Dear Ms. Beck,
Since there was no appeal to or suspension by the City Council, the February 24, 1997 Planning
Commission approval of your Special Permits and Hillside Area Construction Permit for an
accessory structure became effective March 3, 1997. This application was to allow an accessory
structure which exceeds ten percent of the gross floor area of the main dwelling structure, and
`^r a window 9' from the property line where 10' is the minimum distance at 2735 Summit
Drive, zoned R-1.
The February 24, 1997 minutes of the Planning Commission state your application was approved
with the following conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department and
date stampec� January 23, 1997, Site Plan, Floor Plan and Building Elevations (11" x 17")
with the exception that the window 9' from property line (not shown on the plans) shall be
opaque and shall be no larger than 1' x 2";;
2. that the plate line of the accessory structure shall be not more than eight (8) feet, one (1) inch
above the finished floor;
3. that the accessory structure shall never be used for accessory living or sleeping purposes,
sha11 never include a kitchen or sleeping area and shall not be used for recreational purposes
or any home occupation use as defined in C.S. 25.68.010 without an amendment to this
special permit; and
4. that the accessory structure shall meet all the requirements of the municipal code and of the
1995 edition California Building and Fire Codes as amended by the City of Burlingame.

All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be
issued. One extension of up to one year may be considered by the Planning Commission if
application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil
Procedure Section 1094.6. If you wish to challenge the decision in a court of competent
jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is
required pursuant to state or federal law.
