Summary: 801 Crossway Road is located at the corner of corner of Crossway Road and Palm Drive.
While the front of the property is considered to be Palm Drive, the house and garage face Crossway
Road. The site currently contains a finro-story, three-bedroom house and a detached one-car garage.
There is no work proposed on the house as part of this project.
The applicant is proposing to completely demolish the existing 327 SF detached one-car garage and
construct a new 454 SF detached accessory structure. The new accessory structure will provide one
covered parking space (10' X 20'), meeting the parking requirement for the three bedroom house. In
addition to a single covered parking space, the rear 14' of the new accessory structure would contain a
storage area with a decreased ceiling height. The new structure will be set back 1'-0" from the side
and rear property lines, located within the rear 30% of the lot, and will be 36' in length. The Zoning
Code requires a Special Permit for accessory structures greater than 28' in length.
With the removal of the existing garage and the construction of the proposed garage, the floor area on
the property will increase from 2,320 SF (0.44 FAR) to 2,447 SF (0.46 FAR) where 3,185 SF (0.60
FAR) is the maximum allowed. The proposed floor area is 738 SF below the maximum allowed FAR.
Aside from the Special Permit required for the length of the proposed accessory structure, all Zoning
Code requirements have been met. The following application is required:
• Special Permit for an accessory structure that is in the rear of the lot and is more than 28 feet
in width or depth (CS 25.28.035, e).

Staff Comments: Staff would note that this is no� a Design Review item. However it is subject to
Planning Commission review because of the Special Permits that are required for the accessory
structure. I
Study Meeting: At the Planning Commission regular study meeting on November 13, 2007, the
Commission had several concerns with the plans and placed this item on the action calendar when the
plans have been revised as directed (November 13, 2007, Planning Commission Minutes).
The designer submitted a response letter and revised site plan (Sheet 1), date stamped November 20,
2007, to address the Commissions concerns. Listed below are the Commission's comments followed
by the responses from the designer: �
1. Where the new structure lies adjacent to the ,neighboring property, clarify whether or not a new
fence will be required on the prope►ty line. �
• The applicant responded that the existing wood fence will be modified to end at the left rear
corner of the garage. There will be no fence at the rear or right side of the garage (response
letter from applicant and revised site plan (Sheet 1), date stamped November 20, 2007).
2. Note that the existing building has already been demolished.
• The applicant responded that the property owner demolished the garage without a permit, and
without the knowledge that a building per I it was required. The property owner has since
applied for a demolition permit (response letter from applicant, date stamped November 20,
2007). '
3. A dividing wall is not shown between the storage area and parking space in the new garage; is
one needed or desired?
• The applicant responded that a dividing wall is neither needed nor desired (response letter
from applicant, date stamped November 20,, 2007).
4. The roof pitch should more closely match the I'roof pitch of the existing house.
• The applicant responded that the proposed roof pitch is needed so that the area above the
covered parking space can be used for storage purposes (response letter from applicant, date
stamped November 20, 2007). '

5. Consider shortening the length of the garage to 32' 0" to reduce the garage's prominence.
• The applicant responded that they would like a 36'-long garage for storage purposes, and to
provide the option of tandem parking in �the future (response letter from applicant, date
stamped November 20, 2007).
Findings for a Special Permit: In order to grant Special Permits for an accessory structure that is
greater than 28' in length and that is exempt from setback requirements and is located within the rear
40% of the lot, the Planning Commission must find that the following conditions exist on the properly
(Code Section 25.51 A20 a-d): '
(a) The blend of mass, scale and dominant structural characteristics of fhe new construction or
addition are consistent with the existing st�ructure's design and with the existing street and
neighborhood; '
(b) the variety of roof line, facade, exterior finish materials and elevations of the proposed new
structure or addition are consistent with the existing structure, street and neighborhood;
(c) the proposed project is consistent with the �!� residential design guidelines adopted by the city;
and '
(d) removal of any trees located within the footprint of any new structure or addition is necessary
and is consistent with the city's reforestation requirements, and the mitigation for the removal
that is proposed is appropriate. '�
Planning Commission Action: The Planning Cornmission should hold a public hearing. Affirmative
action should be by resolution and include findings for the Special Permits. The reasons for any action
should be clearly stated for the record. At the public hearing the following conditions should be
considered:
1. that the project shall be built as shown on the plans submitted to the Planning Department and
date stamped Oclober 17, 2007 (Sheets 2 a�nd 3), and date stamped November 20, 2007
(Sheet 1), and shall not exceed an overall height of 14'-7" measured from adjacent grade to the
roof ridge, and a maximum plate height of 8'-7" measured from adjacent grade to top of plate;
2. that the conditions of the Chief Building Official's September 14, 2007 memo, the City
Engineer's September 17, 2007 memo, the Fire Marshal's September 17, 2007 memo, and the
NPDES Coordinator's September 19, 2007 ��memo shall be met;
3. that the accessory structure shall only be used as a one-car garage and storage area; shall
never be used for accessory living or sleeping purposes or as a second dwelling unit; all
storage areas in the detached garage shall not include additional utility services and/or a toilet
or be used as accessory living space without an amendment to this special permit;
4. that prior to issuance of a building permit for��, construction of the project, the project construction
plans shall be modified to include a cover sheet listing all conditions of approval adopted by the
Planning Commission, or City Council on ap�peal; which shall remain a part of all sets of
approved plans throughout the construction process. Compliance with all conditions of
approval is required; the conditions of approval shall not be modified or changed without the
approval of the Planning Commission, or City Council on appeal;
5. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance
which requires affected demolition, new construction and alteration projects to submit a Waste

