Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15303 (e), which states that construction and location of limited
numbers of new, small facilities or structures including accessory (appurtenant) structures including garages,
carports, patios, swimming pools and fences is exempt from environmental review.
Project Description: The property has an existing two- story and a half story house with attached garage and a
pool and spa in the backyard. The applicant is proposing to build a new patio structure at the right side of the
rear yard. The proposed accessory structure will have a 48-foot setback from the rear property line and a 7-foot
setback from the right side property line. The proposed patio shelter is 540 SF (13'-6" w x 40'-0" 1) and will
enclose an existing fireplace and have a new BBQ area and a pizza oven. There are no other existing or
proposed accessory structures on the property.
The applicant is requesting Conditional Use Permits for a patio shelter that is more than 120 SF (540 SF
proposed) and for a plate height that is more than 9 feet from adjacent grade (10'-0" plate height proposed from
grade at the left side of the structure). A Special Permit is requested for an accessory structure with a dimension
that is more than 28 feet (40 feet length is proposed).
The proposed structure will have a standing seam metal roof with a ridge that is pitched on both sides from ridge
to plate. Existing natural grade decreases from the right to the left side of the structure by approximately 1 foot.
The overall height of the proposed structure is 15 feet measured from lowest adjacent grade to the ridge.
Per C.S. 25.26070(e) the maximum single-family residential house size is 8,000 SF, excluding accessory
structures. With this application, the floor area for the main dwelling on the property will not change (7,827
SF/0.29 existing FAR). The total on -site floor area, including the proposed accessory structure, will increase to
8,367 SF (0.31 FAR). (This figure is for reference purposes, as the accessory structure is excluded from floor
total area.)
The applicant is requesting the following applications:
■ Conditional Use Permit for a patio shelter that is more than 120 SF in area (540 SF proposed) (CS
25.60.010 (n)); and
■ Conditional Use Permit for accessory structure with a plate height greater than 9 feet (10 feet proposed)
(CS 25.60.010 (g)); and
■ Special Permit for accessory structure exceeding 28'-0" in length (40 feet length proposed) (CS
25.26.035 (e)).

Staff Comments: Planning staff would note that since this request for Conditional Use Permits and a Special
Permits does not require design review or hillside area construction permits and does not include any increase in
to the main dwelling, the application was placed directly on the action calendar. If the Commission feels there is
a need for more discussion, this item may be placed on a future action calendar for a second review and/or
public hearing with direction to the applicant.

Required Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning
Commission must find that the following conditions exist on the property (Code Section 25.52.020, a-c):
(a) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or
convenience;
(b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the

aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Findings for a Special Permit: In order to grant a Special Permit, the Planning Commission must find that the
following conditions exist on the property (Code Section 25.51.020 a-d):
(a) The blend of mass, scale and dominant structural characteristics of the new construction or addition are
consistent with the existing structure's design and with the existing street and neighborhood;
(b) the variety of roof line, facade, exterior finish materials and elevations of the proposed new structure or
addition are consistent with the existing structure, street and neighborhood;
(c) the proposed project is consistent with the residential design guidelines adopted by the city; and
(d) removal of any trees located within the footprint of any new structure or addition is necessary and is
consistentwith the city's reforestation requirements, and the mitigation forthe removal that is proposed is
appropriate.
Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped
November 4, 2014, sheets One and Two and that any changes to footprint, floor area, or envelope of the
accessory structure shall require an amendment to this permit;
2. that if the accessory structure is demolished or the envelope changed at a later date the Conditional Use
Permits and Special Permit, as well as any other exceptions to the code granted here, will become void;
3. that the conditions of the Building Division's June 30 and November 6, 2014 memos, the Engineering
Division's July 18, 2014 memo, the Fire Division's July 1, 2014 memo, the Parks Division's July 1, 2014
memo and the Stormwater Division's July 8 and November 7, 2014 memos shall be met;
4. that any grading or earth moving on the site shall not occur until a building permit has been issued and
such site work shall be required to comply with all the regulations of the Bay Area Air Quality
Management District;
5. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit; and
6. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2013
Edition, as amended by the City of Burlingame.

