Request: Hillside Area Construction Permit and Special Permit for construction of an accessory
structure. Two Speciafl pernuts are required for storage which will exceed ten percent of the gross floor

window 9' from the rear property line where 10' is the minimum distance allowed (CS 25.60.010 (I)
and (1), and 25.61).

Summary: Gail Friedman-Beck, property owner and applicant, is requesting a hillside area construction
permit and two special permits to build an accessory structure for storage at 2735 Summit Drive, zoned
R-1. The proposeci storage structure would be located 8'-0" from the rear property line and 16'-0° from
the right side property line. The storage area would be 288 SF (12' x 24"). The existing main dwelling
structure is 2389.5 SF. Special permits are required for storage area which exceeds ten percent of the
main dwelling structure (288 SF where 238.9 SF is the maximum allowed), and for a window within
ten feet of the property line (9'-0" from the rear property line, where 10'-0" is the minimum distance).
The proposed accessory structure will be used to store extra household furniture. There is electrical
service but no plumbing proposed in the new structure. 1fie storage shed has lap siding painted to match
the residence, and has a shingle roof. There is a door and two 3'-0" x 3'-0" windows on the front of
the structure and a 6'-0" wide sliding door on the side facing the interior of the lot. It was noted on a
site inspection that there is also a 1'-0" x 2'-0" window with frosted glass on the opposite side facing
the side property line, This window is locaterl9'-0" from the rear property line. A special permit is
required for a window 9'-0" from a property line, where 10'-0" is the minimum distance.
The property owner submitted building plans for review estimating the square footage of the existing
house as 3000 SF. Based upon this information, planning staff approved the plans of the storage shed
as being less than 10% of the gross floor area of the main dwelling, and building permits were issued.
During construction of the storage shed, a neighbor called the building department because the storage

shEd appeared to be larger than the code would allow. Planning and building staff inspected the site and
determined that the main dwelling was closer to 2500 SF. The property owner was informed of the
need for a special permit and submitted this application.

Study Meeting Questions: At the February 10, 1997 study meeting, the commission asked if a home
occupation permit is required since the applicant is storing inventory for his sales business. A home
occupation permit is generally required when a resident is conducting a business in their home. A
permit is not required for storage of materials, unless they are shipped from this site as a part of the
business being done elsewhere (C.S. 25.68.010 (b)).
The commission also asked what utilities are going to be provided within the storage structure.
Electricity is the only utility to be extended to the structure. There will be one light fixture in the center
of the ceiling, and one light fixture outside next to the sliding glass door. There will be four electrical
outlets along the baseboards. The commission commented that on site the windows look bigger than
3' x 3'. Staff did a site inspection and measured the windows. They are each 3'-0" x 3'-0", surrounded
by wood trim.
The commission ask�d why the storage structure needs a 6' door, a 3' door and two windows. The
applicant states that �he 6' door is needed to move the furniture to be stored into the building. The
applicant also states that the glass doors and windows provide light so that electricity use will be lower.
The commission also asked if the building will be sheet rocked on the inside. The applicant states that
it is not planned at this time, but she may eventually choose to install sheet rock to reduce the moisture
in the storage structure and to prevent the furniture from mildewing.
The commission noted that there is a small window about 1' x 2' in the wall opposite the sliding glass
door which looks much like a bathroom window and dces not appear on the plans. On a site inspection,
staff noted that there is a window in this wall, it is not shown on the plans date stamped January 23,
1997, and that it is �ocated 9'-0" from the rear property line. A special permit is required for this
window, since it is closer than 10'-0" from a property line. The applicant states that the window was
installed to provide additional light into the storage room. Frosted glass was installed to provide privacy
both within the structure and to the adjoining neighbor, who had expressed concern regarding the
location of the window.
The commission asked what is the reason for the paving on the right side of the house, up to the double
gates and to the graveled area. The applicant states that the paving was done previously to allow for
additional parldng in tront of the house and to provide access through the double gates to the back yard
for garden equipment. The gravel was installed behind the gate to provide a dog run. The applicant
has submitted the attached letter dated February 17, 1997 which responds to the commissioners'
questions.
Required Findings for a Hillside Area Construction Permit:
Review of a hillside area construction permit by the Planning Commission shall be based upon
obstruction by constxuction of the existing distant views of nearby properties. Emphasis shall be give
to the obstruction of distant views from habitable areas within a dwelling unit (Code Sec. 25.61.060).
Required Findings for a Special Permit:
In order to grant a Sgecial Permit the Planning Commission must find that the following conditions exist
on the property (Co�ie Section 25.52.020 a-c):