Reduction plan and meet recycling requirements; any partial or full demolition of a structure,
interior or exterior, shall require a demolition permit; and
6. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2001 Edition, as amended by the City of Burlingame.

Instead of building fences parallel to the e�rterior of the garage we will have a 90 degree return so
the side and end of the garage will perform as a fence. See the site plan.
Note that e�sting building has already been demolished.
The owner did demolish the e�sting garage without benefit of a pernut and without
knowledge that a pemut was required. A demolition pernut has been applied for and all the
required documentarion will be furnished to the buildiug department.
A dividing wall is not showu between the storage area and parking space in the new garage; is o�e
needed or desired?
No such wall is desired or nceded.
The roof pitch should more closely match the roof pitch on the home.
The roof pitch, of the main portion of the garage, is needed so the attic will have enaugh room
where it can actually be used, as is very common, for storage. The rear of the garage has a less of
a slope which will allow more light to enter the adjoining properly and also to diminish bulk of the
building.
Consider shortening the length of tbe garage to perhaps 32-feet to rednce the garage's prominence at
the street side of the property.
The 36 feet of length is needed to allow for storage at the rear and a car at the front. Additionally
if we decide to park two cars in the garage (tandem) we will need the entire 36 feet. Shortening
the garage to 32 feet would not allow use for tandem parking. The garage width of 13 feet is
considerably shorter in width than a standard two car garage of 21 feet The front of the garage
sits back 22 feet from the property line and 24 feet from the back of sidewalk. This provides
adequate space for a car to park in the driveway and not to protrude into the sidewalk. We don't
feel the proposed garage will display any negadve prominence.

1) All construction must comply with the 2001 California Building Codes (CBC), the Burlingame
Municipal and Zoning Codes, and all other State and Federal requirements. NOTE: Projects
for which Building Permit applications are received on or after January 1, 2008 must
comply with the 2007 California Buildinq Codes (CBC), the Burlingame Municipal and
Zoning Codes, and all other State and Federal requirements. Projects that have been
approved by the City of Burlingame Planning Commission on or before December 31,
2007 may use the 2001 California Codes.
2) Provide fully dimensioned plans.
3) Provide a complete demolition plan that indicates the existing walls, walls to be demolished,
new walls; and a legend. NOTE: The Demolition Permit will not be issued until a Building
Permit is issued for the project.
4) This project will be considered a New Building because, according to the City of Burlingame
Municipal code, "when additions, alterations or repairs within any twelve-month period exceed
fifty percent of the current replacement value of an existing building or structure, as
determined by the building official, such building or structure shall be made in its entirety to
conform with the requirements for new buildings or structures." This building must comply with
the 2001 California Building Code for new structures.
5) Comply with the new, 2005 California Energy Efficiency Standards for low-rise residential
buildings. Go to http://www.eneray.ca.qov/title24 for publications and details.
6) Obtain a survey of the property lines for any structure within one foot of the property line.
7) Roof eaves must not project within two feet of the property line.
8) Exterior bearing walls less than three feet from the property line must be constructed of one-
hour fire-rated construction and no openings are allowed.
9) Provide guardrails at all landings. NOTE: All landings more than 30" in height at any point are
considered in calculating the allowable floor area. Consult the Planning Department for details
if your project entails landings more than 30" in height.
10) Provide handrails at all stairs where there are four or more risers.
11) Provide lighting at all exterior landings.
12) The fireplace chimney must terminate at least finro feet above any roof surface within ten feet.

