ORDINANCE 1470. Seconded by Councilwoman O'Mahony, carried
unanimously.
Mayor Pagliaro told about a new law in the city of Davis that
requires residents must plant trees that will cover 40 percent of
any concrete work on a property.
REOUEST FROM COUNTY FOR HOUSING AND HOMELESS FUNDING
City Manager's memo of August 4 reviewed and attached a letter
from County of San Mateo Supervisors requesting support of the
new Family Housing and Homeless Trust Fund. Mayor Pagliaro
recommended council postpone any action on this matter.
SELECTION OF VOTING DELEGATE FOR LEAGUE OF CALIFORNIA CITIES
CONFERENCE IN LOS ANGELES
Mayor Pagliaro said he would try to arrange his schedule to have
a business meeting in LA at the same time so that he could
represent the city at no travel cost to the city.
WATER PENALTY APPEAL - 1445 CABRILLO
City Manager reviewed the Finance Director's memo of August 10
which recommended council consider this request to use "future
intended underuse" to abate an overuse penalty of $357. Anne
Malcolm, 1445 Cabrillo, recently moved into the city and received
her first water bill with a large penalty. She was present and
told council this is her first home and her first garden; she
mentioned the property was vacant for nine months before her
occupancy and had very low water use during that time. Council-
woman O'Mahony suggested council hold the bill in abeyance for
four months while Malcolm attempts to build a bank to cover the
overuse. Councilman Harrison moved to forgive the penalty.
Mayor Pagliaro seconded the motion. After further discussion,
the motion was withdrawn. Councilwoman o�Mahony moved the city
hold the penalty bill for four months while the applicant builds
a bank, at the end of that period any overuse amount not covered
by the bank would still be penalized. Councilwoman Knight was
opposed to forgiving any water penalty. The motion was seconded
by Councilman Harrison, carried 4-1 on roll call vote, Council-
woman Knight voting no.
WELCOME TO BURLI�NGAME SIGN - 101 FREEWAY
City Manager's'memo of August lo recommended council direct staff
regarding the'freeway sign. In 1976 the city executed a$1 per
year lease to place a Welcome to Burlingame sign adjacent to the
freeway at the end of Lang Road. This lease expires in 1996.
The original sign was built by the Chamber of Commerce. Over the
years the sign has fallen into disrepair and the current property
owner, Howard Hickey, has reguested the city either repair the
sign or.remove it. The current sign is in BCDC jurisdiction
which means we can probably maintain the sign but would need a
permit for any substantial improvements. He said Hickey would
probably want a substantial increase in rent if the sign stayed.
Karen Key, Chamber, said the hotel council would meet with the
city about the sign. Howard Hickey was present and said he also
would meet with staff or chamber regarding the sign.

Mayor Pagliaro put this matter over for two months to allow an
�all parties to discuss the future of the freeway sign.
TEPdTATIVE PARCEL MAP FOR SUBDIVISZON OF 2918 ADELINE DRIVE
Public Works Director reviewed his memo of August 11 which
recommended council hear testimony from interested parties and
make a decision. The Planning Commission held a public hearinq
and approved a negative declaration for the project, then the
commission denied the tentative map for the Lands of Fife. This
application is to divide a.90,784 square foot lot into two
parcels, parcel A would be 15,217 square feet and parcel B would
be 75,567 square feet. The proposed access for parcel A would be
across parcel e and the proposed access for parcel B would be the

- property. The existing house would be removed.
Mayor Pagliaro opened the floor to comments. John Hall, 2910
Adeline; Arthur Kluge, 2900 Adeline; Robert Weisberger, 2917
Adeline also speaking for neighbor at 2915; and another neighbor,
spoke in opposition to the subdivision; both parcels would use
driveway at 2910 to access the parcels; all lots on the city side
of Adeline are very large and parcel A would be much smaller;
feared they would build "monster house" on that small lot;
changes in slope could create problems with soil, there has been
settling since the earthquake; there were several errors on map,
particularly having to do with the slope on the existing drive-
way; heavy trucks on Adeline would be dangerous; this would add
another driveway to a dangerous curve; telephone pole is shown as
moved but may not be allowed to move it.
Councilman Harrison agreed with the concerns expressed by the
speakers and by the Planning Commission and their findings; he
moved to uphold the Planning Commission action. Seconded by
Councilwoman O'Mahony. Councilwoman Knight questioned why the
commission approved the negative declaration, it seemed the
project would be detrimental; City Attorney said the negative
declaration speaks to significant effects on the environment.
The motion carried unanimously.

