Applicant: Dogan Tezdogan, Tez Marble Property Owner: De Vincenzi Metal products General Plan: Industrial & Associated Office Use — Auto Row Overlay District APN: 025-262-350 Lot Area: 41,909 SF Zoning: RR Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15301, which states that existing facilities, consisting of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination are exempt from environmental review. Existing Use: Showroom/Warehouse — OTD Cyclesports (automobile sales) Proposed Use: Showroom/Warehouse — Tez Marble (tile and marble) Allowable Use: Air courier service, light industrial or manufacturing use, labs, office uses in conjunction with a permitted use, warehouses, retail sales and display areas in conjunction with a permitted use and commercial recreation uses are all allowed with a Conditional Use Permit Project Description: The applicant, Tez Marble, is requesting a Conditional Use Permit to allow a non-auto related showroom and warehouse use (tile and marble) at 1601 Adrian Road, zoned RR, Automobile Sales and Service Overlay Area. Within the Auto Overlay Area, a Conditional Use Permit is required for non-auto related showroom and warehouse (Code Section 25.44.050 b, 2). The applicant is proposing to use 1,285 SF of existing office space for office uses, 1,905 SF of existing showroom space for showroom uses, and 16,994 SF of existing warehouse space for warehouse uses (the existing 3,083 SF mezzanine level will continue to be used as storage space). Tez Marble sells tile, marble and granite to retail customers, contractors and other tile outlets and currently has an existing showroom and warehouse space in Oakland, CA. There will be no manufacturing, fabrication or product modification conducted on the premises. The proposed business will be open on Monday through Saturday from 8:30 am to 5:30 pm. Initially, the applicant expects approximately 13 customers per day on weekdays and 17 customers per day on weekends. Within the next five years, the applicant expects the number of customers to increase to approximately 21 customers per day on both weekdays and weekends. The number of employees on site will range from 3 to 5 depending on the time of the day and the day of the week. The maximum number of people expected on site at any one time for this business, including the owner and employees, is estimated to be 10 persons. The existing building has 15 lightly striped, on-site parking spaces in front of the building with access from Adrian Road. The proposed tile and marble showroom/warehouse use would be replacing an automobile related showroom/warehouse use. Because there are no changes proposed to the building (interiororexterior), there is no change proposed to the use breakdown of the building. Therefore, no additional on-site parking is required for the proposed showroom/warehouse use. All other Zoning Code requirements have been met. The applicant is requesting the following application: • Conditional Use Permit for a non-auto related showroom and warehouse use (tile and marble) in the Automobile Sales and Service Overlay area of the RR Zone (CS 25.44.050 b, 2). Staff Comments: See attached memos from the City Engineer, Chief Building Official, Parks Supervisor, Fire Marshal and NPDES Coordinator. Planning staff would note that because of the nature of the request to use an existing showroom/warehouse space for a non-auto related showroom/warehouse space with no additional on- site parking required, it was determined that this request could be brought forward directly as an action item. Staff would also note that the plans submitted by the applicant are copies of plans for a previous project on the property that have been slightly modified to reflect the existing and proposed use of the spaces in the building. If the Commission feels there is a need for more study, this item may be continued with direction to the applicant. Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020, a-c): (a) The proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience; (b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: 1. that the tile and marble showroom/warehouse shall be limited to 1,285 SF of office area, 1,905 SF of showroom area, 16,994 SF of warehouse area and 3,083 SF of storage area at 1601 Adrian Road, as shown on the plans submitted to the Planning Division and date stamped February 11, 2011; 2. that the tile and marble showroom/warehouse business may not be open for business except during the hours of 6:00 a.m. to 9:00 p.m., seven days a week; -2- Conditional Use Permit 1601 Adrian Road 3. that the number of people on site at 1601 Adrian Road at any one time, including the owner, employees and customers shall not exceed 10 persons; 4. that the maximum number of employees, including the business owner, in 1601 Adrian Road shall be limited to 5 persons; 5. that any changes to the floor area, use, hours of operation, or number of employees which exceeds the maximums as stated in these conditions shall require an amendment to this conditional use permit; and 6. that any improvements for the use shall meet all California Building and Fire Codes, 2010 Edition, as amended by the City of Burlingame. We are prepared to install the required sprinkler and alarm systems to meet local codes and protect not only our property, but our neighbor as well. 2.)
