the structures before the addition, or 2,500 square feet, whichever is less.
Summary: The existing single-story house with an attached garage is located in the hillside area and
contains 2,181 SF (0.18 FAR) of floor area and three bedrooms. The applicant is proposing an
approximately 162 SF addition to the front and 764 SF to the rear of the existing structure. With the
proposed project, the floor area will increase to 3,107 SF (0.26 FAR) where 4,929 SF (0.41 FAR) is the
maximum allowed. Since the new addition will have a plate height of 10'-0" in the expanded living/dining
area and 11'-0" on the front porch, design review is required. The proposed house will be 1,822 SF below
the maximum allowed FAR.
With the proposed project, the number of bedrooms in the house will increase from three to four. Two
parking spaces, one covered (10' x 20') and one uncovered (9' x 20') are required. The existing attached
garage (17'-10" W x 20'-6" L) and existing driveway will meet the parking requirements. A Hillside Area
Construction Permit is required for construction at this location. All Zoning Code requirements have been
met. The following applications are required:
• Design Review for a single family dwelling addition having a plate height greater than nine feet above
finished floor (CS 25.57.010, a, 2);
• Hillside Area Construction Permit for an addition to an existing structure (CS 25.62.020); and

Staff Comments: Please see attached. Staff notes that, prior to the June 9`h Planning Commission
hearing, the applicant constructed story poles and had them certified by a licensed surveyor. Since June,
the applicant has revised the story poles to reflect the hipped roofline. Staff determined that a revised
certification letter was not required.
Design Review Study Meeting: At the Planning Commission design review study meeting on May 27,
2008, the Commission complimented the design and asked that the applicant add clarity to the plans
regarding the double front porch columns, the window material, and the window trim. The Commission
placed this item on the Consent Calendar at a time when the plans had been revised as directed (May 27,
2008 Planning Commission Minutes). The architect submitted a response letter on June 3, 2008, and
made hand-drawn revisions to existing Sheets A1, A4, and A5 (date-stamped May 14, 2008) to reflect the
changes.
Action Hearing: At the Planning Commission meeting on June 9, 2008, the project was pulled off the
Consent Calendar for discussion (June 9, 2008 Planning Commission Minutes). Comments from the
Planning Commission and members of the public included discussions of view blockage, primary and
secondary views, and the construction of the story poles. The project was continued to the June 23, 2008
Planning Commission meeting.
On June 12, 2008, the applicant requested the hearing be further postponed until revised drawings could
be prepared. The architect submitted revised drawings on July 14, 2008. The property owner submitted a
response letter on August 1, 2008, and the architect submitted a response letter on August 5, 2008
(response letters dated August 1, 2008 and August 5, 2008).
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by
the Council on April 20, 1998 are outlined as follows:
1. Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Required Findings for Hillside Area Construction Permit: Review of a Hillside Area Construction Permit
by the Planning Commission shall be based upon obstruction by construction of the existing distant views
of nearby properties. Emphasis shall be given to the obstruction of distant views from habitable areas
within a dwelling unit (Code Sec. 25.61.060).

Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be by resolution and include findings made for design review, hillside area construction
permit, and special permit. The reasons for any action should be clearly stated. At the public hearing the
following conditions should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Division date
stamped July 14, 2008 sheets A1 through A7 and L1, and that any changes to building materials,
exterior finishes, footprint or floor area of the building shall require an amendment to this permit;
2. that the conditions of the Chief Building Official's March 18 and May 13, 2008 memos, the City
Engineer's March 24, 2008 memo, the Fire Marshal's March 20, 2008 memo, and the NPDES
Coordinator's March 19, 2008 memo shall be met;
3. that demolition or removal of the existing structures and any grading or earth moving on the site
shall not occur until a building permit has been issued and such site work shall be required to
comply with all the regulations of the Bay Area Air Quality Management District;
4. that any changes to the size or envelope of the basement, first or second floors, or garage, which
would include adding or enlarging a dormer(s), moving or changing windows and architectural
features or changing the roof height or pitch, shall be subject to Planning Commission review;
5. that prior to issuance of a building permit for construction of the project, the project construction
plans shall be modified to include a cover sheet listing all conditions of approval adopted by the
Planning Commission, or City Council on appeal; which shall remain a part of all sets of approved
plans throughout the construction process. Compliance with all conditions of approval is required;
the conditions of approval shall not be modified or changed without the approval of the Planning
Commission, or City Council on appeal;
6. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that these
venting details shall be included and approved in the construction plans before a Building permit is
issued;
7. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance
which requires affected demolition, new construction and alteration projects to submit a Waste
Reduction plan and meet recycling requirements; any partial or full demolition of a structure,
interior or exterior, shall require a demolition permit;
8. that the project shall meet all the requirements of the California Building and Uniform Fire Codes,
2007 Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS
PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION:
9. that prior to scheduling the framing inspection the project architect or residential designer, or
another architect or residential design professional, shall provide an architectural certification that
the architectural details shown in the approved design which should be evident at framing, such as
window locations and bays, are built as shown on the approved plans; architectural certification
documenting framing compliance with approved design shall be submitted to the Building Division
before the final framing inspection shall be scheduled;
10. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the
roof ridge and provide certification of that height to the Building Department; and

11. that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built
according to the approved Planning and Building plans.

During the last Planning Commission hearing, the subject of view blockage was discussed. It
was argued on behalf of the homeowners at 2524 Valdivia that the proposed addition will block the
bay views from their backyard patio and from inside their front living room. It was described as an
issue of fairness to preserve these views. Members of the Planning Commission commented that
there is no guarantee to preserve secondary views but in the interest of fairness, it was decided that a
continuance be granted for further examination of this issue.
The owners agreed that changes should be made that would benefit the neighbors and
preserve their views as much as possible. The solution that best achieves this is to change all the
front gable roofs, including the garage, to hip roofs. The kitchen roof line that caused the most
blockage now slopes back at a 4/12 pitch, 14'-0" back from its original starting point. A chimney
currently obstructing some of the view will also be removed. All of these changes leave the
neighbor's primary view unobstructed.
The roof at the rear addition was also lowered approximately 4" by changing to a truss roof.
This has been accurately represented on the drawings and the story poles. Unfortunately, no credible
design change will allow us to lower this roof any further. The roof pitch cannot be lowered any
more and neighboring trees mostly blocks the view.
We are pleased with these changes as they have enhanced the Architectural integrity of our
design and befitted the neighbors. Maintaining good relations is a priority for both the Livingstons
and Philip families and we feel that this has been achieved.

This letter provides background information on the remodel project at 2520 Valdivia Way.