1. Explain why the proposed use at the proposed location will not be detrimental
or injurious to property or improvements in the vicinity or to public health,
safety, general welfare or convenience.
How will the proposed structure or use within the structure affect neighboring properties or structures on those properties? If
neighboring properties will not be affected, state why. Think about traffic, noise, lighting, paving, landscaping sunlight/shade,
views from neighboring properties, ease of maintenance.
Why will the structure or use within the structure not affect the public's health, safety or general welfare?
Public health includes such things as sanitation (garbage), air quality, discharges into sewer and stormwater systems, water
supply safety, and thing which have the potential to affect public health (i.e., underground storage tanks, storage of chemicals,
situations which encourage the spread of rodents, insects or communicable diseases).
Public safety. How will the structure or use within the structure affect police or fire protection? Will alarm systems or sprinklers
be installed? Could the structure or use within the structure create a nuisance or need for police services (i.e., noise, unruly
gatherings, loitering, traffic) or fire services (i.e., storage or use of flammable or hazardous materials, or potentially dangerous
activities like welding, woodwork, engine removal).
General welfare is a catch-all phrase meaning community good. Is the proposal consistent with the city's policy and goals for
conservation and development? Is there a social benefit?
Convenience. How would the proposed structure or use affect public convenience (such as access to or parking for this site or
adjacent sites)? Is the proposal accessible to particular segments of the public such as the elderly or handicapped?
2. How will the proposed use be located and conducted in accordance with the
Burlingame General Plan and Zoning Ordinance?
Ask the Planning Department for the general plan designation and zoning district for the proposed project site. Also, ask for an
explanation of each. Once you have this information, you can compare your proposal with the stated designated use and
zoning, then explain why this proposal would fit accordingly.
3. How will the proposed project be compatible with the aesthetics, mass, bulk
and character of the existing and potential uses on adjoining properties in the
general vicinity?
How does the proposed structure or use compare aesthetically with existing neighborhood? If it does not affect aesthetics,
state why. If changes to the structure are proposed, was the addition designed to match existing architecture, pattern of
development on adjacent properties in the neighborhood? If a use will affect the way a neighborhood or area looks, such as a
long term airport parking lot, compare your proposal to other uses in the area and explain why it fits.
How does the proposed structure compare to neighboring structures in terms of mass or bulk? If there is no change to the
structure, say so. If a new structure is proposed, compare its size, appearance, orientation, etc_ with other structures in the
neighborhood or area.
How will the structure or use within the structure change the character of the neighborhood? Think of character as the image
or tone established by size, density of development and general pattern of land use. Will there be more traffic or less parking
available resulting from this use? If you don't feel the character of the neighborhood will change, state why.
How will the proposed project be compatible with existing and potential uses in the general vicinity? Compare your project with
existing uses. State why you feel your project is consistent with other uses in the vicinity, and/or state why your project would
be consistent with potential uses in the vicinity.

The proposed structure will not be for every day use. It will generally be used in the summer months to
provide shade and an area for food preparation. The structure will provide an out door gathering area
for family and friends as it has in the past. The patio exists and the structure will be added to bring a
cohesive element to the area.
2. How will the proposed use be located and conducted in accordance with the
Burlingame General Plan and Zoning Ordinance?
The project is in line for development as stated in the General Plan. The plate height at one end will be
9'-8" at one end and 4'-9" at the other for an average plate height of 7'-3" where 9'-0" is the allowable.
The plate height at the interior of the structure will be 8'-6" There will be no visual or any other impact
on neighboring properties.
3. How will the proposed project be compatible with the aesthetics, mass, bulk and
character of the existing and potential uses on adjoining properties in the general
vicinity?
The proposed project is in line with lot coverage and F.A.R. requirements as indicated by the Municipal
Code. Please note that the structure observes the 7' side setback although approx 75% of the structure
falls in the rear 30% of the lot where a zero side setback would apply. The structure is in line with the
mass and scale of the existing house and the neighboring properties. -The existing bamboo screening is
solid and works to separate the existing patio from the neighboring property. The structure will
actually serve to reduce sound transmission.

