Dear Mr. and Mrs. Poblete,
At their meeting of February 3, 1�998, the City Council held an appeal hearing on your application to
allow a fence exception at 1170 Vancouver Avenue, zoned R-1. Following a public hearing Council
upheld the Planning Commission's denial of this request.
Since your request for a 7'-8" height exception on the side property line fence adjacent to 1160
Vancouver and a 7'-1" height exception on the rear property line fences were denied, you have 30 days
(to March 4, 1998) in which to lower the height of both fences to 7'-0", the maximum fence height for
side and rear yard fences allowed in the city. Fence heights are measured from highest adjacent grade.
Please call Fred Cullum, Chief Building Inspector, at 656-1595 for him to arrange an appointment for
inspection of the reduced height of the fence.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.

RESOLUTION APPROVING CATEGORICAL EXEMPTION AND
FENCE EXCEPTION
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been proposed and application has been made for a
Fence Exception for a 7'-8" high (maximum) fence alon� the side propertv line and a T-1 ° hi h� fence
along the rear property line where 7'-0" is the maximum fence hei�ht allowed at 1170 Vancouver
Avenue, zoned R-1, Benjamin L. & Inocencia C. Poblete, 1170 Vancouver Avenue, Burlingame CA
94010, property owners, APN: 026-183-270;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
January 12, 1998 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that
the project set forth above will have a significant effect on the environment, and Categorical Exemption,
per CEQA Article 19, Categorically Exempt per Section 15303, construction and location of new, small
facilities or structures -(e) accessory (appurtenant) structures including garages, carports, patios,
swimming pools and fences is hereby approved.
2. Said Fence Exception is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such Fence Exception are as set forth in the minutes and recording of said
meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.
