The Lorenz was listed in the National Register of Historic Places in January of zoiz. This historic brick hotel, built by Susan Lorenz in i9oz, is the only four-story building remaining from Redding's early development. The $6,000,00o renovation of the building, that now serves as an affordable senior residence, includes new apartment spaces, and kitchens, as well as improving the building's seismic strength and safety. McLaughlin APN: 025-169-120 Property Owner: Donald Spolar Lot Area: 1.95 acres Zoning: RR, Automobile Sales and Service Overlay Area General Plan: Industrial Uses: Industrial & Office Use North Burlingame/Rollins Road Specific Plan — Adrian Road Auto Row District Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15301, which states that existing facilities, consisting of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment ortopographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination are exempt from environmental review. History: On June 28, 1999, the Planning Commission granted this applicant a Conditional Use Permit for a health service use (counseling) at a 1731 Adrian Road, Suite 2, where she shared a space with her husband's import food business (June 28, 1999 P.C. Minutes attached). In her letter dated April 13, 2009, the applicant notes that she and her husband recently moved from that space to 32 Adrian Court, where her husband continued to operate an import food business. The applicant would now like to operate her counseling service from a portion of the office space shared with the import food business at 32 Adrian Court. Project Description: The applicant, Dr. Lizah B. McLaughlin, is requesting a Conditional Use Permit to allow a health service use (counseling service) at 32 Adrian Court, zoned RR, Automobile Sales and Service Overlay Area. Within the Auto Overlay Area, a Conditional Use Permit is required for health services, whose primary �unction is to support businesses in the RR zoning district (Code Section 25.44.030, i). The applicant is proposing to use 220 SF of an existing 836 SF office space within the existing 1,825 SF office/warehouse tenant space; the remainder of the office/warehouse space would be occupied by an existing import business (616 SF office +ggg SF warehouse). Dr. McLaughlin is a licensed marriage family counselor in California and would provide part time counseling services to enhance interpersonal and family relationships. The applicant will also assist clients enrolled in the Employment Assistance Program (EAP); some of these clients may come from the businesses in the surrounding area. EAP offers access to confidential counseling and referral services to assist persons in handling problems related to work, personal relationships, finances, drug and alcohol problems, or other life concerns. The applicant is requesting the following application: ■ Conditional Use Permit for a health service use (counseling) in an existing office/warehouse building, whose primary function is to support businesses in the RR zoning district (CS 25.44.050, b, 2 and 25.44.030, i). The applicant is the only counselor involved in the proposed business and counseling sessions will typically include one patient and sometimes two patients from the same family. Each session is approximately one hour long. The office will be open on two weekdays, from 5:00 p.m. to 6:30 p.m. and Saturday from 10:00 a.m. to 11:00 a.m. or 2:00 p.m. to 3:00 p.m. Initially, the applicant expects iwo patients per day on weekdays and one patient on the weekends. The applicant does not expect an increase in the number of employees or patients in fve years. The maximum number of people expected on site at any one time for this business, including employees, is estimated to be three (counselor and one to two patients). Conditional Use Permit 32 Adrian Court The existing building has 50 on-site parking spaces, three of which are assigned to 32 Adrian Court. The proposed health service use would now be replacing an existing office use. The proposed counseling business is 200 SF and would require 0.88 parking spaces (1:250 SF parking ratio); 0.73 parking spaces are currently required for the existing office use (1:300 SF parking ratio). The difference between the two requirements is 0.15 spaces and is considered to be de minimus. Planning staff would note that because of the nature of the request to use an existing office space for a part time health service use with no additional on-site parking required, it was determined that this request could be brought forward directly as an action item. If the Commission feels there is a need for more study, this item may be continued with direction to the applicant. Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020, a-c): (a) The proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience; (b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. -2- Conditional Use Permit 32 Adrian Court Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should inciude specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: that the counseling service shall be limited to 220 SF at 32 Adrian Court, as shown on the plans submitted to the Planning Division and date stamped April 13, 2009; any increase in the health service use shall require an amendment to the Conditional Use Permit; 2. that the counseling service shall be limited to one counselor and two patients on site at any one time; 3. that any changes to the floor area, use or number of counselors or patients which exceeds the maximums as stated in these conditions shall require an amendment to this Conditional Use Permit; and 4. that any improvements for the use shall meet all California Building and Fire Codes, 2007 Edition, as amended by the City of Burlingame. In our discussions with the Planning Division, I understand that I need to apply for a new Conditional Use Permit for our new address that is Zoned R-R My part time Counseling service would continue to be beneficial to the citizens of Buriingame because I am continuing to give this population an opportunity to improve the quality of their lives by enhancing their interpersonal relationships and family relationships. Since I am also contracted to do EAP (Employment Assistance Program) on a part time basis, the result of my counseling would increase the productivity of the employees that I see and would benefit the general welfare of the community. Box 711, San Mateo, CA 94401 property owner, APN: 025-169-120; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on Mav 11, 2009, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15301, which states that existing facilities, consisting of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination are exempt from environmental review, is hereby approved. 2. Said Conditional Use Permit is approved subject to the conditions set forth in Exhibit "A" attached hereto.