The new structure is in scale with the existing house and neighboring properties. The parcels in the area
are relatively large and the accessory structure will not crowd the site in any way. The intent of the 28'
dimension was meant for standard lots in the range of 6006-10000 sq ft.
2. Explain how the variety of roof line, facade, exterior finish materials and elevations
of the proposed new structure or addition are consistent with the existing structure,
street and neighborhood.
The roof line will consistent in slope with the existing house. The stucco exterior finish and color will
match the house. Also note that the adjacent side properties are not in the incorporated City of
Burlingame and fall within County of San Mateo guidelines.
3. How will the proposed project be consistent with the residential design guidelines
adopted by the city (C,S. 25.57)?
The proposed structure will be consistent with the Design Guidelines established by keeping in scale
with the property, existing structures, landscaping and adjacent properties.
4. Explain how the removal of any trees located within the footprint of any new
structure or addition is necessary and is consistent with the city's reforestation
requirements. What mitigation is proposed for the removal of any trees? Explain,
why this mitigation is appropriate.
No trees will be removed for this project. Future planting, and maturation of existing landscaping will
also help in blending the structure with the site.

NOTE: A condition of this project approval is that the Demolition Permit will
not be issued and, and no work can begin (including the removal of an
building components), until a Building Permit has been issued for the
project. The property owner is responsible for assuring that no work is
authorized or performed.
9) Show the distances from all exterior walls to property lines or to assumed
property lines

Copper from Buildings May Harm Aquatic Life
Copper can harm aquatic life in San Francisco Bay. Water that comes
into contact with architectural copper may contribute to impacts,
especially during installation, cleaning, treating, or washing. Patination
solutions that are used to obtain the desired shade of green or brown
typically contain acids. After treatment, when the copper is rinsed to
remove these acids, the rinse water is a source of pollutants.
Municipalities prohibit discharges to the storm drain of water used in the
installation, cleaning, treating and washing of architectural copper.

Use Best Management Practices (BMPs)
The following Best Management Practices (BMPs) must be implemented to prevent prohibited
discharges to storm drains.
During Installation
• If possible, purchase copper materials that have been pre-patinated at the factory.
• If patination is done on -site, implement one or more of the following BMPs:
o Discharge the rinse water to landscaping. Ensure that the
rinse water does not flow to the street or storm drain.
Block off storm drain inlet if needed.
o Collect rinse water in a tank and pump to the sanitary
sewer. Contact your local sanitary sewer agency before
discharging to the sanitary sewer.
o Collect the rinse water in a tank and haul off -site for
proper disposal.
• Consider coating the copper materials with an impervious
coating that prevents further corrosion and runoff. This will
also maintain the desired color for a longer time, requiring
less maintenance.
Storm drain inlet is blocked to prevent
prohibited discharge. The water must be
pumped and disposed of properly.
During Maintenance
Implement the following BMPs during routine maintenance activities, such as power washing the roof,
re-patination or re -application of impervious coating:
• Block storm drain inlets as needed to prevent runoff from entering storm drains.
• Discharge the wash water to landscaping or to the sanitary sewer (with permission from the local
sanitary sewer agency). If this is not an option, haul the wash water off -site for proper disposal.
Protect the Bay/Ocean and yourself!
If you are responsible for a discharge to the storm drain of non-
stormwater generated by installing, cleaning, treating or washing
copper architectural features, you are in violation of the municipal
stormwater ordinance and may be subject to a fine.

RESOLVED, by the Planning Commission of the City of Burlingame that
WHEREAS, a Categorical Exemption has been prepared and application has been made for
Conditional Use Permits and a Special Permit for an accessory structure at 2838 Adeline Drive, Zoned
R-1, Michael Gaul, property owner, APN: 027-091-080;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
November 24, 2014, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that
On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this Commission, it is hereby found that there is no substantial evidence
that the project set forth above will have a significant effect on the environment, and categorical
exemption, per CEQA Section 15303 (e), which states that construction and location of limited
numbers of new, small facilities or structures including accessory (appurtenant) structures
including garages, carports, patios, swimming pools and fences is exempt from environmental
review, is hereby approved.
2. Said Conditional Use Permits and Special Permit are approved subject to the conditions set
