Since there was no appeal to or suspension by the City Council, the August 27, 2007, Planning
Commission approval of your application for front setback variance for a first floor porch addition
became effective September 6, 2007. This application was to allow for front setback variance at
2301 Valdivia Way, zoned R-1.
The August 27, 2007 minutes of the Planning Commission state your application was approved
with the following conditions:
that the project shall be built as shown on the plans submitted to the Planning
Department date stamped August 15, 2007 (sheets A1 through A3) and that any
changes to building materia►s, exterior finishes, footprint or floor area of the building shall
require an amendment to this permit;
2. that the front setback Variance of 11'-6" shall oniy apply to the proposed front porch to
as shown on the plans date stamped August 15, 2007; that the front porch shall never
be enclosed for habitable space; and that the front setback variance shall become void if
the front porch is ever removed;
3, that the conditions of the City Engineer's July 9, 2007 memo, the Chief Building Official's
July 3, 2007 memo, the Fire Marshal's July 5, 2007 memo, and the NPDES
Coordinator's July 6, 2007 memo shall be met;
4. that demolition or removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shall
be required to comply with all the regulations of the B�y Area Air Quality Management
District;
5. that the project shall comply with the Canstruction ai7d Demolition Debris Recyciing
Ordinance which requires affected demolition, new construction and alteration projects
to submit a Waste Reduction plan and meet recyciing requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;

6. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance; and
7, that the project shall meet all the requirements of the California Building Code and
California Fire Code, 2001 edition, as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be
issued. One extension of up to one year may be considered by the Planning Commission if
application is made before the end of the first year.
The decision of the Council is a finaf administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you
must do so within 90 days of the date of the decision unless a shorter time is required pursuant
to state or federal law.

All construction must comply with the 2001 California Building Codes (CBC),
the Burlingame Municipal and Zoning Codes, and all other State and Federal
requirements.
Provide fully dimensioned plans.
Provide existing and proposed elevations.
Provide a complete demolition plan that indicates the existing walls, walls to
be demolished, new walls, and a legend. NOTE: The Demolition Permit will
not be issued until a Building Permit is issued for the project..
Provide guardrails at all landings. NOTE: All landings more than 30" in height
at any point are considered in calculating the allowable floor area. Consult the
Planning Department for details if your project entails landings more than 30"
in height.
Provide handrails at all stairs where there are four or more risers.
Provide lighting at all exterior landings.

Project proponents, contractors and subcontractors shall implement Best
Management Practices (BMPs) to prevent construction activities from impacting the
street, gutter, storm drain, and creek. Appropriate BMPs shall be implemented as
shown in the attached brochure.

Consent Calendar - Items on the Consent Calendar are considered to be routine. They are acted upon
simultaneously unless separate discussion and/or action is requested by the applicant, a member of fhe
public or a Commissioner prior to the time the Commission votes on the motion to adopt.
Chair Deal asked if anyone in the audience or on the Commission wished to call any item off the Consent
Calendar. There were no requests.
2a. 2301 VALDIVIA WAY, ZONED R-1 —APPLICATION FOR FRONT SETBACK VARIANCE AND HILLSIDE
AREA CONSTRUCTION PERMIT FOR A FRONT PORCH ADDITION TO A SINGLE FAMILY DWELLING
(JAMES MCFALL, APPLICANT AND ARCHITECT; AND RALPH AND LINDA WONDRA, PROPERTY

CommissionerAuran moved approva! ofthe Consent Calendarbased on the facts and findings in the staff
report, with recommended conditions in the staff report, and by resolution. The motion was seconded by
CommissionerCauchi. ChairDeal called fora voice vote on the motion and itpassed 6-0-1 (Commissioner
Terrones absent). Appeal procedures were advised.

3. 62 LOMA VISTA DRIVE, ZONED R-1 — APPLICATION FOR DESIGN REVIEW FOR A NEW, TWO-
STORY SINGLE FAMILY DWELLING AND DETACHED TWO-CAR GARAGE (JACK CHU, CHU DESIGN
& ENGR. INC., APPLICANT AND DESIGNER; CHIN-SHUI CHANG, PROPERTY OWNER) PROJECT
PLANNER: RUBEN HURIN (RESUBMITTAL OF A PROJECT WHICH WAS DENIED WITHOUT
PREJUDICE)
Reference staff report dated August 27, 2007, with attachments. Community Development Director Meeker
presented the report, reviewed criteria and staff comments. Twelve (12) conditions were suggested for
consideration.
Chair Deal opened the public hearing.
Rico Huo represented the applicant.
Was present when prior application considered by the Commission and heard comments from this
earlier review.
Brought a color elevation to better illustrate the proposed design.
Described specific changes to project.
Commission comments:
• Complimented the design.
■ In bedroom 3, no window is shown on the front elevation. There is an error on the elevation as
reflected on page A-4 of the plans (a window is shown); though would like a street-facing window in
bedroom 3, with two windows (side-by-side or other arrangement) that are each of a similar dimension
to the window over the entryway.
■ Install a remote-controlled electric gate in the driveway.
■ On the landscape plan, Australian Bushberry is not a good choice, can get diseased, should consider
another species.
■ Asked if a false stack is necessary for the direct vent fireplace.
■ Discussed the second-floor plate height.
■ Encouraged use of a permeable surface paving system for the driveway.
■ On the south elevation, the corbels seem gratuitous; don't necessarily add anything.