`�'e have been working on this redesign of our California ranch for nearly rivo years. Our architect, Robert
Ngedan, will attest that with each set of drawings he presented-12 to date—we took into account the impact
on our neighbors. This remodel has been as modest as we could make it and still include the upgrades we
would like; the proposed additions fall well short of what the lot size can support. Early on, we had
considered building the master bedroom over the garage or as a second story on the present bedroom wing,
but such structures would have caused far greater blockage of the neighbor's primary view and were quickly
rejected. We even vetoed a plan to move the house closer to the western property line to gain floor space.
Iinmediately after the Planning Commission meeting of June 9, we asked Mr. Medan, to see what he could do
to make the roof lines more aceeptable to our uphill neighbor. We initiated this request for modifications
even though Mr. Philip had told us before the meeting that he was agreeable to our project as originally
�resented, information apparently unavailable to the attorney who spoke for the Philip's that evening.
To that end, and after discussions with the neighbor's architects, on July 14 Mr. Medan submitted new plans,
which he will address in a separate letter, that significantly change the roof lines and leave the Philip's
primary view unobstructed. The new hip roof on the garage and the elimination of the chimney on the east
wall should add to their existing view.
We have tried especially hard to find a solution to the problem of the Philip's secondary view from their patio,
one that would still aIllow us the additional space we need. We looked at lowering the roof line of the addition
as much as a foot, lowering the pitch of the roof, turning the addition's ridge line 90 degrees, and/or changing
the rear gable to a hip roo£ None of these changes improved the neighbor's view and, in Mr. Medan's
�pinion, were not architecturally sound. It didn't seem reasonable to pursue these ungraceful options in order
to preserve a tiny wedge of bay view that the Philip's six-foot fence obscures. The Philip's retain lovely
views from the upper portion of their yard.
According to a neighborhood real estate agent we consulted, upper Ray Park is holding its value very well
despite the housing downturn elsewhere, and that includes homes with no views at all. The Philip's, whose
magnificent view from their living room will now be unchanged, can expect to see their property's value
increase at the same rate as other homes in Ray Park.
We are not insensitive to the view issue. When my parents and I moved into this home more than 50 years
ago, the view stretched from Mt. Tamalpais, the towers of the Golden Gate Bridge, San Bruno Mountain, the
Bay Bridge, Berkeley's campanile, and the East Bay hills south to Mt. Diablo. Over the years, we have
watched indigenous and planted trees—none by us—steadily eclipse these Bay Area landmarks. We miss the
views but have valued good relations with our neighbors more. Sadly, much of the view under contention
today will eventually disappear because of the new hospital and tree growth.
Like my father, �vho �vas once dubbed the "�nayor of Ray Park," we hope to live out our days in this beautiful
area, with enough space to enjoy visits from family, fi-iends, and grandchildren.

report, reviewed criteria and staff comments. Eleven (11) conditions were suggested for consideration.

applicant.
■ The neighbor's impacted views are secondary views, not from primary living space within the
residence.
• The neighbors removed the glass patio door from their master bedroom and closed up that space
with a stucco wall. They also replaced a four-foot fence with a six-foot fence; the new fence blocks
the view when seated in the patio area.
■ Spoke to Mr. Philip yesterday and was told that his representative would not be speaking this
evening.
Commission comments:
■ Seems that the height difference between existing and proposed is roughly 11-inches (applicant -
actually 12-14 inches); the story poles seem to show a greater height than proposed on the plans
(applicant - story poles are accurate, based upon 2" x 8" rafters, but could be 2" x 4", which would
reduce height).
■ There is a false ceiling in the living room; could it be altered to reduce impact (applicant - needed to
use the current design to resolve roof lines adequately); Did architect look at roofline options to
reduce its height?
■ Views from the outdoor area should not be considered as "primar�' views.
■ Encouraged use of 2" x 4" construction to reduce height impacts.
Public comments:
Stephen Wilson, 500 Sansome Street, San Francisco, attorney for Brian Philip, neighbor at 2524 Valdivia
Way; and Pat Giorni, 1445 Balboa Avenue spoke:
■ The Philips have not had an adequate opportunity to consider alternative solutions given that story
poles only recently were installed.
■ While no one is guaranteed a view, it is an important ameniry; agrees that the views are secondary,
but are a significant secondary view.
■ Concerned with uncertainty about where the roofline will actually be when constructed.
■ Philip is willing to spend his own money to identify alternatives for consideration.
■ Recommend a postponement for two meetings to provide the neighbor an opportunity to review
alternatives.
■ Asked if this the second or third time that this item has been reviewed by the Commission; if it is the
second time, then perhaps there hasn't been enough opportunity by the neighbor to review the
proposal.

Would be important to have all Commissioners view the property and the view impacts in advance of
action regarding the proposal.

