Summary: The applicant, Ron Bernstein, representing Color Copy Printing, requests an
exception from the sign ordinance to replace an existing two-sided pole sign with a larger two-
sided pole sign with changeable copy and a digital clock and an overall height of 24'-0".
The applicant requests exceptions from the sign ordinance to permit:

A pole sign with an overall height of 24'-0" where a maximum height of 20'-0" is permitted
(C. S. 22.20.060);
A changeable copy sign which requires approval by the Planning Commission (C.S.
22.29.010);
A total signage area of 416 SF on the primary frontage where a maximum area of 200 SF
is permitted (C.S.22.20.020); and,
4. Three signs on the primary frontage where a maximum of two signs are permitted (C. S.
22.20.040).
In the supplemental application material date stamped December 8, 1999, the applicant states that
the copy on the changeable copy sign will include: "special items advertising their business, and
messages advertising special community or city events". Some public service messages such as,
"vote today; donate blood; school is out, etc." will be illuminated on the changeable copy sign.
The duration of each message would be about a day at a time, and the applicant states that the
sign copy will not change minute by minute.

**** A total of 416 SF of signage is proposed on the primary frontage where a maximum area of
200 SF is allowed.
Staff' Comments:
This application was reviewed by the Fire Marshal, Chief Building Official, and City Engineer.
Planning Staffwould note that the existing digital time clock was added to the existing pole sign
without review from the Planning Department and was identified in a February 9, 1999 report
from the Code Enforcement Officer (note: the Hertz car parking issue has already been resolved).
There were no staff comments regarding the application. Because the pole sign with changeable
copy would be visible from the right-of-way along Highway 10 ], the applicant included
correspondence from CalTrans which verifies that a State Outdoor Advertising permit is not
required if the applicant advertises only their firm on the changeable copy sign.
Study Meeting:
At the January 10, 2000 study meeting, the Planning Commission reviewed the application
materials and staff report and requested additional information. The Commission inquired about
the height and size of the existing DHL pole sign on the adjacent parcel at 1635 Adrian Road. A
variance for an over height pole sign with a total height of 48'-0" and signage area of 8'-0" x 40'-
0° (320 SF) on each face, was originally approved for this site in 1967. Numerous companies
have occupied the site at 1635 since that time, with DHL receiving approval to change the copy
on the non-conforming sign in 1994. The SonicAir sign at 1601 Adrian Road has also had the
face copy changed numerous times since the original sign exception was issued in 1974. The 35'-
0" tall sign was approved because the signage was used to identify the street location of the
business and to also serve as freeway advertising, with a tall enough sign to be visible over the
existing eucalyptus trees located between the freeway and the business location. Each face of the
sign at 1601 Adrian Road measures 26'-6" in length and 8'-6" in height providing an area of 225
SF on each face and 450 SF total for the pole sign.
The property owner's attorney, Mark Hudak, responded to the other c�uestions raised by the
Planning Commission with a letter date stamped January 19, 2000. Mr. Hudak stated that the
height and size ofthe proposed sign is necessary to provide clear visibility from Highway 101, and
such a sign is consistent with other existing signs in this M-1 area. Because Color Copy is a
smaller local business, it does not have the immediate name recognition of a national company,
such as DHL, and therefore Color Copy hopes the changeable copy sign will advertise their
services and capabilities in order to attract more customers who may be unfamiliar with the Color
Copy business.
The Commission asked whether a condition could be included to limit the frec�uency of change in
the copy on the changeable copy sign. Mr. Hudak stated in his letter that the owners would
accept a condition which limits the frequency of copy changes to once per day and not alternate
messages. He explained that the language on the sign would advertise the capabilities of Color
Copy and with the Commission's permission, would advertise public service announcements, and
would not advertise `special rates'. The sign would use 5- 10 watt lights and would not be made
with high intensity, color resolution (compared to the Serramonte Shopping Center sign).

Please note we are AGAINST granting an exception for this oversized electronic sign. I note
200 sq. feet is aliowed, 200 sq. feet may be 10x20, which is very large, the sign in question may
be OVER 20'x20' — this is not currently allowed and should not be allowed. 1 note any size over
that allowed by code should be disallowed. I ALSO note your attention regarding ANY type of
electronic sign should be DISALLOWED, these signs do not add to our community, but only
make it look like a circus.

