The proposed addition will create a new two story house with 4,008 square feet of living area, 539 square feet of garage, and 105 square feet of covered porch for a total of 4652 square feet. A family room, kitchen, dining room, living room, library, bedroom and bath with an attached two car garage is proposed at the first floor level; and three bedrooms, three baths, den, and laundry room are proposed on the second floor level. The proposed residence meets all other zoning code requirements. Staff Review City staff have reviewed this application and the Fire Marshal and Chief Building Inspector had no comments. The City Engineer had no comments on the hillside area construction permit, but indicated a number of items missing from the application for a building permit. A site property line survey will be required. The dimensions to adjacent property driveways will need to be determined before the final driveway as shown may be located. The location of the creek and its bank will need to be verified and shown on the plans. He questioned whether any street trees are located in front of the property and if any will be removed. ApAlicant's Letter The applicant notes in their special permit application of December 28. 1990, that the existing house is too small and is built into the side setback with no available uncovered parking available on the short driveway. The applicant proposes to extensively remodel and add to this residence with a house under the allowable lot coverage (26.30); 3.5' under the allowable height; and the new house will not block any distant views. The new design incorpo- rates many of the existing features of the existing house, including hip roofs, covered front porch, and brick veneer creating a style that is compatible witl� the neighborhood. The applicant further notes in their letter of January 24, 1991 that they have included the following in their design to meet current code requirements: the west wall of the existing house will , 2 be moved six feet to meet the current setback requirements of seven feet; an existing detached recreation room that is not to code will be removed; the garage and driveway will be widened to allow for uncovered on site parking. NeiQhbor's Comments Two of the neighbors have submitted a petition in favor of the project as indicated in the January 5, 1991 letter attached. Findinas for a Hillside Area Construction Permit Review of a hillside area construction permit by the Planning Commission shall be based upon obstruction by construction of the existing distant views of nearby properties. Emphasis shall be given to the obstruction of distant views from habitable areas within a dwelling unit (Code Sec. 25.61.060). Planning Commission Action The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution. The reasons for any action should be clearly stated. At the public hearing the following condition should be considered: 1. that the addition as built shall conform to the plans submit- ted to the Planning Department and date stamped December 27, 1990 Sheets 1 through 5; 2. that the finish material used on both the flat and sloping portions of the roof shall be nonreflective as approved by the Chief Building Inspector and City Planner; and 3. that the highest point on the new roof of the remodeled house shall not exceed elevation 137.83' and that the framing shall be surveyed to confirm this elevation and the survey accepted by the City Engineer before the final framing inspection is called for and the roofing material is attached. On March 6, 1989, the City Council passed Ordinance 1388, which established a public review procedure for second floor additions in designated hillside areas. The intent of this ordinance is to protect the distant views which exist from neighboring properties. Regarding hillside area construction permits, Burlingame Municipal Code Section 25.61.050 states: Review of application. Any noticed property owner may request review of the application by written request to the city planner within seven days after the mailing of notice of application. Review of the application may be requested by any member of the planning commission or council by making such request before the close of the meeting of the legislative body at which the notice is received. Upon receipt of a request for review the city planner shall thereafter process the application in the same manner as an application for a special use permit. Unless review of the application is requested the hillside area construction permit shall be deemed approved upon the adjournment of the later of the planning commission or city council meeting following notice of application.
