Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301 (e)(1) of the CEQA Guidelines, which states that additions
to existing structures are exempt from environmental review, provided the addition will not result in an increase
of more than 50% of the floor area of the structures before the addition.
Project Description: The subject property is an interior lot with an existing two-story single family dwelling and
attached garage; the entire house is in the front 36% of the lot. The applicant is proposing to add a new,
uncovered 180 SF deck to the second story of the house and has an overall height of 13'-7". Previously, there
was a deck in the proposed location but it had been demolished in June 2014 due to its poor condition.
The proposed uncovered deck extends from one of the second story bedrooms by 13-feet and has a width of 14-
feet; the two front corners of the deck taper in at the last 1'-6'h" of the deck extension. The deck cantilevers and
is then supported by a post on each tapered front corner. The bottom of the deck is 9'-4" above grade and a 3'-6"
high guardrail (as measured from the deck finished floor) wraps around the edge of the deck.
With this project the existing lot coverage will increase from 13.5% to 14.8% where 40% is the maximum
allowed. The proposed floor area is 3,206 SF (0.23 FAR), where 5,632 SF (0.40 FAR) is the maximum allowed
(including the floor area under the deck). There is no other work proposed to the exterior or interior of the
existing house. All other zoning code requirements have been met.
The applicant is requesting the following applications:
Design Review for a second story addition (C.S. 25.57.010 (a) (2)); and
Hillside Area Construction Permit (C.S. 25.61.060).

Staff Comments: See attached memos from the Chief Building Official, Fire Division, Engineering Division,
Parks Division, and Stormwater Division.
The proposed project was initially submitted as a building permit (Permit No. B17-0302) and during review, it
triggered the need to approve the requests stated in this application before continuing the building permit
process. Planning staff would note that because of the nature of the request, it was determined that this request
could be brought forward directly as a Regular Action Item. If the Commission feels there is a need for more
study, this item may be placed on a subsequent action calendar for a second review with direction to the
applicant.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:

Required Findings for Hillside Area Construction Permit: Review of a Hillside Area Construction Permit by
the Planning Commission shall be based upon obstruction by construction of the existing distant views of nearby
properties. Emphasis shall be given to the obstruction of distant views from habitable areas within a dwelling
unit (Code Sec. 25.61.060).
Suggested Findings for Hillside Area Construction Permit: That the proposed uncovered deck addition at
the rear of the house does not extend beyond the existing side walls of the house, that the deck extension does
not block the view corridor for each neighboring property on the right, left, and rear, that the deck extension is
heavily screened by tall and large canopy trees from the neighboring properties to the rear. For these reasons
the project does not obstruct distant views from habitable areas with nearby dwelling units, and therefore the
project may be found to be compatible with hillside area construction permit criteria.
Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Division date stamped
December 7, 2017, sheets A-1 to A-6;
2. that any changes to building materials, exterior finishes, architectural features, roof height or pitch, and
amount or type of hardscape materials shall be subject to Planning Division or Planning Commission review
(FYI or amendment to be determined by Planning staffl;
3. that any changes to the size or envelope of the basement, first or second floors, or garage, which would
include adding or enlarging a dormer(s), shall require an amendment to this permit;
4. that any recycling containers, debris boxes or dumpsters for the construction project shall be placed upon
the private property, if feasible, as determined by the Community Development Director;
5. that demolition or removal of the existing structures and any grading or earth moving on the site shall not
occur until a building permit has been issued and such site work shall be required to comply with all the
regulations of the Bay Area Air Quality Management District;
6. that prior to issuance of a building permit for construction of the project, the project construction plans shall
be modified to include a cover sheet listing all conditions of approval adopted by the Planning Commission,
or City Council on appeal; which shall remain a part of all sets of approved plans throughout the
construction process. Compliance with all conditions of approval is required; the conditions of approval
shall not be modified or changed without the approval of the Planning Commission, or City Council on
appeal;
7. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination and
installed on the portions of the roof not visible from the street; and that these venting details shall be
included and approved in the construction plans before a Building permit is issued;
8. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial orfull demolition ofa structure, interiororexterior, shall require
a demolition permit;
9. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2016
Edition, as amended by the City of Burlingame; and

THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR
TO THE INSPECTIONS NOTED IN EACH CONDITION:

1. Based on the scope of work, this is a"Type I" project that requires a Stormwater Construction
Pollution Prevention Permit. This permit is required prior to issuance of a Building Permit. An initial field
inspection is required prior to the start of any construction (on private property or in the public right-of-
way).
z. Any work in the City right-of-way, such as placement of debris bin in street, work in sidewalk area,
public easements, and utility easements, is required to obtain an Encroachment Permit prior to starting
work.
3. Construction hours in the City Public right-of-way are limited to weekdays and non-City Holidays
between 8:00 a.m. and 5:00 p.m. for all activities (including hauling).

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
Desiqn Review and Hillside Area Construction Permit for a second story deck addition to an
existinq sinqle familv dwellinq at _2965 Trousdale Drive zoned R-1 Ivanrick John proqertv
owner, APN: 025-312-100;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
January 8, 2018, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is
no substantial evidence that the project set forth above will have a significant effect on
the environment, and categorical exemption, per the California Environmental Quality