We represent Brian Philip and Bridget Marchetti Philip, owners of 2524 Valdivia Vlray,
whose home abuts the applicant on the West. We wriTe to call your attention to an apparent
procedural irregularity in the calendaring of this matter for June 9, and separately a request to
liave the matter taken off the consent calendaa� and regularly agendized for hearing. For the
reasons described below, we ask that this be re-agendized for your first meeting in July. We
intend to appear and speak on behalf of the Philip farnily because, as their previous
correspondence to you indicates, they had long plann.ed to be out to the country on a family
matter (wedding of a relative) and it was irnpossible for them to personally appear at a June
hearing. The applicant wiil not suffer any discemable prejudice by the rescheduling.
I call your attention to the staff report. This report indicates at page 2, under "Design
Review Study Meeting" that at the design review study meeting held on May 27, a decision was
made to place this item on the consent calendar. Two irregularities having to do with this
decision have deprived Mr. and Mrs. Philip of their due process rights. The first is that they
received no notification of the design review study ineeting. Had they received notification, they
would have attended and given their input. Second, the story poles were not erected until after
May 27 and therefore after the City had already made its decision (absent my clients' input) to
put this approval on an accelerated tracic However, even if Mr. and Mrs. Philip had given
approval on May 27, they would not have been fairly apprised of the results of the appiication
without the story poles.
Your decisions plainly put the cart before the harse and the combination of these two
events certainly deprived the Phitips family of reasonable notice and an opportunity to be heard.

I am in receipt of your letter on behalf of you client, erian Philip, requesting removal of the proposed project for
2510 Valdivia Way from the Burlinqame Planning Commission's June 9, 2008 agenda and that the matter be re-
scheduled for consideration for the first Commission meeting in July.
In your correspondence you allege that a"procedural irregularity" exists that lead to the placement of the
proposed project on the Commission's June 9th agenda. I assure you that all required procedures have been
complied with in the processing of this matter. Please note that consideration of the proposal by the Planning
Commission was duly noticed in advance of the Commission's review of the proposal at its May 27t�' Design
Review Study Session. Additionally, notice was provided in accordance with the City's regulations in advance of
the upcoming June 9rh meeting. The City of eurlingame uses ownership information and contact information from
the County of San Mateo's property ownership database for preparation of noticing materials. The County's
records indicate thot your dient's mailing address is 1440 Valdivia Way, Burlingame. Our records indicate that
notices have been mailed to that address. A review of our file has revealed that a notice was recently returned,
noting that the forwarding order from your client has expired. In addition to mailed notice, the Planning
Commission's procedures call for a posting of the proposed development site with notice of a pending action in
advance of both the Planning Commission's design review study session and the agenda on which the matter is
slated for action. This procedure has also been complied with in this instance. 1 encourage you to advise your
client to contact the County of San Mateo to ensure that their contact information is corrected. it is my opinion
that no ' procedura! irregularity" exists, and that the matter has been properly noticed for the upcoming agenda
(and past agendasJ.
Once an item has been properly noticed for the Commission's agenda, it must appear on that agenda. The
Community Development Department cannot remove the item from the agenda at this point in time. However, a
copy of your correspondence is being forwarded to the Planning Commission for their consideration as part of the
public hearing on the project. I anticipate that the matter will be pulled from the Consent Calendar and moved to
the Regular Action Calendar at Monday's meeting. However, it is ultimately the Commission's decision regarding
your request for a continuance of this matter to a future date. Please note that an earlier e-mail message from
your client (attachedJ was forwarded to the Planning Commission to permit each member the opportunity to
contact Mr. Philip to arrange a visit to his property in advance of Monday's public hearing. In Mr. Philip's obsence,
I encourage you, or another representative to attend the meeting to represent your client's position. In the event
that the Commission ultimately chooses to take action regarding the project application, all actions of the
Planning Commission are appealable to the City Council within ten (10J calendar days following the Commission's
action. Any appea! must be accompanied by a$280.00 appeal fee. Commission actions from the June 9th
meeting will be appealable through 5 p.m. on Thursday, June 19, 2008.

