Summary: The applicant is requesting to add one master bath to the
second floor and enlarge the garage on the first floor (174 SF) to
create a three bedroom, 2z bath house (2,459 SF Total). The
existing house is two stories with three bedrooms, 1? baths and
attached garage (2,285 SF). The new two story addition will
continue the line of the existing two story wall, which is located
approximately 3�-0" from the side property line. The code allows
a 4'-0" side setback for this size lot. (Note, this proposed
construction was not treated as a minor modification since the 3'-
0" side setback is for a two story addition. A minor modification
would be allowed for a first story addition with a 3'-0" side
setback.)
The new construction will enlarge the existing one car garage from
19'-8" in length to 28'-4" X 10'-0" wide. The existing and
remodeled house requires one covered and one uncovered parking
space. The existing house provides one covered and two uncovered
spaces. The driveway is approximately 10' wide X 50' long. All
other zoning code requirements have been met.

Staff comments: The Fire Marshal and Chief Building Official had
no comments (March 17, 1993 memo and March 22, 1993 memo). The
City Engineer notes (March 22, 1993 memo that the site survey shows
a 2.91' side setback at the southern corner of the existing house.
If the new construction continues this line the house will be
closer than 3'-0" to the property line. This will require a
different type of construction than shown. He recommends holding
the new construction at 3'-0" from the property line. A condition
of approval has been added to ensure that the new construction
meets the 3'-0" side setback proposed.
Required Findinqs for Variance: In order to grant a variance the
Planning Commission must find that the following conditions exist
on the property (Code Section 25.54.020 a-d):
(a) there are exceptional or extraordinary circumstances or
conditions applicable to the property involved that do not
apply generally to property in the same district;
(b) the granting of the application is necessary for the preserva-
tion and enjoyment of a substantial property right of the
applicant, and to prevent unreasonable property loss or
unnecessary hardship;
(c) the granting of the application will not be detrimental or
injurious to property or improvements in the vicinity and will
not be detrimental to the public health, safety, general
welfare or convenience;
(d) that the use of the property will be compatible with the
aesthetics, mass, bulk and character of existing and
potential uses of properties in the general vicinity.
Planninq Commission Action: The Planning Commission should hold a
public hearing. Action should include findings; and the reasons
for any action should be clearly stated for the record. At the
public hearing the following condition should be considered:
Conditions:
1. that the addition as built shall conform to the plans
submitted to the Planning Department and date stamped March
17, 1993 Sheet T-1 Topographic Map and Boundary Survey, Sheet
1- Proposed Floor Plan, Sheet 2- Existing Elevations, Sheet
3- Existing Floor Plan, and Sheet 4- Proposed Elevations;
2. that the conditions of the City Engineers' March 22, 1993 memo
shall be met;
3. that any new construction as built shall be a minimum of 3'-0"
from the property line and foundation forming verified with a
site survey before the foundation is poured and inspected by
the Building Department; and

4. that the project shall meet all the requirements of the
Uniform Building and Uniform Fire Codes as amended by the City
of Burlingame.

In order to approve an application for a variance, the���;�}����, j.
Commission is required to make findings (Code Section 25.54.020
a-d). Please answer the following questions as they apply to
your property and application request to show how the findings
can be made. A letter may also be submitted if you need
additional space or if you wish to provide additional information ,..
for the Planning Commission to consider in their review of your �
application. Please write neatly in ink or type.
a. Describe the exceptional or extraordinary circumstances or .
conditions applicable to your property which do not apply to
other properties in the area.
The building on this property was built approximately 50
years ago. It was built three feet from the western
property line. This building now'lies one foot in the side
yard setback. This condition is the reason for this variance
application.
b. Explain why the application request is necessary for the
preservation and enjoyment of a substantial property right
and what unreasonable property loss or unnecessary hardship
might result from the denial of the application.
The applicant is asking for permission to extend the house
at the rear west side. The addition is along the side of
the building that is in the setback. If the applicant
obtains the variance, the addition to this property will
blend in very naturaliy to the existing structure. If this
request is denied, there will be a permanent one foot of-fset
in the walls and roo-F requiring an additional hip and valley
in the roofline.. These eyesores wili exist for the life of
the building, indicating that this addition may have been an
afterthought.
c. Explain why the granting of the application will not be
detrimental or injurious to property or improvements in the
vicinity and will not be detrimental to the public health,
safety, general welfare or convenience..
This pro�ect will not be detrimental to this or adja�ent
properties. The only lot affected will be that on the West -
side. This lot will see the addition of the house as a
natural expansion of a building that is already in the
setback. This addition can be approved by the building
department whether or not the one foot setback variance is
approved. The neighbors will either see a nice structure
that looks like it was always there or an ugly one foot
offset reminding them that the house was built piecemeal.
d.� Discuss how the proposed use of the property will be
compatible with the aesthetics, mass, bulk and character of
existing and potential uses of properties in the general
vicinity .
The propose'ti use has not changed. The addition will only
add 90 square feet to the -Footprint of this house. I-F this
variance is authorized, the aestheti�s of the nouse will be
greatly improved, thereby improving the looks of the
neighborhood and the town of Burlingame.

The CITY OF BIIRLINGAME PLANNING COMMISSION announces the
