Reference staff report dated 9/18/80; Project Application & CEQA Assessment accepted
by staff 8J25/�0; aerial photoqraph, site development layout and site dravrings;
August 13, 19�0 letter from Steve G. Gardner; September 12, 19�0 memo from the Chief
Building Inspector; September 4, 1980 memo from the Chief Fire Inspector; 9/8/80 .
memo from the City Engineer; and July 28, 1980 letter to Steve Gardner from the 7_oning
Aide, with copy of Business License Application. CP.discussed the P�1-1 District neighbor-
hood, this building in particular and P1r. Gardner's plans. Staff believed this business
would be an inappropriate use at its present location and recommended denial. If
Commission found it a reasonable use, six conditiors �•rere recommended as listed in
the siaff report.
The applicant, Steve Gardner, was present. He described his repair business'which
consists of component repair work, with no vehicles on the site at any time except
for his personal automobile. He questioned Fire Department requirement that the �
building be brought to fi-4 occupancy regulations. Discussion: clarification of the
exact nature of this business; the type and present useage of the building ai 1745 Adrian
Road. It was suggested there be further discussion betG,�een staff and the Fire Department
regarding occupanry requirements, and it was noted the business must be approved by
the Fire Department in the business license application process. Chm. Sine opened the
public hearing. There were no comrneni:s and ihe hearing was closed.
C. Jacobs moved for approval of this special permit with the following conditions:
(1} that the permit be approved to Steve G. Gardner dba Gardner's 4-4dheel Drive, and
be nontransferable; (2) that the permit be approved for vehicle component repairs
only; (3) that no vehicles be brought to the site; (4) that no persons be employed
on this site by Gardner's 4- Wheel Drive; (5) that the hour-s of operation be limited
to tveekday evenings 6:00 - 9:00 P.ht. and weekends; (6) that all Fire and 6uilding Code
requirements be satisfied; and (7) that this perr�it be subject to review and possible
amendment in one year. Second C. Cistulli; approved 6-0 on roll call vote. Appeal
procedures were advised<

Because we have not yet received PG & E approval for
the garage encroachment within their easement, and also have
not received copies from the Title Company of the law suit
settlement regarding title to the 10' strip within subject Map,
I hereby request that City consideration of the subject Parcel
Map be postponed unti 1 those documents can be provided.

was then made by C. Jacobs for approval and recommendation to the City Council of this '

This will confirm our recent conversation regarding the
ten-foot strip adjacent to the above pro�erty. As I stated,
that strip does contain a water line and a sewer line serving
the Muirheads and others. I agree with you that the City
does not own the fee title, but sim�ly easement rights for
our facilities. I checked the Assessor's �Iap and the Assessor's
Roll, and it would appear that the ten-foot strip is assessed
to no one. The Muirhead's property is shown as the fifty-foot
lot, not including the easement strip.
You asked if you mioht prepare a quitclaim deed to remove
the City's interest subject to any existing easements. It is
my preference that we be included in any cuiet title judgment
rather than pursuing the separate quitclaim deed. Thus at
the time the action is pursued I would be Dleased to stipulate
that the City does not have any'interest in the �roperty but
simply claims the right to maintain and replace the sewer and
water facilities which are in the subject area.
