SUBJECT: TWO SPECIAL PERMITS FOR A NEW GARAGE AT 728 CROSSWAY
ROAD, ZONED R-1
Mr. and Mrs. Michael McCallion are requesting two special permits
in order tv replace their existing 18� x 18' detached garage with a
23� x 29� detached garage in the rear 30� of their lot at 728
Crossway Road, zoned R-1. One special permit is for an oversized
garage (660 SF proposed, 500 SF allowed) (Code See. 25.60.010-b).
The second special permit is for storage area exceeding 10� of the
floor area of the house (154 SF proposed, 124 SF allowed) (Code
Sec. 25.60.010-1). No other construction is proposed on this lot.
Staff Review
City staff have reviewed this request. The Chief Building
Inspector (May 2, 1988 memo), Fire Marshal (May 2, 1988 memo) and
City Engineer (May 2, 1988 memo) had no comments.
Applicants' Letter
In their letter of April 23, 1988 the applicants state that they
would like to use the extra space in the new garage for storage and
a fly tying bench. They expect next year to add a second story
addition to the house. They will use the garage temporarily ta
store eonstruction materials a� that time. They indicate they
intend to live in Burlingame a long time.
Studv Ou�stions
The Planning Commission reviewed this request at study on May 9,
1988 (PLanning Commission Minutes, May 9, 1988). The Commissioners
asked several questions about the proposed garage. The applicant
responded in a letter dated May 10, 1988. The only utility
proposed for the new garage is electricity. The existing garage is
18� x 18�. They are intending to add a second story to their house
within the next two years. At that time the storage area in the
garage would not exceed 10� of the house. If the extra 30 SF of
storage is a problem they would prefer to remove the in�erzor wall
of the garage and call the entire structure parking.
Plannina Commission Action
The Planni.ng Commission should hold a public hearing. Affirmative
action should be taken by resolution. The reasons for any action

should be clearly stated. At the public hearing th� following
conditions should be considered:
1. that the garage as built shall conform to the plans
submitted to the Planning Department and date stamped April
21, 1988; and
2. that no part of the garage shall ever be used for
residential purposes nor shall any vther utility except
electricity be extended to the garage.

ITEM FOR STUDY

Requests: utilities in the proposed garage; size of existing
garage; statement from applicant regarding why the proposed storage
area cannot be reduced by 30 SF and eliminate one special permit.

reviewed etails of the request, staff review, appl' ants' letter,
letter fr applicant�s architect, letter in pport from the
neighbor at 2007 Clarice Lane. One condition as suggested for.
consideration at the public hearing.
Anthony Kakis, pplicant and his archit t, Thalia Georgopoulos
were present. plicant discussed th fact that the code had
changed since his rchitect started wo ing on the plans, they had
checked code requir ents with the ci in February, 1988; redesign
of structural change would add c siderably to the cost of the
project; they have di ussed the roposal with their neighbors and
have received no negati e feedb ck. In discussion with Commission
the architect advise fo dation plan will meet all city
requirements at the buildi ermit stage, prior to the code change
this project did not meet 'de yard setback requirements and would
have required a varianc f m the Commission, an additional 2'
setback would require r design f the whole project.
Chm. Jacobs opened the public h ring. There were no audience
comments and the lic hearing was losed.
Commission/sta discussion/comment: mber of bedrooms existing
and with the addition; understandably t re is a problem with the
applicant t knowing of the code chang but feel this addition
would be o much house next to other homes the present next door
neighbor who has approved of the addition may not always live
there; ecause of the slope of the lot the add ion will tower over
t}ie h se next door, it will appear to be muc higher than it is
and ight infringe on the privacy of the neighbor backyard, it is
too tall to go straight up.
With the statement the architect did contact the city in the first
instance regarding code requirements, then there was a code change,
