which meet the performance standards of the M-1 zone district (CS 25.44.030 (4)).

Allowable Use: Automobile Storage for Car Rental Business subject to performance standards with a
special permit.
Summary: The applicant, The Hertz Corporation, is requesting a special permit to allow storage of
vehicles for their automobile rental business at 1649 Adrian Road, zoned M-l. This application came
to us as a result of a code enforcement action. Aertz Rent A Car is cunently using the space behind the
Color Copy building at 1649 Adrian Road to store overflow vehicles from its operation at the San
Francisco International Airport. This overflow storage primarily occurs between Friday and Sunday,
when there are fewer vehicles rented. The applicant also states that the use of this area is only required
on an interim basis until a new car storage facility at the airport is completed at the end of 1998.
The vehicles will be stored in 58' x 600' (34,800 SF) area behind the Color Copy building as shown
on the site plan date stamped March 25, 1998. This area is not part of the required parking for the
building at 1649 Adrian Road. However, this paved area also provides fire access to the rear of the
building. The Fire Department has indicated that the parked vehicles shall not interfere with Fire
Department access to the building for laddering purposes and shall not interfere with exiting from the
building.
The M-1 zoning district specifies that automobile storage for car rental businesses require a special
permit and must meet the following minimum standards.
1. vehicles shall not be moved during a.m. and p.m. peak hour traffic periods as defined by the
City Engineer;
2. minimum site size of .7 (seven-tenths) acres;
3. azea enclosed with an opaque fence eight (8) feet in height at a location approved by the Public
Works Department.

The a.m. peak hour is generally considered to be between 7:00 a.m. and 9:00 a.m. Monday through
Friday, and the p. m. peak hour is between 4:00 p. m. and 6:00 p. m. Monday through Friday. A
condition of approval should be considered that no cars shall be moved between 7:00 a.m. and 9:00 am,
and between 4:00 p. m. and 6:00 p. m. Monday through Friday. T'he area where the cars aze to be stored
consists of appro�cimately 34,800 SF of paved area (0.8 acre), and is enclosed by an 8' high solid fence.
The cars are stored at this site primarily between Friday morning and Sunday evening. On Fridays, 12
to 15 employees would move up to 210 cars from the Hertz Rent A Car facility at the airport to the site.
On Saturday and Sunday evenings, the 12 - 15 employees would move vehicles back to the airport
facility. The applicant notes that occasionally cars would be moved from the airport facility to the site
on Thursday evenings between 6:00 p.m. and 10:00 p.m., and the cars would be returned to the airport
on Monday mornings.
The applicant has provided a list of the other businesses located in this building. Color Copy Printing
has a total of 232 employees and is open 24 hours a day. Nationwide Mailing has a total of 84
employees and is open from 7:00 a.m. to 11:30 p.m. Three-Day Envelopes has a total of 12 employees
and is open from 8:00 a.m. to 4:30 p.m. Idea Brokers has a total of 10 employees and is open from
8:00 a.m. to 5:00 p.m. There are a total of 212 parking spaces on the site, and 205 parking spaces are
required for the uses which occupy the building. The paved area behind the building is not a part of
the required parking.

This project meets all other zoning code requirements.
Staff Comments: The Fire Mazshal notes (Mazch 30, 1998 memo) that: 1) parked vehicles shall not
interfere with Fire Department access to building for laddering purposes; and 2) pazked vehicles shall
not interfere with exiting from building. The Chief Building Inspector and the City Engineer had no
comments on the project.
Study Meeting: At the Apri127, 1997 Planning Commission study meeting, the commission asked the
applicant when did the car rental storage use at this location begin, and why did they not apply for a
spacial permit before they began the use. The applicant has responded in the attached memorandum date
stampefl May 4, 1998. The Hertz Corporation has had vehicles stored at this location on an intermittent
basis since December, 1996. They were not aware of the requirement of the special permit until the
letter regarding the code enforcement action was received.
The commission asked if any other sites in this area of Burlingame are used by Hertz for car rental
storage. The applicant states that property at 1730 Rollins Road, Prime Time Athletic Club, has also
been used for car storage since March, 1997. They were not aware of the requirement for a separate