by the building official, such building or structure shall be made in its entirety to conform with the
requirements for new buildings or structures." This building must comply with the 2007 California
Building Code for new structures.
6) Due to the extensive nature of this construction project the Certificate of Occupancy will
be rescinded once construction begins. A new Certificate of Occupancy will be issued
after the project has been finaled. No occripancy of the building is to occur until a new
Certificate of Occupancy has been issued.
�7) Show the distances from all exterior walls to property lines or to assumed property lines
�8) Show the dimensions to adjacent structures.
9) Provide a complete demolition plan that indicates the existing walls, walls to be demolished, new
walls, and a legend. NOTE: The Demolition Permit will not be issued until a Building Permit
is issued for the project.
10) Comply with the 2005 California Energy Efficiency Standards for low-rise residential / non-

11) Obtain a survey of the property lines for any structure within one foot of the property line.
.� 12) On the plans specify that the roof eaves will not project within two feet of the property line.
13) Provide details on the plans which show that all roof projections will be constructed of one-hour
fire-resistance-rated construction per CBC 704.2.
�14) Indicate on the plans that exterior bearing walls less than five feet from the property line will be
built of one-hour fire-rated construction. (Table 602)

15) On the plans show that all openings in exterior walls, both protected and unprotected, will comply
with Table 704.8. Provide a table or chart that specifies 1) the openings allowed and; 2) the size
and percentage of the openings proposed.
,�16) Rooms that can be used for sleeping purposes must have at least one window or door that
complies with the egress requirements. Specify the size and location of all required egress
windows on the elevation drawings.
17) Provide guardrails at all landings. NOTE: All landings more than 30" in height at any point are
considered in calculating the allowable floor area. Consult the Planning Department for details if
your project entails landings more than 30" in height.
18) Provide handrails at all stairs where there are four or more risers.
19) Provide lighting at all exterior landings.
20) The fireplace chimney must terminate at least two feet higher than any portion of the building
within ten feet. Sec. 2113.9
21) NOTE: A written response to the items noted here and plans that specifically address —
items 1, 7, 8, 12, 14, and 16 must be re-submitted before this project can move forward for
Planning Commission action.

Summary: The existing single-story house with an attached garage is located in the hillside area and
contains 2,181 SF (0.18 FAR) of floor area and three bedrooms. The applicant is proposing an
approximately 162 SF addition to the front and 764 SF to the rear of the existing structure. With the
proposed project, the floor area will increase to 3,107 SF (0.26 FAR) where 4,929 SF (0.41 FAR) is the
maximum allowed. Since the new addition will have a plate height of 10'-0" in the expanded living/dining
area and 11'-0" on the front porch, design review is required. The proposed house will be 1,822 SF below
the maximum allowed FAR.
With the proposed project, the number of bedrooms in the house will increase from three to four. Two
parking spaces, one covered (10' x 20') and one uncovered (9' x 20') are required. The existing attached
garage (17'-10" W x 20'-6" L) and existing driveway will meet the parking requirements. A Hillside Area
Construction Permit is required for construction at this location. All Zoning Code requirements have been

Design Review Study Meeting: At the Planning Commission design review study meeting on May 27,
2008, the Commission complimented the design and asked that the applicant add clarity to the plans
regarding the double front porch columns, the window material, and the window trim. The Commission
placed this item on the Consent Calendar at a time when the plans had been revised as directed (May 27,
2008 Planning Commission Minutes). The architect submitted a response letter on June 3, 2008, and
made hand-drawn revisions to existing Sheets A1, A4, and A5 (date-stamped May 14, 2008) to reflect the
changes. Listed below are the Commission's suggestions and responses by the applicant.
1. Clarify fhat double front porch columns will be installed on front (double 6x6s), similar to design
at rear.
The architect notes that the front and rear columns have been revised to reflect the double 6x6
configuration (response letter date-stamped June 3, 2008, and Sheets A1 and A4 date-stamped
May 14, 2008).
2. Clarify thaf windows will be simulated, true divided light, mefa/ clad design.
• The architect notes that the windows will be metal clad simulated divided lite windows (response
letter date-stamped June 3, 2008, and Sheet A5, front elevation, date-stamped May 14, 2008).
3. Clarify wood trim over windows.
• The architect notes that the trim over the windows will be wood 2x10s (response letter date-
stamped June 3, 2008, and Sheet A5, front elevation, date-stamped May 14, 2008).
4. Insfall sfory po/es.
• Story poles have been installed and the architect will provide a story pole certification letter in
advance of the public hearing.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by
the Council on April 20, 1998 are outlined as follows:
Compatibiliry of the architectural sryle with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;

