to the premises of the same
occupant. In such circumstances, the sum of these additions and/or alterations
construction costs during this two (2) year period shall be aggregated for the
purpose of calculating the replacement cost value formula. Final
determination will be made and the plan review phase of the project.
It is very important that you understand the threshold indicated by BMC
§ 17.04.030. Designer, contractor, and owner should communicate
specifically the extent of demolition and remodel. Keeping in mind any
change orders and addendums which increase the total amount of square
footage added or remodeled after plan review would be applied to the
sprinkler ordinance.

Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution from construction
activities. Project proponent shall ensure all contractors implement Best
Management Practices (BMPs) during construction.
Include a list of BMPs and erosion and sediment control measure plan as project
notes when submitting plans for a building permit. Please see attached brochure for
guidance.