special permit for this properiy, and state in their response that they have requested a permit at this site.
Staff would note that a special permit application for car rental storage has not been receiveri for car
storage at 1730 Rollins Road. A letter will be sent to the property owner informing him of this
requirement.
The commission asked how the cars are parked within the designated area. The applicant states that the
vehicles are parked bumper to bumper and aze at least 6 inches apart from each other. Staff would note
that the proposed conditions of approval have been drafted to include a requirement for maintenance of
a fire lane. The commission also asked where the keys to the parked cars are kept. The applicant states
that the keys are kept in a locked cabinet at the Dispatch Booth at the main facility at the airport. The
commission asked how are the cars delivered and picked up, individually or by car transporters. The
applicant states that vehicles are delivered and pickerl up via crews of 8-15 employees at a time, with
each vehicle driven by one employee.
T'he commission asked where are the contracts for rental of these cars written, and is there any revenue
to Burlingame for this use. The applicant states that the contracts are written at the San Francisco
International Airport, and no revenue goes to the City of Burlingame. The commission asked how this
use will affect the required parking for the tenants who already have more employees on the site than
striped parldng spaces. The applicant notes that the car storage does not take place within the required
parldng for the building, but takes place in back of the building. The commission also asked if Hertz
will pay for maintenance of the street. The applicant states that they will not pay for the street
maintenance, they feel the wear and tear on the street is minimal, their drivers are safe and stay well
under the speed limit, and notes that there are many large and heavy freight trucks which frequently use
Adrian Road.
The commission stated that the use is intended to be short term and noted that there should be a
condition on the permit limiting the use to short term. The applicant indicates that the new
transportation center at the airport will open in November, 1998 and they will no longer require the use
effective 12/1/99. The proposed conditions have been drafted to include a condition limiting the use
to this time. Tfie commission asked how will security be provided to the cars, will animals be used for
security. The applicant states that there is 24-hour security on the property provided by Color Copy,
and the entire perimeter of the property is fenced. Access to and from the facility is controlled by a
security gate with a manned booth, and no animals will be used for security.
�ndings for a Special Permit: In order to grant a Special Permit the Planning Commission must find
that the following conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame
general plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems
necessary to secure the purposes of this title and to assure operation of the use in a manner

compatible with the aesthetics, mass, bulk and character of existing and potential uses on
adjoining properties in the general vicinity.
Planniiig Commiccion Action: The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution and should include findings. The reasons for any action should be
clearly stated. At the public hearing the following conditions should be considered:
Conditions:
1 that automobile storage for the rental car facility shall operate as shown on the plans submitted
to the Planning Department and date stamped March 25, 1998, Site Plan;
2. that the rental cars shall not be moved to and from the site between the hours of 6:30 a. m. and
9:00 a. m. or between the hours of 4:00 p. m. and 6:30 p. m. Monday through Friday;
3. that a line demarcating the fire lane and the words `fire lane' shall be painted on the paved
surface within the parking area and `fire lane' signs shall be posted on the building;
4. that the conditions of the Fire Mazshal's March 30, 1998 memo shall be met;
5. that the special permit for automobile storage for car rental with the conditions listed herein is
a temporary use and shall expire on December 1, 1999; and
6. that the use and any improvements for the use shall meet all the requirements of the Uniform
Building and Uniform Fire Codes, 1995 Fdition, as amended by the City of Burlingame.

for car rental storage; how are the cars parked within the designated area; where are the keys
to the parked cars kept; the physical condition of Adrian Road is very poor, the increase in
trafiic caused by this use does not help the road's condition, how are the cars delivered and
picked up, one at a time or by car transporters; where are the contracts for the rental of these
cars written, is there any revenue to Burlingame for this use; how will this use affect the
required parking for the tenants who already have more employees on the site than striped
parking spaces; will Hertz pay for maintaining the street; if the use is intended to be short term
there should be a condition on the permit limiting the use to a short term; how will security be
provided to the cars, will animals be used for security. There were no other questions and the
item was set for public hearing on May 11, 1998, provided all the answers could be compiled
by then.

