Date: June 23, 2006 �C.- Ma aret Monroe, ity Planner �3� � 4 � i+ RESOLUTION 050-2006 RESOLUTION APPROVING CATEGORICAL EXEMPTION, LOT COVERAGE VARIANCE AND CONDITIONAL USE PERMITS RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for lot covera�e variance-and conditional use permits for use of an existing accessory structure as a therapy room/sleeping room and to allow a bathroom with shower, sink and toilet at 1529 Albemarle Wav, zoned R-1, Allen Menicucci, property owner, APN: 025-228-350; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on June 12. 2006, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15303, Class 3— New Construction or Conversion of Small Structures, 3(e), accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences, is hereby approved. 2. Said parking variance and conditional use permits are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such parking variance and conditional use permits are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. � � � /l� �� � Chairman I, �i� �D G/kocK � , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 12th day of June, 2006 by the following vote: AYES: Commissioners: Brownrigg, Cauchi, Terrones, Vistica NOES: Commissioners: Auran, Deal ABSENT: Commissioners: Osterling ABSTAIN: Commissioners: NONE Secretary � • k- r EXHIBIT "A" Conditions of approval for categorical exemption, lot coverage variance and conditional use permits. 1529 Albemarle Way Effective June 22, 2006 1. that the project shall continue to be consistent with the plans submitted to the Planning Department and date stamped March 30, 2005, Site Plan, Floor Plan and Elevations; 2. that the accessory structure use shall be limited to a therapy room and sleeping quarters for family guests or a caretaker to stay as needed; 3. that if there is a building permit for an addition or an alteration to the main structure or for any construction valued at $50,000 or more on this property, the accessory structure shall be demolished and any use permits for the accessory structure voided; 4. that the accessory structure shall never be used as a second dwelling unit, shall never include a kitchen or cooking element, and shall not include additional or upgraded utility services without an amendment to this conditional use permit; 5. that the lot coverage variance being granted is based on the existing conditions on the property which were approved by previous permits; the lot coverage variance is applicable only to the existing accessory structure, cannot be transferred to any other portion of the property and will cease when any portion of the existing structure or the accessory structure is removed; and 6. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2001 Edition, as amended by the City of Burlingame. -2-