NPDES permit requirement to prevent stormwater pollution including but not limited
to ensuring that all contractors and subcontractors implement construction Best
Management Practices (as shown in attached brochure) during ALL phases of the
construction project (including demolition).

WHEREAS, a categorical exemption has been proposed and application has been made for a
Special Permit for an accessory structure that is qreater than 28' in length at 801 Crosswav
Road, zoned R-1, Vickv Collins, propertv owner, APN: 029-016-110;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
December 10, 2007, at which time it reviewed and considered the staff report and all other
written materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is
no substantial evidence that the project set forth above will have a significant effect on
the environment, and categorical exemption, per CEQA Article 19. Section: 15303 -
New Construction or Conversion of Small Structures Class 3(e), Accessory
(appurtenant) structures including garages, carports, patios, swimming pools and
fences.
2. Said Special Permit is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such Special Permit is as set forth in the minutes and
recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

1. that the project shall be built as shown on the plans submitted to the Planning
Department and date stamped October 17, 2007 (Sheets 2 and 3), and date stamped
November 20, 2007 (Sheet 1), and shall not exceed an overall height of 14'-7" measured
from adjacent grade to the roof ridge, and a maximum plate height of 8'-7" measured
from adjacent grade to top of plate;
2. that the conditions of the Chief Building Official's September 14, 2007 memo, the City
Engineer's September 17, 2007 memo, the Fire Marshal's September 17, 2007 memo,
and the NPDES Coordinator's September 19, 2007 memo shall be met;
3. that the accessory structure shall only be used as a one-car garage and storage area;
shall never be used for accessory living or sleeping purposes or as a second dwelling
unit; all storage areas in the detached garage shall not include additional utility services
and/or a toilet or be used as accessory living space without an amendment to this
special permit;
4. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of
approval adopted by the Planning Commission, or City Council on appeal; which shall
remain a part of all sets of approved plans throughout the construction process.
Compliance with all conditions of approval is required; the conditions of approval shall
not be modified or changed without the approval of the Planning Commission, or City
Council on appeal;
5. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects
to submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit; and
6. that the project shall meet all the requirements of the California Building and Uniform
Fire Codes, 2001 Edition, as amended by the City of Burlingame.

Summar�r: 801 Crossway Road is located at the corner of corner of Crossway Road and Palm Drive.
While the front of the property is considered Palm Drive, the house and garage face Crossway Road.
The site currently contains a finro-story, three-bedroom house and a detached one-car garage. There is
no work proposed on the house as part of this project.
The applicant is proposing to completely demolish the existing 327 SF detached one-car garage and
construct a new 454 SF detached accessory structure. The new accessory structure will provide one
covered parking space (10' X 20'), meeting the parking requirement for the three bedroom house. In
addition to a single covered parking space, the rear 14' of the new accessory structure would contain a
storage area with a decreased ceiling height. The new structure will be set back 1'-0" from the side
and rear properly lines, located within the rear 30% of the lot, and will be 36' in length. The Zoning
Code requires a Special Permit for accessory structures greater than 28' in length.
With the removal of the existing garage and the construction of the proposed garage, the floor area on
the property will increase from 2,320 SF (0.44 FAR) to 2,447 SF (0.46 FAR) where 3,185 SF (0.60
FAR) is the maximum allowed. The proposed floor area is 738 SF below the maximum allowed FAR.
Aside from the Special Permit required for the length of the proposed accessory structure, all Zoning
Code requirements have been met. The following application is required:
• Special Permit for an accessory structure that is in the rear of the lot and is more than 28 feet
in width or depth (CS 25.28.035, e).

1) All construction must comply with the 2001 California Building Codes (CBC), the Burlingame
Municipal and Zoning Codes, and all other State and Federal requirements. NOTE: Projects
for which Building Permit applications are received on or after January 1, 2008 must
comply with the 2007 California Buildinq Codes (CBC), the Burlingame Municipal and
Zoning Codes, and all other State and Federal requirements. Projects that have been
approved by the City of Burlingame Planning Commission on or before December 31,
2007 may use the 2001 California Codes.
2) Provide fully dimensioned plans.
3) Provide a complete demolition plan that indicates the existing walls, walls to be demolished,
new walls, and a legend. NOTE: The Demolition Permit will not be issued until a Building
Permit is issued for the project.
