Your request for a minor modification was reviewed by property owners within 100 feet, the Planning
Commission and City Council. Since there was no appeal, a minor modification to allow a 3'-0" left side
setback where 6'-0" is required at 1609 Albemarle Way, zoned R-1, was approved effective February 27,
2008.
The project shall be built as shown on the plans submitted to the Planning Division and date stamped
February 9, 2009. Any changes to these plans shall be subject to further minor modification procedures. The
minor modification was approved with the following findings:
1. that the location of the proposed first floor remodel is located behind the existing main portion of the
house so that it will not alter the character of the neighborhood and will not have a detrimental
impact on the character of the adjacent properties;
2. that the original house was built with a 3'-0" left side setback which does not meet current code
requirements and that the proposed removal and replacement of the existing wall_with a 3'-0" left
_
side setback does not represent a greater impact on the adjacent property than the existing side
setback;

that the proposed addition is compatible with the aesthetics, mass and character of the property and
of adjacent properties and the neighborhood; and
that the construction will meet the requirements of the Califomia Building and Fire Codes, 2007
Edition as amended by the City of Burlingame, and therefore will not be detrimental to public health,
safety, or welfare.
All site improvements and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.

�1 On the plans specify that this project will comply with the 2007 California Building
Codes (CBC).
2) Anyone who is doing business in the City must have a current City of Burlingame
business license.
3) Provide fully dimensioned plans.
4) Provide existing and proposed elevations.
5) Provide a complete demolition plan that indicates the existing walls, walls to be
demolished, new walls, and a legend. NOTE: The Demolition Permit will not
be issued until a Building Permit is issued for the project.
6) Comply with the 2005 California Energy Efficiency Standards for low-rise
residential / non-residential buildings. Go to http://www.energv.ca.qov/title24 for
publications and details.

with the opening protection required in Table 704.8 the building face must be
more than three feet from the property line. On the plans show that these walls

While the project appears to not require sprinklers based upon proposed addition
and remodel, the project is close. Be advised where more than one (1) addition
and/or alteration for which building permits are required are made within a two
(2) year period and said alterations are made to the premises of the same
occupant. In such circumstances, the sum of these additions and/or alterations
construction costs during this two (2) year period shall be aggregated for the
purpose of calculating the replacement cost value formula. Final
determination will be made and the plan review phase of the project.
It is very important that you understand the threshold indicated by BMC
§ 17.04.030. Designer, contractor, and owner should communicate
specifically the extent of demolition and remodel. Keeping in mind any
change orders and addendums which increase the total amount of square
footage added or remodeled after plan review would be applied to the
sprinkler ordinance.

NPDES permit requirement to prevent stormwater pollution from construction
activities. Prc�ject proponent shali ensure all contractors implement Best
Management Practices (BMPs) during construction.
Include a list �f BMPs and erosion and sediment control measure plan as project
notes when submitting plans for a building permit. Please see attached brochure for

MINOR MODIFICATION REQUEST FOR REDUCED LEFT SIDE SETBACK
Dear Property Owner,
The Burlingame Planning Department has received an application for a Minor Modification at
the following address:
1609 Albemarle Way
APN: 025-205-150
APPLICATION FOR REMOVAL AND REPLACEMENT OF AN EXISTING WALL
AT 1609 ALBEMARLE WAY, ZONED R-1, THAT WILL HAVE A 3'-0" LEFT
SIDE SETBACK WHERE 6'-0" IS REQUIRED.
The applicant is proposing to remove and rebuild an existing room at the rear of the structure.
The new construction will have a higher floor height and different roof configuration. The
footprint of the structure will not change, and the proposed work does not require Planning
Commission review. However, a minor modification is required to remove and replace an
existing wall that has a left side setback of 3'-0" where a minimum of 6'-0" is required.
Your property is located within 100 feet of this property. The minor modification has been
requested to allow for the reduced side setback based on Municipal Code Section 25.55. Any
noticed property owner may call this item up for review. If you would like to request that this
project be reviewed, which includes a public hearing, you should submit a written
request to the Community Development Director within seven days of the postmark on
this letter. Unless review of the application is requested, the minor modification shall be
approved based upon the following findings:
