SUBJECT: DESIGN CHANGES IN THE ARC WAY CONDOMINIUMS, 1500 WILLOW AVENUE
On September 22, 1980 the Planning Commission considered an application by George
Rescalvo* for an 18 unit condominium, 35' high, at the corner of Willow Avenue and
El Camino Real. At the conclusion of the hearing, the permit was approved on
unanimous roll call vote with three conditions:
1. that the final working drawings for the Arc Way Condominiums be consistent
with the plans filed with this application;
2. that before the condominium plans and necessary maps be sent to Council,
the following information, changes or requirements be met to the satisfaction
of the City Engineer:
- show all proposed utilities and meter connection to existing services;
show electrical and telephone to be installed underground with no
additional utility poles to be added;
- show new survey information prepared by Mr. Baca on the condominium
site plan; indicate approximate proposed site grades for comment by
City staff;
- show how the existing drop inlet connects to the two 27" V. C. P.
drain lines;
- show driveway grade and profile to meet City requirements and approval;
- remove existing driveways along E1 Camino Real;
- indicate roof drainage in front through under-sidewalk drains;
all other drainage by gravity where possible;
- City datum to be indicated and all floor elevations to be shown;
and
3. that the final landscaping and irrigation plans be approved by the Park
Department prior to the issuance of a building permit.
A building permit was subsequently issued for the foundation and basement parking to
allow excavation and construction to start before the winter rains. During this
period, however, the new project owner reevaluated the floor plans for the condominium
units and decided to apply for an amendment to Condition No. 1. The March 5, 1981
letter from Zev Ben-Simon, together with the architectural plans date stamped March 16,
1981, confirm that the proposed changes are interior changes only**.

the preliminary design was completed by Mr. Rescalvo (but immediately prior to the
September 22, 1980 public hearing), the project was sold to Zev Ben-Simon of Gilco
Construction Company.
**Setbacks, sideyards, building height and all other significant zoning criteria are
identical to the 1980 design. However, window sizes, balcony dimensions and other
minor exterior changes have been made to complement the redesign of the interior walls.

Given the consistency of the new plans to the 1980 design (numbers of dwelling units,
numbers of bedrooms, numbers of parking spaces, building height, setbacks, lot coverage,
etc. are all the same), staff has no objection to the requested amendment. The
only problem which has been noted is that the slope of the basement driveway (shown
as 20% on Rescalvo's plans) now averages 26% in the "as built" condition; the City
Engineer's March 19 memo provides an explanation of this change, and recommends two
additional conditions to the Condominium Permit.
If, at the conclusion of the March 23 hearing, the Commission finds that the interior
changes requested by Gilco Construction are both reasonable and consistent with the
1980 permit, then the following conditions are recommended:
1. that the final working drawings for the Arc Way Condominiums be consistent
with the amended plans date stamped P�arch 16, 1981;
2. that the conditions recorrrnended by the September 17, 1980 and March 19, 1981
memos from the City Engineer be met to the satisfaction of the Public Works
Department; and
3. that the final landscaping and irrigation plans be approved by the Park
Department prior to the issuance of a building permit.

CP Yost reviewed this request to allow design changes in the floer plans of the final
working drawinqs for this project. Reference staff report dated 3/20/81; September 22,
1980 Planning Commission minutes approv�ing the pro,ject; March 5, 1981 letter from Zev
Ben-Simon, the ne��J project o�•rner; memo from the City Engineer received f�larch 29, 1981;
Septeinber 17, 1980 memo from the City Engineer; and amended architecturai plans date
star�ped f1arch 16, 1981. CP discussed the conditions of the 19�0 permit, progress to date,
the CE's concern about the drive!vay slope (two additional cor.ditions of approval
recor;mended), and the recent request by th'e ne:�� project owner. Staff had no objection
to approval with three condiiions as listed in the staff report.
Discussion: the 26°o driveGaay slope as opposed to the 20% indicated on the original plans;
staff requirement for modification of the ramp to nrovide marimum feasible access.
Zev 6en-Simon discussed the minor interior changes requested as well as atiempts to
attain a reasonable drive�-day slope. Chm. Sine opened the public hearing. There were
no comments and the hearing v�as closed. It was determined all significant zoning criteria
are identical to the 1980 plans.
C. Jacobs moved to allow amendment of the September 22, 1980 condominium permit with
the followin�7 conditions: (1) that the final working drawings for the Arc Way Condominiums
be consistent with the amended plans date stamped P1arch 16, 1981; (2) that the conditions
reco����»ended by the September 17, 1980 and March 19, 1981 memos from the City Engineer
be met to the satisfaction of the Public Works Department; and (3) that the final
landscaping and irrigation plans be apr�roved by the Park Department prior to the
issuance of a building permit. Second C. Cistulli; motion approved on a 6-0 roll call

The attached amended Tentative Subdivision Map has been reviewed and it
conforms to the amended Condominium Permit Plans. Minor conditions as
indicated below should be attached to any map approvals.
It is recommended that the Commission transmit the attached Tentative
Subdivision Map to Council for approval, subject to any Commission re-
quired changes to units and air spaces and subject to the following:
1. That the current owner agree to pay all map processing and
City review costs for the previous map and the amended map.
2. That the Tentative Map include by reference, the architectural
plans submitted by the current owner and received by the Planning
Department on March 16, 1981.

Re: Amendment of September 22, 1980 Condominium Permit
1500 Willow Avenue
In review of the revised set of Plans, it is apparent that the majority of the
requested changes are in the living area floors 1,2 and 3. Staff has no ob-
jections to these changes.
In the review of the Plans and the more detailed design data presented by the
applicant, it is apparent that the driveway to the lower level parking exceeds
the 20% maximum that may be approved by staff. This ramp area was erroneously
shown at a 20% grade on the original condominium Permit Plans upon which the
current Permit was issued and foundation and slab was constructed. The new
submittal has included an additional detailed driveway ramp profile. This de-
tailed profile still needs some transition modifications. It is clear, however,
that the average slope between the two sides of the ramp should be approximately
26% at the maximum on any revised details.
Should the Commission grant this condominium Permit, the following conditions of
approval should be attached:
1. That a registered Civil Engineer submit a design complete with pro-
file showing the replacement of curb and gutter fronting this property.
Design to be approved by the Public Works Department prior to any drive-
way ramp installation on-site.
2. That either a registered Civil Engineer or Architect present to the
City a detailed design profile for the driveway, showing detailed
transitions; said profile to be approved by the Public Works Department
based on the Civil Engineer's street profile. Minimum elevation of
the high point of driveway to be approximately six inches (6") above
the top of curb to provide additional storm drainage protection.