(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame
general plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems
necessary to secure the purposes of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of existing and potential uses on
adjoining properties in the general vicinity.
Planning Commiscion Action: The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution and should include findings. The reasons for any action should be
clearly stated. At the public hearing the following conditions should be considered:
Conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department and
date stamped January 23, 1997, Site Plan, Floor Plan and Building Elevations (11" x 17");
2. that the plate line of the accessory structure shall be not more than eight (8) feet above grade,
as measured from adjacent grade;
3. that the accessory structure shall never be used for accessory living or sleeping purposes, shall
never include a kitchen or sleeping area and shall not be used for any home occupation use
as defined in C.S. 25.68.010 without an amendment to this special permit; and
4. that the accessory stnicture shall meet all the requirements of the municipal code and of the 1995
edition California Building and Fire Codes as amended by the City of Burlingame.

To The Burlingame Planning Commission:
This statement is being made regarding the request for a Special Permit for a Storage Shed built at
the Residence of Mrs. Gail B. Friedman Beck, 2735 Summit Dr., Burlingame, CA 94010.
The Circumstances are as foliows:
After the San Mateo County Fair this past suiruner of 1996, my husband's son and daughter-in-law
purchased a shed from a company they saw at the show-grounds called Shed Co. Their business is
to install storage type buildings which have a very similar appearance to the basic structure of
many af die homes in the Bay Area. We took a look at theirs and were surprised to find how nice
looking it was and well 6uilt for tlie price. Since our marriage the precedu�g January, we had been
struggling wifll the probletn of tcx� many possessions as this is a second mamage for each of us. Ui
addition to this problem, my husband's job requires that lte "warehouse" his sales materials at his
}�ome so that he can access tl�em readily fvr iiis sales cails. `Therefore it had c�ecome apparent that
we needed extra storage space. We looked into ihe idea of renting one of the storage facifities, but
in comparing the cost tnonthly with tiie cost of buildv�g a shed frotn Shed Co, we realized the deal
was too good to pass up. So instead of gerting an aluminum shed or plastic one which we had also
looked at; or rent a space, we decided to have one built.
The ne� decision was where to place it, which was already decided by the very fact that an area ui
the back yard had been m�used for all 21 years I have been living here except for when my childre��
were very young and loved to piay on the upper patio and build forts etc.. This was an ideal
location because ii is basically flat and removed from the rest of tlie yard and house except for a
stairway I had redone after the house was refnodeled 'v� 199 t-92. Fortunately my lot is rather large
for Burlingame as most of these parcels are in the I-Iills. Thereiare even though I added what may
have seemed like a fairiy good sized addition to my home ui 1991-92 the lot coverage is far from
reaching the maximum allowed by the City of Burlingame.
We decided on the size due to our rather excessive storage needs. The reason we wanted to keep
the possessions listed next has to do with the fact that between us we have 3 growii children who
are not yet iu their own homes and I inherited some nice furnishings from my elderly Aunt. So, the
list was die real clvicl�er for us, which is as follows:

Needless to say, we were very pleased with the prospect of the desirable quate we received from
Shed Co for the additional space. And we had estimated that the house was about 3,000 sq. ft.
because of the recent quotes for the roof which needs to be replaced. So we went ahead witli the
building.
We received our pei�nit from the City and followed it to the letter, including making some changes
which were not required but just suggestions; to assure us of the durability of the flooring aud
structure overall. The City required the shed to be built to the code of any additional room on a
house, so we are told. At no time did we hesitate to folloiv dieir code. We were surprised by some
of the changes the City kept makuig but our Contractor complied at all titnes. We were
unfortunately forced to replace the flooruig at an additional expense due to the weather and delays
we have endured u� the makuig of ttiese changes. However we are pleased with the appearance, the
location and the fact that we have maintauied the privacy we have always had froin and for our
neighbors.
And naw we would like ta make it clear that the storage shed only exceeds tlie Cities' Code by
1.2% which is hard to detect due to the oversized lot, where it is located and the additional rooms
added that enlarged the hause. The house is under the estimated sq. footage and is mare accueate(y
surveyetl at 2,567 sq. ft. In this case we must seek a Special Permit from your commission. We
are hoping you will be able to give us the permit for which we have applied.

