RESOLUTION APPROVING CATEGORICAL EXEMPTION, AND SPECIAL PERMIT FOR ACCF.SSORY STRUCTURE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for six svecial permits to replace an existin�, sin lg e story accessory structure at 839 Walnut Avenue, zoned R-1, APN: 028-133-080 ; Deborah Hall. 839 Walnut Avenue,�roperty owner: WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on July 22, 1996 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption per Article 19, Section: 15303 - New construction or conversion of small structures Class 3(e)-Accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences is hereby approved. 2. Said speciai permits are approved, subject to tl�e conditions set forth in Exhibit "A" attached hereto. Findings for such special permits are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. � � �� ���- cxAi�tarr I, Charles Mink , Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 22nd day of Julv , 1996 , by the following vote: AYES NOES : COMMISSIONERS: �� / , i � �� J i; `o `1-� � ��. � � � �� � � , 1� �/� r ', - `� i ,� ,�� ��,�o� i � COMMISSIONERS: ABSENT: COMMISSIONERS: : �I �l� i� `/ C SECRETARY EXHIBIT "A" Conditions of approval categorical exemption and special permits 839 WALNUT AVENUE effective AUGUST 5, 1996 1. that the project shall be built as shown on the pla�ls submitted to the Planning Department and date stamped July 11, 1996 Sheet 1, Site Plan, General Floor Plan and Building Elevations; 2. that the conditions of the City Engineers' and Senior Building Official's 7une 3, 1996 memos shall be met; 3. that the rear and right side property lines adjacent to the proposed structure shall be surveyed prior to the issuance of a Building permit and that survey shall be accepted by the City Engineer, 4. that the accessory structure shall never be used for accessory living or sleeping purposes, shall never include a kitchen and shall not be used for any home ofiice uses without an amendment to this special permit; and 5. that the project shall meet all the requirements of tl�e California Building and Fire Code, 1995 Edition as amended by the Cily of Burlingame.
