HomeMy WebLinkAbout801 Crossway Road - Staff Report� �� � P.C. 8/ 88 Item # ._ MEMO T0: PLANNING COMMISSTON FROM: CITY PLANNER SUBJECT: VARIANCE FOR SIDE SETBACK AT 1200 PALM DRIVE, ZONED R-1 Bruce Blagsvedt, property vwner, is requesting a variance to the side setback (4� requested, 7.5' required) in order to place a covered porch and stairs on the house located on the corner lot at 1200 Palm Drive, zoned R-1 (Code Sec. 25.62.050). The house sits at an angle to the side property line so that the side setback provided from the proposed structure varies from 4� to 5�. Staff Review City staff hav� reviewed this request. The Chief Building Inspector (July 21, 1988 memo) and Fire Marshal (July 25, 1988 memo) had no comments. The City Engineering Department (July 25, 1988 memo) commented that they checked utility placement and intersection sight lines and had no problems. The Zoning Technician (July 22, 1988 memo) notes that in the plans submitted for plan check and building permit the stairs did not appear to encroach into. the side setback. While on a site inspection a building inspeetor identified the problem and stopped work on the stair. There is an active building permit on the remainder of the construction and it meets zoning code requirements. Applicant's Letter In his letter of July 13, 1988 Bruce Blagsvedt state5 that he was not awa�e that the 7.5� side setback line applied to stairs and the drawings submitted were somewhat confusing. Since this was not questioned, he received a building permit. During a site inspection the building inspector suggested that he talk to Planning. There was a walkway and stairs in the side setback originally. These extended from a porch set behind the side setback. Because of settlement and termite/dry rot problems this porch had to be removed. It was relocated closer to the side property line as a part of interior remodeling and expanding a second floor bedroom. To address the problem he comments that he has redesigned the porch, orienting it to the side so that it does not extend into the side setback more than the 2.5' to 3.5' of the original porch. He includes pictures of houses within a two block radius which also have porches and stairs within their side setbacks. He comments that what he is proposing sets back further than these examples. He does not feel these existing porches, or his, detract from the neighborhood. a The exceptional circumstances relating to the property, he states, are the change in elevation of 62" and a front setback of 15' severely limits the location of the front stairs. He also notes the Crossway frontage is the narrow (Planning front) ot his lot, but his house is oriented toward Palm ( the side of the lot ). The foundation was poured because a building permit had been issued and it would be costly, at this point, to relocate the stairs and porch foundation. He feels he has a right to improve his property consistent with Uniform Building Code. The propased stairs are consistent with the design and location of the stairs on other properties in the neighborhood. ThE house will continue to be used as a single family home as dictated by the R-1 zoning. Findinc�s for a Variance In order to grant a variance the Planning Commission must find certain conditions exist on the site (Code Section 25.54.020 a-d): (a) that there are exceptional or extraordinary circumstances applicable to the property or class of uses in the district, so that a denial of the application would result in undue prvperty loss; (b) that such variance would be necessary for the preservation and enjoyment of a property right of the owner of the property involved; (c) that the granting of such variance would not be materially detrimental to the public health, safety or welfare, or injurious to the property or improvements of other prope�ty owners, or the quiet enjoyment of such property or improvements; and (d) that the granting of such variance will not adversely affect the comprehensive zoning plan of the city. Plannina Commission Action The Planning Commission should hold a public hearing. Findings must be made for affirmative action and the reasons for any action should be clearly stated. The reasons for �har�ging t�he lacation of t,�e entrance stairs are many �ut briefly: - the exlsting porch and stairs had settlement probierns, Germit�es �nd dryrQt and needed to be torn down. - loca�ion of frant door and fireglace were not conducive to goad traffic fiow. Th� approved plans show the frant stairs facing Crassw�a�. Attachm�nt "C" ciarifies v�hat the stairs wouid loak like as triey are represent�ed in the apgrQved drawings. The cavered porch area is within the 7.5' side setback but since t�he stairs are attached they violate t,�e setback requirernents . In additian, although visuaily the Crassw�ay eleva�ion is cieariy the "front" oi the house I am nat abie t�a take advantag� af the 6' exbension of stairs i�to the frant setback since legaily Paim is the front �f my house. Also, since a permit w�s issued and the faunda�ions have 1�n peured I will suff$r considerable exgense if floQr pian changes are required.