I am writing to respond to the Commission's questions regarding my request for
a special permit foa- a newly constructed shed on my property. In my previous
statement to the Commission I explained the purpose for the starage shed and
explained that there will not be any utilities other than electricity necessary for
this out building. I gave permission to the planning department to come onto my
property to inspect and measur� the windows which are 3' x 3' as stated in the
plan. However, upon this inspection while 1 was at work, it was noted that the
small 1' x 2' window, which by the way, is frosted to prevent anyone from looking
into or out of the shed from this back wall, was possibly 1 foot too close to the
back property iine. That being 9' rather than 10'. This is a possibility, but not
necessarily a fact. The measurement of the back property line needs to be done
by us and our eontractor to verify this fact. We have at all times tried to stay to
code as stated before in my initial statements to you. This was not an intentional
error and may in fact not be one at all.
In addition, you are now putting questions to me regarding my driveway and side
yard. I will explain each willingly, however it does not seem to be necessary,
since the special permit is only for the part of the code relating to the 10%
requirement. The reason for the paving on the right side is to allow my daughter
or son to leave their car off the drive through area when we have company and
then keep that area free for us to park off the street since there is little or no
space available in the neighborhood. My neighbor below, Marjary Yates is not
willing to accomodate any cars which are not belonging to her family or visitors
when we have an overflow. As we looked around the area, of Summit Dr., we
saw several �omes with similar parking arrangements and thought it would be a
good way to accomodate all the vehicles which we have when we have family
and friends visiting. By the way, it works out just fine and we can feel
comfortable in that we are not bothering our neighbors above us or below us
with our cars. As far as the side yard is concerned, when we put in the lawn the
young man who did that work suggested we just ciean up the old shrubbery and
old planters which were falling apart and put in gravel down to clean it up. We
were also looking for a possible space to contain a dog because my step-son's
dog was in need of more space. Unfortunately, the dog took ill and died. So, we
do not need to have the area made into a dog run. The gravel has cleaned up
this side of ttie yard which we rarely spend time in due to its location on the lot
and the unattractiveness of the view.
To respond to your question regarding the 6' door is easy. Since we have such a
large amount of household furnishings to store we felt we needed some ease of
access in and out of the shed. So, the door was an extra since the doors that
come with the shed are 2 112'. This also allows for more light to enter this space
so that we didn't need more than the one light �xture which will be installed in
the ceiling of the shed.
If at some time in the future we feel that the contents of the shed are not
insulated from the dampness of the winters enough, then we will possibly install
sheet rock, but I did not request this with my original permit because the space
witl not be inhabited. If you require a speciat permit for sheet rocking this space,
we will notify you a$ the time. So, please let us know if this will become an issue
in the future so we can be prepared.
As to the home occupation permit, I have no idea of what your restxictions are
regarding the sales materials that my husband will be able to keep in the shed.
You will have to inform us as to the requirements and we will be sure that we do
not exceed any limits or rulings since we do no want to pay for any more special
permits.
I hope this answers all of your questions and concerns. I am loaking foward to a
resolution of the issue on Monday, February 24, 1997.

SPECIAL PERMITS AND HILLSIDE AREA CONSTRUCTION PERI�ZIT
RESOLVED, by the Planning Commission of the City of Burlingame that:

WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
February 24, 1997 , at whic9� time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
l. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption Class
15303, construction and location of new, small facilities or structures -(e) accessory (appurtenant)
structures including garages, carports, patios, swimming pools and fences is hereby approved.
2. Said special permits and Hillside Area Construction Permit is approved, subject to the
conditions set forth in Exhibit "A" attached hereto. Findings for such special permits and Hillside Area
Construction Permit �re as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

Conditions of approval categorical exemption, special permits and hillside area construction permit
2735 SUMMIT DRIVE
effective MARCH 3, 1997
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped January 23, 1997, Site Plan, Floor Plan and Building Elevations (11" x
17"
);
2. that the plate line of the accessory structure shall be not more than eight (8) feet above grade
as measured from adjacent grade;
3. that the accessory structure shall never be used for accessory living or sleeping purposes,
shall never include a kitchen or sleeping area and shall not be used for any home occupation
use as defined in C.S. 25.68.010 without an amendment to this special permit; and
4. that the accessory structure shall meet all the requirements of the municipal code and of the
1995 edition California Building and Fire Codes as amended by the City of Burlingame.