Dear Board Members,
The purpose of this correspondence is to clarify the use of the property located at 1649 Adrian Rd.,
Burlingame, California.
Currently, the Airport Commission Office provides Hertz with space to park approximately 500 vehicles
while running the operations. On any given Friday/Saturday/Sunday, we could possibly have 1500 to
2300 vehicles sitting idle. We have enough overflow parking space to accommodate approximately 1100
vehicles. Consequently, we have an overflowparking deficit ranging between 400 and 1200 vehicles,
beginning Friday and ending on Monday when our rentals exceed our returns.
On Fridays, we would need to move approximately 210 vehicles from the airport to 1649 Adrian Rd.
between the hours of 5:00 AM and 12:00 PM, and 5:00 PM and 8:00 PM. Our goal is to limit car
movements between the hours of 12:01 PM and 5:00 PM to avoid traffic congestion. Occasionally. we
would move cars from the airport on Thursdays at about 6:00 PM through 10:00 PM (only when the
vehicles idle is expected to exceed 2000. This occurs about six times each year.)
On Saturdays, at about 5:00 PM, or Sundays at about 8:00 PM we would begin moving vehicles from
1649 Adrian to the airport. On rare occasions, we would not be able to move the cars until Monday
mornings starting at 0700 through 0900.
The Airport Commission is relocating all of the rental car companies tentatively in the fall of 1998. At
that time, the Airport Commissions Office will provide us with adequate space to park more than 3,000
vehicles. We respectfully request you approve the use permit which will allow Hertz to park vehicles in
the 1649 Adrian Rd until such time as we are relocated.

Thank you for your time and interest in the matter concaming the property at I 649 Adrian
Road, Below are answers to the questions that we received via fax on April Z°.
When did the car rental storage at this locavon begin?
The Hertz Corporation has had vahicles stored at I 649 Adrian since approximately 12/I 3/96
on an irrterrnittent basis,

The Hertz Corporation was not aware of the fad that a permit was required until Color Copy
received notice from the City of Burlingame that it was required.

Yes. There is an adjacent property to the I 649 lot , which is a part of the Prime Time Athletic
Club, Inc. We have been using the Prime Time lot for storaga since approximately 3/ I 5/97,
Due to the fact that the lots are connected it was not clear until recently that we would need
to apply for a separate permit for the Prime Time properry.
We have requested a permit for the lot at 1730 Rollins Road (Prime Time Athletic Club Inc,).

The vehicles are parked bumper to bumper. We mandate that the vehicles must be at least 6
inches apart from one another. There is always enough space for our employees to walk
between vehicles in order to take inverrtory and to dekey the vehicles,

When vehicles are stored the keys are kept in a locked cabinet at the Dispatch Booth at our
main facility located at the airport. The Dispatch Booth is manned 7_4 hours and someone is
always available to deliver keys and to retrieve vehicles,
How are cars delivered an_d�i'1c�C�d_�? One at a t�me or by car trans�orters?
Vehicles are delivered via crews of 8-15 employees at a time. Each individual vehicle is driven
by one employee, The employees drive the vehicles in the designated area as specif ed by at
leasttwo supervisory personnel. The vehicles are picked up by crews of 8- I 5 employees at a
time,

The striped parldng spaces are in no way compromised by our vehicles on the property. The
storage of vehicles takes place in the back of the building, The striped parking spaces are
located in the front of the building,

No, We feel that the wear and tear on the street is minimal. Our drivers are extremely safe
and typically stay well underthe speed limit, due to the fact thattheir employmerrt is contingent
upon a clean driving record. 7here are many large and heavy freight trucks that frequently use
Adrian Road.

the property is fenced, Access to and from the facility is controlled by a security gate, which is

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
Mav 11, 1998 , at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
CEQA Article 19, Section 15301, Existing facilities, Class 1(a), interior or exterior alterations involving
such things as interior partitions, plumbing, and electrical conveyances is hereby approved.
2. Said Special Permit is approved, subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such Special Permit are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

