Since there was no appeal, a minor modification to allow a 3'-0" left side setback where 6'-0" is required at 1609 Albemarle Way, zoned R-1, was approved effective February 27, 2008. The project shall be built as shown on the plans submitted to the Planning Division and date stamped February 9, 2009. Any changes to these plans shall be subject to further minor modification procedures. The minor modification was approved with the following findings: 1. that the location of the proposed first floor remodel is located behind the existing main portion of the house so that it will not alter the character of the neighborhood and will not have a detrimental impact on the character of the adjacent properties; 2. that the original house was built with a 3'-0" left side setback which does not meet current code requirements and that the proposed removal and replacement of the existing wall_with a 3'-0" left _ side setback does not represent a greater impact on the adjacent property than the existing side setback; 3. Q that the proposed addition is compatible with the aesthetics, mass and character of the property and of adjacent properties and the neighborhood; and that the construction will meet the requirements of the Califomia Building and Fire Codes, 2007 Edition as amended by the City of Burlingame, and therefore will not be detrimental to public health, safety, or welfare. All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. NOTE: The Demolition Permit will not be issued until a Building Permit is issued for the project. 6) Comply with the 2005 California Energy Efficiency Standards for low-rise residential / non-residential buildings. Be advised where more than one (1) addition and/or alteration for which building permits are required are made within a two (2) year period and said alterations are made to the premises of the same occupant. In such circumstances, the sum of these additions and/or alterations construction costs during this two (2) year period shall be aggregated for the purpose of calculating the replacement cost value formula. Final determination will be made and the plan review phase of the project. It is very important that you understand the threshold indicated by BMC § 17.04.030. Designer, contractor, and owner should communicate specifically the extent of demolition and remodel.
