At their meeting of December 7, 1992 the City Council held an appeal
hearing on your application for a special permit for expansion of a
nonconforminq primary unit and a declining height envelope variance at
850 Walnut Avenue, zoned R-1.
Following a public hearing Council approved your special permit
application and denied the request for a declining height envelope
variance with the following conditions:
1. that the addition as built shall conform to the plans submitted to
the Planning Department and date stamped June 10, 1992 Sheets 1,
2 and 3, except that no exceptions to declining height envelope
shall be permitted and no new windows shall be permitted on the
wall facing the side yard;
2. that the primary dwelling unit on this single family residential
lot at 850 Walnut Avenue is determined to be the dwelling unit at
the forwardmost portion of the lot which is also the newer of the
two dwelling units; and
3. that the project shall meet all the requirements of the Uniform
Building and Uniform Fire Codes as amended by the City of
Burlingame.
All site improvements and construction work will require separate
application to the Building Department. This approval is valid for one
year during which time a building permit must be issued. One extension
of up to one year may be considered by the Planning Commission if
application is made before the end of the first year.

Dear Mr. and Mrs. Dungca,
Pursuant to the enclosed document (Ordinance 1471) the Planning
Department has made the determination that the primary unit on your
lot at 850 Walnut Avenue will be the forward most structure closest
to the street. The primary unit status means that at no future
date may the rear unit on your property be deemed the primary
structure for expansion reasons and that only maintenance and
repairs may be made to that rear (secondary) unit.
On the basis o� the determination of the primary unit status your
declining height envelope variance is scheduled for a study meeting
before the Planning Commission on October 13, 1992 at 7:30 pm in
the Council Chambers here at City Hall.

ORDINANCE CONCERIQING EXPANSION OF I`TON-CONFORMING
RESIDENCES IN R-1 ZONE
The CITY COt7NCIL of the CITY OF BURLINGAME does
hereby ordain as follows:
Section 1. Section 25.50.025 is hereby added to
the Burlingam� Municipal Code to read as follows:
"25.50.025 Fxpansion of non-conforming uses - R-1 zone
This section shall.only be applicable to R-1 zoned parcels
which contain two detached n�n-confor!ning residential
units. Only the primary residence, as determined by the
City Planner, may be increased in footprint or in any
exterior dimension if the secon�ary detached unit is to be
retained as a residential unit. A ccnd�tional use permit
pursuant to Chapter 25.16 shall be required for any such
increase to a primary unit. Only mainLenance aizd repairs
as defined by the Uniform Building Code m3y be made tc any
secondary dwelling unit. The floor area or footprint of
such a secoridary unit shall not be e:cpanded. �
Factors for determining T.he primary residence �hall
include, but not be linited �o, rclative age, size and
conformity with zoning requirements of the two rzsidences.
The property owner may request that the Pla.nning Commission
review any such determination by the City Planner_"