4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Findings: Based on the revisions to the plans and on the findings stated in the attached minutes of the
Planning Commission's May 27 2008, design review study meeting, that the design is thoughtful and
modest, the project is found to be compatible with the requirements of the City's five design review
guidelines.
Required Findings for Hillside Area Construction Permit: Review of a Hillside Area Construction Permit
by the Planning Commission shall be based upon obstruction by construction of the existing distant views
of nearby properties. Emphasis shall be given to the obstruction of distant views from habitable areas
within a dwelling unit (Code Sec. 25.61.060).
Findings for Hillside Area Construction Permit: Based on the design of the addition as a single-story
elerr�ent and on the findings stated in the attached minutes of the Planning Commission's May 27, 2008,
design review study meeting, the project is found to be compatible with hillside area construction permit
criteria listed above.
Plar�ning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be by resolution and include findings made for design review, hillside area construction
permit, and special permit. The reasons for any action should be clearly stated. At the public hearing the
following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Division date
stamped May 14, 2008 sheets A1 through A7 and L1, and that any changes to building materials,
exterior finishes, footprint or floor area of the building shall require an amendment to this permit;
2. that the conditions of the Chief Building Official's March 18 and May 13, 2008 memos, the City

2) Anyone who is doing business in the City must have a current City of Burlingame business
license.
3) Provide fully dimensioned plans.
4) Provide existing and proposed elevations.
5) This project will be considered a New Building because, according to the City of Burlingame
Municipal code, "when additions, aiterations or repairs within any twelve-month period exceed
fifty percent of the current replacement value of an existing building or structure, as determined
by the building official, such building or structure shall be made in its entirety to conform with the
requirements for new buildings or structures." This building must comply with the 2007 California
Building Code for new structures.
6) Due to the extensive nature of this construction project the Certificate of Occupancy will

residential buildings. Go to http://www.enerqv.ca.qov/title24 for publications and details.
11) Obtain a survey of the property lines for any structure within one foot of the property line.
.� 12) On the plans specify that the roof eaves will not project within two feet of the property line.
13) Provide details on the plans which show that all roof projections will be constructed of one-hour
fire-resistance-rated construction per CBC 704.2.
�14) Indicate on the plans that exterior bearing walls less than five feet from the property line will be
built of one-hour fire-rated construction. (Table 602)
15) On the plans show that all openings in exterior walls, both protected and unprotected, will comply
with Table 704.8. Provide a table or chart that specifies 1) the openings allowed and; 2) the size
and percentage of the openings proposed.
,�16) Rooms that can be used for sleeping purposes must have at least one window or door that
complies with the egress requirements. Specify the size and location of all required egress
windows on the elevation drawings.
17) Provide guardrails at all landings. NOTE: Ail landings more than 30" in height at any point are
considered in calculating the allowable floor area. Consult the Planning Department for details if
your project entails landings more than 30" in height.
18) Provide handrails at all stairs where there are four or more risers.
19) Provide lighting at all exterior landings.
20) The fireplace chimney must terminate at least two feet higher than any portion of the building
within ten feet. Sec. 2113.9
21) NOTE: A written response to the items noted here and plans that specifically address�
items 1, 7, 8, 12, 14, and 16 must be re-submitted before this project can move forward for
Planning Commission action.