1 that automobile storage for the rental car facility shall operate as shown on the plans
submitted to the Planning Department and date stamped Mazch 25, 1998, Site Plan;
2. that the rental cars shall not be moved to and from the site between the hours of 6:30 a. m.
and 9:00 a. m. or between the hours of 4:00 p. m. and 6:30 p. m. Monday through Friday;
3, that a line demarcating the fire lane and the words `fire lane' shall be painted on the paved
surface within the parking area and `fire lane' signs shall be posted on the building;
4, that the conditions of the Fire Marshal's March 30, 1998 memo shall be met;
5. that the special permit for automobile storage for car rental with the conditions listed herein
is a temporary use and shall expire on December 1, 1999; and
6. that the use and any improvements for the use shall meet all the requirements of the
Uniform Building and Uniform Fire Codes, 1995 Edition, as amended by the City of
Burlingame.

which meet the performance standards of the M-1 zone district (CS 25.44.030 (4)).

interior or exterior alterations involving such things as interior partitions, plumbing, and electrical
conveyances.
Previous Use: Paved area behind Color Copy building
Proposed Use: Automobile Storage for Car Rental Business
Allowable Use: Automobile Storage for Car Rental Business subject to performance standards with a
special permit.
Summary: The applicant, The Hertz Corporation, is requesting a special permit to a11ow starage of
vehicles for their automobile rental business at 1649 Adrian Road, zoned M-1. This application came
to us as a result of a code enforcement action. Hertz Rent A Car is cunently using the space behind the
Color Copy building at 1649 Adrian Road to store overflow vehicles from its operation at the San
Francisco International Airport. This overflow storage primarily occurs between Friday and Sunday,
when there are fewer vehicles rented. The applicant also states that the use of this area is only required
on an interim basis until a new car storage facility at the airport is completed at the end of 1998.
The vehicles will be stored in 58' x 600' (34,800 SF) area behind the Color Copy building as shown
on the site plan date stamped March 25, 1998. This area is not part of the required parking for the
building at 1649 Adrian Road. However, this paved area also provides fire access to the rear of the
building. The Fire Department has indicated that the parked vehicles shall not interfere with Fire
Department access to the building for laddering purposes and shall not interfere with exiting from the
building.
The M-1 zoning district specifies that automobile storage for car rental businesses require a special
permit and must meet the following minimum standards.
1. vehicles shall not be moved during a. m. and p. m. peak hour traffic periods as defined by the
City Engineer;
2. minimum site size of .7 (seven-tenths) acres;
3. area enclosed with an opaque fence eight (8) feet in height at a location approved by the Public
Works Department.
' SPECIAL PERMIT FOR AUTOMOBILE STORAGE FOR CAR RENTAL BUSINESS
1649 Adrran Road
The a.m. peak hour is generally considered to be between 7:00 a.m. and 9:00 a.m. Monday through
Friday, and the p. m. peak hour is between 4:00 p. m. and 6:00 p. m. Monday through Friday. A
condition of approval should be considered that no cars shall be moved between 7:00 a.m. and 9:00 am,
and between 4:00 p. m. and 6:00 p. m. Monday through Friday. The area where the cars are to be stored
consists of approximately 34,800 SF of paved area (0.8 acre), and is enclosed by an 8' high solid fence.
The cars aze stored at this site primarily between Friday morning and Sunday evening. On Fridays, 12
to 15 employees would move up to 210 cars from the Hertz Rent A Car facility at the airport to the site.
On Saturday and Sunday evenings, the 12 - 15 employees would move vehicles back to the airport
facility. The applicant notes that occasionally cars would be moved from the airport facility to the site
on Thursday evenings between 6:00 p.m. and 10:00 p.m., and the cars would be returned to the airport
on Monday mornings.
The applicant has provided a list of the other businesses located in this building. Color Copy Printing
has a total of 232 employees and is open 24 hours a day. Nationwide Mailing has a total of 84
employces and is open from 7:00 a.m. to 11:30 p.m. Three-Day Envelopes has a total of 12 employees
and is open from 8:00 a.m. to 4:30 p.m. Idea Brokers has a total of 10 employees and is open from
8:00 a.m. to 5:00 p.m. There are a total of 212 parking spaces on the site, and 205 parking spaces are
required for the uses which occupy the building. The paved area behind the building is not a part of
the required parking.

Staff Comments: The Fire Marshal notes (March 30, 1998 memo) that: 1) parked vehicles shall not

comments on the project.
