Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301, which states that existing facilities, consisting of the
operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private
structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use
beyond that existing at the time of the lead agency's determination are exempt from environmental review.

Allowable Use: Air courier service, light industrial or manufacturing use, labs, office uses in conjunction
with a permitted use, warehouses, retail sales and display areas in conjunction with a
permitted use and commercial recreation uses are all allowed with a Conditional Use
Permit
Project Description: The applicant, Tez Marble, is requesting a Conditional Use Permit to allow a non-auto
related showroom and warehouse use (tile and marble) at 1601 Adrian Road, zoned RR, Automobile Sales and
Service Overlay Area. Within the Auto Overlay Area, a Conditional Use Permit is required for non-auto related
showroom and warehouse (Code Section 25.44.050 b, 2). The applicant is proposing to use 1,285 SF of
existing office space for office uses, 1,905 SF of existing showroom space for showroom uses, and 16,994 SF of
existing warehouse space for warehouse uses (the existing 3,083 SF mezzanine level will continue to be used
as storage space).
Tez Marble sells tile, marble and granite to retail customers, contractors and other tile outlets and currently has
an existing showroom and warehouse space in Oakland, CA. There will be no manufacturing, fabrication or
product modification conducted on the premises. The proposed business will be open on Monday through
Saturday from 8:30 am to 5:30 pm. Initially, the applicant expects approximately 13 customers per day on
weekdays and 17 customers per day on weekends. Within the next five years, the applicant expects the number
of customers to increase to approximately 21 customers per day on both weekdays and weekends. The number
of employees on site will range from 3 to 5 depending on the time of the day and the day of the week. The
maximum number of people expected on site at any one time for this business, including the owner and
employees, is estimated to be 10 persons.
The existing building has 15 lightly striped, on-site parking spaces in front of the building with access from Adrian
Road. The proposed tile and marble showroom/warehouse use would be replacing an automobile related
showroom/warehouse use. Because there are no changes proposed to the building (interiororexterior), there is
no change proposed to the use breakdown of the building. Therefore, no additional on-site parking is required
for the proposed showroom/warehouse use. All other Zoning Code requirements have been met. The applicant
is requesting the following application:

Staff Comments: See attached memos from the City Engineer, Chief Building Official, Parks Supervisor, Fire
Marshal and NPDES Coordinator. Planning staff would note that because of the nature of the request to use an
existing showroom/warehouse space for a non-auto related showroom/warehouse space with no additional on-
site parking required, it was determined that this request could be brought forward directly as an action item.
Staff would also note that the plans submitted by the applicant are copies of plans for a previous project on the
property that have been slightly modified to reflect the existing and proposed use of the spaces in the building. If
the Commission feels there is a need for more study, this item may be continued with direction to the applicant.
Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning Commission
must find that the following conditions exist on the property (Code Section 25.52.020, a-c):
(a) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or
convenience;
(b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:
1. that the tile and marble showroom/warehouse shall be limited to 1,285 SF of office area, 1,905 SF of
showroom area, 16,994 SF of warehouse area and 3,083 SF of storage area at 1601 Adrian Road, as
shown on the plans submitted to the Planning Division and date stamped February 11, 2011;
2. that the tile and marble showroom/warehouse business may not be open for business except during the
hours of 6:00 a.m. to 9:00 p.m., seven days a week;

3. that the number of people on site at 1601 Adrian Road at any one time, including the owner, employees
and customers shall not exceed 10 persons;
4. that the maximum number of employees, including the business owner, in 1601 Adrian Road shall be
limited to 5 persons;
5. that any changes to the floor area, use, hours of operation, or number of employees which exceeds the
maximums as stated in these conditions shall require an amendment to this conditional use permit; and
6. that any improvements for the use shall meet all California Building and Fire Codes, 2010 Edition, as
amended by the City of Burlingame.

How will the proposed structure or use within the structure affect neighboring properties or structures on those properties? If
neighboring properties will not be affected, state why. Think about traffic, noise, lighting, paving, landscaping sunlighUshade,
views from neighboring properties, ease of maintenance.
W hy will the structure or use within the structure not affect the public's health, safety or general welfare?
Public health includes such things as sanitation (garbage), air quality, discharges into sewer and stormwater systems, water
supply safety, and thing which have the potential to affect public health (i.e., underground storage tanks, storage of chemicals,
situations which encourage the spread of rodents, insects or communicable diseases).
Public safetv. How will the structure or use within the structure affect police or fire protection? W ill alarm systems or sprinklers
be installed? Could the structure or use within the structure create a nuisance or need for police services (i.e., noise, unruly
gatherings, loitering, traffic) or fire services (i.e., storage or use of flammable or hazardous materials, or potentially dangerous
activities like welding, woodwork, engine removal).
General welfare is a catch-all phrase meaning community good. Is the proposal consistent with the city's policy and goals for
conservation and development? Is there a social benefit?
Convenience. How would the proposed structure or use affect public convenience (such as access to or parking for this site or
adjacent sites)? Is the proposal accessible to particular segments of the public such as the elderly or handicapped?
2. How will the proposed use be located and conducted in accordance with the
�urlingame General Plan and Zoning Ordinance?
Ask the Planning Department for the general plan designation and zoning district for the proposed project site. Also, ask for an
explanation of each. Once you have this information, you can compare your proposal with the stated designated use and
zoning, then explain why this proposal would fit accordingly.
3. How will the proposed projecf be compatible with the aesthetics, mass, bulk
and character of the exisfing and potential uses on adjoining properties in the
general vicinify?
How does the proposed structure or use compare aesthetically with existing neighborhood? If it does not affect aesthetics,
state why. If changes to the structure are proposed, was the addition designed to match existing architecture, pattern of
development on adjacent properties in the neighborhood? If a use will affect the way a neighborhood or area looks, such as a
long term airport parking lot, compare your proposal to other uses in the area and explain why it fits.
How does the proposed structure compare to neighboring structures in terms of mass or bulk? If there is no change to the
structure, say so. If a new structure is proposed, compare its size, appearance, orientation, etc. with other structures in the
neighborhood or area.
How will the structure or use within the structure change the character of the neighborhood? Think of character as the image
or tone established by size, density of development and general pattern of land use. W ill there be more traffic or less parking
available resulting from this use? If you don't feel the character of the neighborhood will change, state why.

