HomeMy WebLinkAbout1151 Vancouver Ave - Staff Report� ���, �� P.C. 4/27/87 Item # / MEMO TO FROM; SUBJECT PL�NNING COMMISSION CITY PLANNER USE PERMIT FOR CHILDBIRTH CLASSES AT ROOSEVELT SCHOOL, 1151 VANCOUVER AVENUE, ZONED R-1 Kathryn Newburn is requesting a use nermit in order to provide childbirth preparation classes in the 550 SF rear half of the kindergarten building at Roosevelt School, zoned R-1 (Code Sec. 25. 56.020). Classes would be held twice a week from 7:00 P.M, to 9:15 P.M, for 14 students with one instructor. The instructor would also use the area for an office two days a week, Mondays and Wednesdays, from 9:00 A.M, to 4:00 P.M. The leased area contains bathroom facilities. The other half of this building is leased to Peninsula Parent newspaper who obtained a use permit in 1986. Staff Review City staff have reviewed this application. The Chief Building Inspector (March 25, 1987 memo) and the Fire Marshal (March 26, 1987 memo) had no comments. The City Engineer (April 6, 1987 memo) still expresses concern about parking but makes no requirement or other comments. Superintendent of Schools, James Black (letter date stamped March 17, 1987), notes that he has recommended approval of the lease and the board acted on it, with the condition of receipt of a city use permit, on March 10, 1987. She has been a certified childbirth instructor since 1980. She wishes to use the 550 SF area at Roosevelt School to instruct expectant couples in childbirth preparation. She has taught these classes at hospitals and recreation centers but finds them too noisy and uncomfortable for teaching a small group. She would also use the area for a personal office on a part time basis. She notes classes would be between 7:00 P.M, and 9:15 P.M, when traffic would be minimal; this is also the most convenient time for working couples. Since she lives close to the school she would walk to the site when she uses it both for an office and classes. -2- Study Questions At their meeting on April 13, 1987 the Planning Commission reviewed this application and asked several questions. In clarifying her office use at this location the applicant noted she would use the site two days a week, Monday and Wednesday between 9;00 �.M, and 4:00 P.M. She would have no more than one to two people per day at most visit her during her office hours. She notes in her letter to Commission that she finds a location off the hospital premise is quieter and better suited to her tyoe of class. She has taught classes at hospitals and recreation centers in the past. During her daytime use she would walk to the site. She lives at 1301 Sanchez �venue. Her occasional visitors would have to park on the street. Presently four uses share this closed public school site (table of Required Parking for Uses at Roosevelt School, April 6, 1987). Three of these uses are schools with a maximum of 22 staff inembers who come regularly to the site generally between the hours of 7:30 A.M, to 5:30 P.M. The fourth use is Peninsula Parent newspaper with three employees on site between 9:00 A.M, and 5:00 P.M. None of the present tenants have regular use after 5:30 P.M., although several have mentioned occasional evening sessions for school events. Planninq Commission Action The Planning Commission should hold a public hearing and take action by resolution. In finding reasons for any action the facts included in the staff report supporting the action should be incorporated by reference and the reasons for action clearly stated. �t the public hearing the following conditions should be considered: l. that the use of the 550 SF rear of the kindergarten building at Roosevelt School shall be limited to classes with 14 students offered twice a week between 7:00 P.M, and 9:15 P.M, with one instructor; 2. that the daytime office use of the rear of the kindergarten area shall be limited to two days a week, Monday and Wednesday 9:00 A.M. to 4:00 P.M.; 3. that if a conflict over evening parking for occasional use by previously approved uses on site shall occur between the students of the childbirth classes and those other uses, the childbirth classes shall be occasionally temporarily rescheduled to resolve the problem; and 4. that any change in the size of class, the hours of operation or the type of use in this 550 SF area will require an amendment to this use permit before the change can be implemented. The applicant's business is compatible with the facility and its neighbor- hood lcoation. Such business can include: a. Schools, private tutoring, pre-school, arts/dancing instruction and/or indstrial training center. b. Offices for charity or non-profit organizations, as well as small business offices or light commercial industry. 2. Provisions should be made for continued use of the facilities for community service activities (i.e., Senior Citizens, homeowners associations, recreation department classes, scouts, etc.) 3. The office use of the site will not involve any staff other than herself and at most, she expects 1-2 visitors a week during office hours. The classes would be held twice a week for at most 7 couples between the hours of 7:00 p.m. and 9:15 p.m. Page 5 Burlingame Planning Commission Minutes April 13, 1987 Comment on the motion: appellant should comply with the codes, it would jeopardize the city and the residents to allow this appeal; stairs are not safe, concern about their use in an emergency; Fire Department has noted its reasons for these code requirements, in an emergency situation with packs on their backs negotiating the narrow stairs would be a problem; if the use is going to be intensified this house should be brought up to code to ensure safety. CP Monroe reviewed her summary page of suggestions discussed at the last meeting compared with present code and noted there are several aspects of signage regulation relating to auto dealerships which are addressed in the present code but were not covered in Commission's previous discussion. C. H.Graham suggested a change in his proposal: maximum size of face of pole signs to be 48 SF rather than 24 SF. C. Jacobs commented she could not vote for either of the suggestions in the summary table and will contact the CP with her recommendations to be added to this table. Staff will bring back to Commission on a future agenda. - Commission Rules of Procedure - Timing for Election of Officers Due to a recent change in Council's commissioner appointment policy election of officers in April does not seem feasible. She plans to use the proposed site for office work two days a week (Monday and Wednesday) from 9:00 a.m, to 4:00 p.m., and some days she would be there for only half the day. She lives in the area (1301 Sanchez Avenue) and plans to walk to the site. She stated she prefers teaching childbirth classes on her own rather than at hospitals which offer such classes since she can have smaller classes and can set up the room for more comfort and less noise than possible in a hospital atmosphere. Peninsula Montessori (i.e. Peninsula Early Learning) has moved from rooms 3 and 4 to rooms 1 and 2. They have decreased the amount of space leased from 6100 SF to 4108 SF. 2. Carden School has taken over rooms 3 and 4 vacated by Peninsula Montessori. However, since in 1986 Carden vacated rooms 9,10,11 and 12, even with these new rooms, they are using less space than they have had in the past. 3. True Learning has expanded from rooms 9 and 10 and is also using rooms 11 and 12. Since this application is up for review in May, 1987 the applicant has been informed that his use permit will have to be amended to reflect the additional space he is using.