WHEREAS, a categorical exemption has been proposed and application has been made for

amendment to this permit;

the City Engineer's March 24, 2008 memo, the Fire Marshal's March 20, 2008 memo,
and the NPDES Coordinator's March 19, 2008 memo shall be met;
3. that demolition or removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shail
be required to comply with all the regulations of the Bay Area Air Quality Management
District;
4. that any changes to the size or envelope of the basement, first or second floors, or
garage, which would include adding or enlarging a dormer(s), moving or changing
windows and architectural features or changing the roof height or pitch, shall be subject
to Planning Commission review;
5. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of
approval adopted by the Planning Commission, or City Council on appeal; which shall
remain a part of all sets of approved plans throughout the construction process.
Compliance with all conditions of approval is required; the conditions of approval shall
not be modified or changed without the approval of the Planning Commission, or City
Council on appeal;
6. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a
single termination and installed on the portions of the roof not visible from the street; and
that these venting details shall be included and approved in the consiruction pians
before a Building permit is issued;
7. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects
to submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
8. that the project shall meet all the requirements of the California Building and Uniform
Fire Codes, 2007 Edition, as amended by the City of Burlingame;

Summary: The existing single-story house with an attached garage is located in the hillside area and
contains 2,181 SF (0.18 FAR) of floor area and three bedrooms. The applicant is proposing an
approximately 162 SF addition to the front and 764 SF to the rear of the existing structure. With the
proposed project, the floor area will increase to 3,107 SF (0.26 FAR) where 4,929 SF (0.41 FAR) is the
maximum allowed. Since the new addition will have a plate height of 10'-0" in the expanded living/dining
area and 11'-0" on the front porch, design review is required. The proposed house will be 1,822 SF below
the maximum allowed FAR.
With the proposed project, the number of bedrooms in the house will increase from three to four. Two
parking spaces, one covered (10' x 20') and one uncovered (9' x 20') are required. The existing attached
garage (17'-10" W x 20'-6" L) and existing driveway will meet the parking requirements. A Hillside Area
Construction Permit is required for construction at this location. All Zoning Code requirements have been
met. The following applications are required:

" 1) On the plans specify that this project will comply with the 2007 California Building Codes (CBC).
2) Anyone who is doing business in the City must have a current City of Burlingame business
license.
3) Provide fully dimensioned plans.
4) Provide existing and proposed elevations.
5) This project will be considered a New Building because, according to the City of Burlingame
Municipal code, "when additions, alterations or repairs within any twelve-month period exceed
fifty percent of the current replacement value of an existing building or structure, as determined
by the building official, such building or structure shall be made in its entirety to conform with the
requirements for new buildings or structures." This building must comply with the 2007 California
Building Code for new structures.
6) Due to the extensive nature of this construction project the Certificate of Occupancy will
be rescinded once construction begins. A new Certificate of Occupancy will be issued
aner ihe project has been finaled. No occ�ipancy of the building is io occur until a new
Certificate of Occupancy has been issued.
�7) Show the distances from all exterior walls to property lines or to assumed property lines
�8) Show the dimensions to adjacent structures.
9) Provide a complete demolition plan that indicates the existing walls, walls to be demolished, new
walls, and a legend. NOTE: The Demolition Permit will not be issued until a Building Permit
is issued for the project.
10) Comply with the 2005 California Energy Efficiency Standards for low-rise residential / non-

11) Obtain a survey of the property lines for any structure within one foot of the property line.

13) Provide details on the plans which show that all roof projections will be constructed of one-hour

�16) Rooms that can be used for sleeping purposes must have at least one window or door that
complies with the egress requirements. Specify the size and location of all required egress
windows on the elevation drawings.
17) Provide guardrails at all landings. NOTE: All landings more than 30" in height at any point are
considered in calculating the allowable floor area. Consult the Planning Department for details if
your project entails landings more than 30" in height.
18) Provide handrails at all stairs where there are four or more risers.
19) Provide lighting at all exterior landings.
20) The fireplace chimney must terminate at least two feet higher than any portion of the building
within ten feet. Sec. 2113.9
21) NOTE: A written response to the items noted here and plans that specifically address'�
items 1, 7, 8, 12, 14, and 16 must be re-submitted before this project can move forward for
Planning Commission action.