Mr. Hudak also clarified the current status of any code enforcement actions on this site. The
Code Enforcement Officer's action relating to the unauthorized installation of the digital time
clock is currently on hold, as this request is included in the current sign exception application.
Staff has added a condition to require the immediate removal of the digital clock for this sign if
the sign exception is not approved. Mr. Hudak also provided a copy of a 1996 building permit
for the sentry structure located at the front of the property.
Findings for a Sign Exception:
In order to prevent or lessen practical difficulties and unnecessary hardship inconsistent with the
objectives of the Sign Code, the Planning Commission may grant an exception from the
regulations relating to height, area, location or number of signs if each of the following findings is
made (CS 22.06.110 a-b):
a) any exception granted shall be subject to such conditions as will assure the adjustment
thereby authorized shall not constitute a grant of special privilege inconsistent with the
limitations upon other properties in the vicinity and district in which the subject property is
situated; and
b) because of special circumstances applicable to the subject property, including size, shape,
topography, street frontage, location or surrounding land use; the size or height of the
building on which the sign is to be located; the classification of the street or height on
which the sign is located or designed primarily to be viewed from, or the strict application
of zoning regulations is found to deprive subject property of privileges enjoyed by the
other properties in the vicinity and under identical zone classification.
Planning Commission Action:
The Planning Commission should hold a public hearing. Affirmative action should be made by
resolution and should include findings made for the exception requested. Reasons for any action
should be clearly stated. At the public hearing the following conditions should be considered:
that the project shall be built as shown on the plans date stamped November 10, 1999,
with a free-standing pole sign with a height of 24'-0", with two sides of copy having 168
SF of copy per side (total of 336 SF of copy on pole sign), and changeable copy including
a digital clock;
2. that the applicant shall obtain and provide verification of approval from CalTrans for a
changeable copy sign prior to application for a building permit;
3. the frequency of change of copy for each statement on the changeable copy sign shall be
no more than once per day with no alternating of inessages;
4. that no off-site advertising of other commercial businesses, services, or products shall be
permitted;
5. if the sign exception application is not approved and the applicants do not approve the

decision made by the Planning Commission, the applicant shall remove the digital clock
within 30 days of the city's last action on the sign exception request; and
6. that the project shall meet all uniform building code and fire code requirements as
amended by the City.

drawing of eave and how they will work, with better resolution it would really finish off the design of the house; similar

little that they do not provide the shadow and articulation needed), these issues should be addressed at the front of this

granted, is it tied to retail sales use of the site, what are the options for limiting the use and the variance. There were na

service notices on the reader board it appears that he will need an Outdoor Advertising Pernut from the State of
California. This requirement must be met before he could install any reader board approved by the city. The
commissioners asked regarding the application: what are the sizes of the DHL, Sonic Air, and Briggs and Stratton signs;
can the clock be integrated into the sign and not appear as an added-on element; conditions should state the length of time
for each sign posted on the changeable copy part of the sign; is the entire sign black and white; what is the reason for on
going advertising; what is the current status of the enforcement on the code violation (installation of the clock without
sign and other permits); how can the city enforce a time limit on the message changing of the sign; this request raises a
lot of issues such as what should the image of Burlingame be along the freeway, how bright should this sign be, how much
action should be allowed on the sign, these are city image issues that need to be addressed; could CA address how much
control the city has over such a sign, CA noted control over size and color and whether copy relates to on-site or off-site
advertisement; can the owner word messages any way he wishes, yes; commissioners should look at the sign at
Serramonte Shopping Center to see what the impact of illumination can be, CA noted that commission can regulate
brightness, applicant should tell us how many lumens the proposed signage would be; discussion seems to indicate that
changeable copy sign is inappropriate both in tenns of city image and control, digital clock seems OK; would like a clearer
description about the finding for each ofthe sign exceptions, the reasons given in the attachments i.e., the applicant would
like to have the signs and the need to clarify the company name, are not reasons for sign exception findings. The item
was placed on the regular action calendar, for the January 24, 2000, meeting if all the information is provided to the
Planning Department in time.

Inteusity. Serramonte's sign is full color and S�igh int�nsity. Color Copy's si�;n

U AND SIGN EXCEPTION
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been proposed and application has been made for a sien
exception for an overwei�ht over-size changeable copy pole sign at 1649 Adrian Road zoned M-1
Color Copy property owner APN� APN� 025 262 320;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on _
January 24 2000 , at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
CEQA Section 15301 is hereby approved.
2. Said sign exception is approved, subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such sign exception are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

1649 Adrian Road
effective February 7, 2000
Conditions:
that the project shall be built as shown on the plans date stamped November 10, 1999, for
a free standing pole sign with a height of 24'-0", with two-side copy having 168 SF of
copy per side (total of 336 SF of copy on pole sign), and changeable copy, including a
digital clock;
2. that the applicant shall obtain and provide verification of approval from CalTrans for a
changeable copy sign prior to application for a building permit;
3. the frequency of change of copy for each statement on the changeable copy sign shall be
no more than once per day with no alternating of inessages;
4. that no off-site advertising of other commercial businesses, services, or products shall be
permitted;
5. if the sign exception application is not approved and the applicants do not approve the
decision made by the Planning Commission, the applicant shall remove the digita] clock
within 30 days of the last action on the sign exception request, and
6. that the project shall meet all uniform building code and fire code requirements as
amended by the City.
