SUBJECT: VARIANCE FOR PARKIP�G TO ALLOW AN ADDITION TO A SINGLE
FAMILY HOME AT 1544 WESTMOOR ROAD
Mrs. Catherine Cimarello is requesting a variance to the two covered off-street parking
space requirement so that she can add a third bedroom to her home at 1544 Westmoor Road
(Code Sec. 25.70.030a). Currently there is one covered off-street space in an attached
garage; however the home is placed 18'-6" from the front property line, and required
parking is not allowed within the required 15' front setback.
City staff have reviewed this project. The City Engineer (August 29, 1983 memo), the
Chief Building Inspector (August 18, 1983 memo) and the Fire Marshal (August 24, 1983
memo) had no comments.
Mrs. Cimarello submitted a letter (August 16, 1983) explaining the reasons for her
request. She notes that there is no other location on her property to put the additional
required parking space, that she would like to make the addition to her house so her
granddaughter can come live with her to provide companionship, she does not feel the
addition would affect the public health, safety or welfare or the zoning in the area.
Te grant a variance the Planning Commission must make findings of fact which pertain
to the property as follows (Code Sec. 25.54.020):
a. that there are exceptional or extraordinary circumstances applicable
to the property or class of uses in the district, so that a denial of
the application would result in undue property loss;
b. that such variance would be necessary for the preservation and enjoyment
of a property right of the owner of the property involved;
c. that the granting of such variance would not be materially detrimental
to the public health, safety or welfare, or injurious to the property
or improvements of other property owners, or the quiet enjoyment of such
property or improvements; and
d. that the granting of such variance will not adversely affect the
comprehensive zoning plan of the city.
In summary, the existing garage is attached to the residential structure and the setback
from the street is inadequate to expand or extend the garage without encroaching into
the front setback or causing substantial remodeling cost including replacing the kitchen.
Because of the placement of the house on the lot, additional living area cannot be added
except at the rear or over the existing structure without violating city codes or causing
extraordinary expense and disruption to the property owner. The public impact of the
addition will be limited to the parking of an additional car in the driveway or street.
Because access to the addition requires one to go through the existing home and no
kitchen facilities will be provided in the addition, the project will not impact the
single family zoning of the area.

The Planning Commission should hold a public hearing. Findings must be made for an
affirmative action on the variance. At the public hearing the following condition
should be considered:
1. that the project be built according to the plans submitted and
date stamped by the Planning Department August 16, 1983.