1.) Tez Marble will have a positive effect on the Public's health, safety and general welfare
occupying 1601 Adrian Road as a retail and wholesale outlet. The facility will only be used as a
showroom and storage facility with a few Offices targeting a small specific Customer base selling
a very select high end product. We will not be doing any manufacturing or fabrication on the
site. By catering to a targeted Customer base, traffic and deliveries will be kept to a minimum.
We are prepared to install the required sprinkler and alarm systems to meet local codes and
protect not only our property, but our neighbor as well.
2.) Tez Marble will add to the continued business growth in the by providing a high end product to
a specific, growing Customer base. We have been in contact with the Burlingame Planning and
Zoning Commission and are well aware of the needs and requirements of the area.
3.) Tez T/larble will add to the beautification of the Adrian Road business district without any
changes made to the existing structure or the surrounding area. Tez Marble will follow the
same guidelines as the surrounding businesses and work to improve Public health, safety and
general welfare.

Dear Administrator:
Tez Marble will be setup to sell and store tile, marble and granite. We will sell to retail Customers,
Contractors and other tile outlets when available. We will operate out of our showroom for Customers
to view the product available, Offices will be set up to handle administrative duties and clerical functions
and the warehouse will be used for storage purposes only. There are plenty of parking spaces on the
pre�mises for Customers, Employees and any deliveries or pickups as needed.
We will not have any manufacturing, fabrication or product modification on the premises. The product
is purchase as is without any modifications or changes. Therefore, we will not change or affect on the
proposed location. We are looking to move in and make use of the proposed site as is.
The proposed site is setup for us to just move in, install alarm and sprinkler system as needed, setup
our showroom and bring product into the warehouse.
We will not be making any changes to the structure or surrounding grounds.

1. The fire sprinkler system shall be re-evaluated for storage.
2. Storage shall not exceed 12 feet in height unless a high piled combustible
storage permit is approved by the Central County Fire Department.
3. Madifications to the fire sprinkler system as a result of floor plan changes shall
not be permitted without obtaining a fire sprinkier permit from the Central
County Fire Department.
4. The building fire sprinklers system shall be maintain a current five year service
tag or provide fire year service by a licensed State Fire Marshal concern prior
to occupancy.

Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution from construction
activities. Project proponent shall ensure all contractors implement Best
Management Practices (BMPs) during construction.
Please include a list of construction stormwater pollution prevention best
management practices (BMPs), as project notes, when submitting plans for a
building permit. Please see attached brochure for guidance. The brochure may also
be down loaded directly from "flowstobay.org." It is recommended that the
construction BMP's be placed on a separate full size plan sheet (2' x 3` or larger as
appropriate) for readability.

RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDITIONAL USE PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
Conditional Use Permit for a non-auto related showroom and warehouse use (tile and Marble)
at 1601 Adrian Road, zoned RR, Automobile Sales and Service Overlav Area De Vincenzi
Metal Products. 1655 Rollins Road, Burlinqame, CA 94010, propertv owner APN� 025-262-350�
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
March 14, 2011, at which time it reviewed and considered the staff report and ali other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is
no substantial evidence that the project set forth above will have a significant effect on
the environment, and categorical exemption, per CEQA Article 19, Section 15301, which
states that existing facilities, consisting of the operation, repair, maintenance, permitting,
leasing, licensing or minor alteration of existing public or private structures, facilities,
mechanical equipment or topographical features, involving negligible or no expansion of
use beyond that existing at the time of the lead agency's determination are exempt from
environmental review.
2. Said Conditional Use Permit is approved subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such Conditional Use Permit are set forth in the staff
report, minutes, and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

1. that the tile and marble showroom/warehouse shall be limited to 1,285 SF of office area,
1,905 SF of showroom area, 16,994 SF of warehouse area and 3,083 SF of storage
area at 1601 Adrian Road, as shown on the plans submitted to the Planning Division and
date stamped February 11, 2011;
2. that the tile and marble showroom/warehouse business may not be open for business
except during the hours of 6:00 a.m. to 9:00 p.m., seven days a week;
3. that the number of people on site at 1601 Adrian Road at any one time, including the
owner, employees and customers shall not exceed 10 persons;
4. that the maximum number of employees, including the business owner, in 1601 Adrian
Road shall be limited to 5 persons;
5. that any changes to the floor area, use, hours of operation, or number of employees
which exceeds the maximums as stated in these conditions shall require an amendment
to this conditional use permit; and