Public.Works memo of July 29 recommended council accept the
completion of the water main improvements at 150 Valdeflor-
es. This was a joint venture between the developers and the
city; wor]G was completed by Manuel C. Jardim at a cost of
$104,808.53,

Park Director's m�mo of August 7 recommended council accept
this project by Suiqmit Springs Design. The total cost of
the project was $11�;.200; a Roberti-Z'Berg grant of $7,840, a
private match by Friends o�% Mills Canyon of $1,120 and city
funds of $2,240 covered e�cpenses.

City Planner's memo of August 12 recommended this ordinance
to clarify nonconforming uses in the zoning code. Hearing
was scheduled for the September 9 meeting. The ordinance
proposes to amend the nonconforming use portion of the code
by adding a section applicable to the R-1 district and

TENTATIVE PARCEL MAP AND NEGATIVE DECLARATION
suB�ECT:LANDS OF FIFE; DEED VOL. 6909 O.R. 94-95;
APN 027-111-050; 2918 ADELINE DRIVE - PM 92-2
RECOMMENDATION:
Council should take action on this mapping request considering the
recommendation of the Planning Commission. Council should either approve
this map with any desired conditions or disapprove this map making such
findings as are appropriate.
Procedure:
The Council is not obligated to hold a public hearing but may do so at
its discretion. Staff has notified those people who spoke at the
Planning Commission public hearing that this item has been placed as a
Staff Report item on this August 17, 1992 agenda. If any substantial
changes are requested by Council, then this mapping action needs to be
referred back to the Planning Commission. (Section 26.24.050)
Conditions:
These conditions were recommended to the Planning Commission and should
be considered for attachment to any tentative map approval:
1.) The subdivider shall deposit into the City of Burlingame Water
Fund, one-half of the estimated cost of a future 6" water main
installation fronting the site. The half-cost would be 62.50/L.F.
x 157 foot frontage or $9812.50.

All conditions of the March 27, 1992 San Mateo County Department
of Public Works memo shall be met. (Attached)
All conditions of the March 3, 1992 Burlingame Fire Department
memo shall be met. (Attached)
The existing house on the proposed lot line shall be removed
prior to recordation of a final map.
5.) The applicant shall enter into a subdividers agreement with the
City complete with bonding. This agreement would require tYiat
within two years of the filing of the map or before the sale of
the lots (whichever occurs first) construction of the driveway
access and parking pads (including grading, fill and retaining
walls) be completed.
6.) All vehicles used for transportation of workers to the site shall
be parked on site and not be allowed to be parked on Adeline Dr.

vehicles shall park on Adeline and shall be attended by a minimum
of two flag men at all times. All construction material shall be
transferred on site the same day it arrives.
All outstanding bills for the checking and processing of this map
application shall be paid in full.
Any conditions the Council may wish to attach relating to the
existing shared driveway with 2910 Adeline.
BACKGROUND:
At their meeting of August 10, 1992, the Planning Commission heid a
public hearing on the proposed subdivision. The attached report was
reviewed by the Commissioners at the meeting.
The applicant, Mr. Fife, and his engineer Mr. Kavanaugh spoke in favor of
this subdivision noting that the project was designed so that no varian-
ces would be required. Several concerned citizens spoke in opposition
noting the narrowness and steepness of Adeline Drive, the construction
traffic and noise which would be generated, the obstruction of views and
the lack of compatibility of this subdivision with the rest of the
neighborhood. There was also a concern with the existing driveway which
is shared with 2910 Adeline. (P.C. Minutes, August 10, 1992)
A motion was made to approve the Negative Declaration and was approved on
a 5-0-2 roll call vote. A motion to recommend denial of the Tentative
Map was approved 5-0-2 on a roll call vote. Commission found that the
proposed Parcel "A" being 15,000 square feet was not compatible with the
existing parcels on the Burlingame side of Adeline.
