second story addition to the house at 1545 Ralston. A variance is
required because the appiicant wishes to retain the present 17 feet
by 17 feet garage where a �C� feet by '�0 1Qpt, garaqe is req��ired for
a rour bedroom home. There is a vt> foot long driveway and a studio
apartment in what was oriqinally a breezeway between the house �;nd.
garage. The applic�nt proposes to remove the studio �nd breezeway
so that the garage is a detached structure. The Planning-Commission
voted unanimously at its January 9 meeting to deny the request
hec���se there were no e.:ception�l circumstanr_es or hardships to
provide a standard si�e garage.

Conditions suggested in the staff report:
1. that the conditions of the Chief Bu"ilding Inspector�s December 5,
1988 memo shall be met; '
2. that the project as built shall be consistent with the plans
submitted to the Planning Department and date stamped November
21, 1988, which shall include the removal of the studio apartment
on the property; and
3. that there shall be only one dwelling unit on this property.
In order to grant a variance the City Council must find that the
following conditions exist on the site (Code Sec. 25.54.020 a-d):
(a) there are exceptional or extraordinary circumstances or
conditions applicable to the property involved that do not
apply generally to property in the same district;
(b) the granting of the application is necessary for the
preservation and enjoyment of a substantial property right of
the applicant, and to prevent unreasonable property loss or
unnecessary hardship;
(c) the granting of the application will not be detrimental or
injurious to property or improvements in the vicinity and will
not be detrimental to the public health, safety, general
welfare or convenience;
(d) that the use of the property will be compatible with the
aesthetics, mass, bulk and character of Pxisting and potential
uses of properties in the general vicin.ity.

Action Alternatives:
1. The City Council can uphold the Planning Commission and deny the
parking variance for a 17� x 17� interior dimension garage where
20� x 20� interior dimension is required for a four bedroom
house. The reasons for the denial should be clearly stated.
2. The City Council can reverse the Planning Commission and grant
the parking variance with conditions. Council must make findings
for this action.
3. The City Council can deny without prejudice this request for
parking variance. If this alternative is pursued the Council
should be clear in its direction to the applicant, Planning
Commission and staff about the areas where they feel information
is inadequate or where redesign should be considered.
BACKGROUND:
Robert Louth is requesting a parking variance in order to make an 802
SF, 3 bedroom, 2 bath second story addition to the house at 1545 Ral�ston
Avenue. A variance is required because, with the new construction the
house will have four bedrooms, two covered off-street parking spaces
with an interior dimension of 20�x 20' are required and the applicant
wishes to retain the existing 17� x 17� (interior dimension) garage
(Code Sec. 25.70.030). A 30' long driveway leads from the street to the
existing garage which leaves 22.5� between the side setback on this
corner lot and the face of the garage.
Presently on this property there is a studio apartment in what appears
to have originally been a breezeway between the house and the garage.
The applicant proposes to remove the studio and breezeway and return the
existing garage to a detached structure.
The present house including the garage (324 SF) and breezeway is 1,943
SF. The remodeled house without the breezeway and retaining the
existing garage as detached will be 2,407 SF or 24� larger.
PlanninQ Commission Action
At their meeting on January 9, 1989 the Planning Commission voted 7-0 to
deny the applicant�s request for a parking variance. The Planning
Commission discussion and reasons included the increase in the number of
bedrooms, the size of the addition, if the house were sold it would have
been enlarged but would have a substandard garage where there is space
to provide a standard garage; the lot size is 5,200 SF, larger than the
minimum in the city; thus there were no exceptional circumstances nor
any hardship to support the variance.
Commission discussed briefly the removal of the nonconforming second
unit. It was noted that if the value of the proposed 802 SF addition
equaled 50� or more of the value of the existing structure the

nonconforming unit.would have to be removed. If the value of the
improvement was less, the unit could be retained but not improved. In
fact only maintenance improvements necessary for life safety could be
made and the floor area could never be expanded. -

not add more structure than he is proposing, two cars can be parked
in the garage now, everything else will meet code, he will remove
the second unit which presently connec�s the house and garage.
Responding to Commission questions, applicant advised he purchased
the property recently with his father, he and his family will live
there, he has three children (aged 17, 8 and 6), they will move in
after the addition is completed; applicant did not know when this
property was subdivided, lot meets the 5,000 SF minimum; he is a
contractor.
Applicant stated he would rather use the outside space for living
area than have it taken up by enlarging the garage; he will need a
fence along the sidewalk, will leave the driveway open; he was not
aware at the time he purchased this property that a variance would
be necessary. There were no audience comments and the public
hearing was closed.
Commission discussion/comment: concern about this large addition
and reluctance of applicant to enlarge the garage; if the house
were sold it would be a home with a variance and a substandard
garage when it is possible to provide a standard garage, based on
this cannot support the variance request; since applicant is a
contractor he should have known a variance would be involved, think
he should provide a standard size garage.
C. Giomi moved to deny the parking variance for the reasons stated;
she found there were no exceptional circumstances applicable to
this property because it is a standard sized lot, there is room for
expansion of the garage, no hardship exists. Motion was seconded
by C. Harrison and approved on a 7-0 roll call vote. Appeal
procedures were advised.

SUBJECT: PARKING VARIANCE FOR AN ADDITION TO A SINGLE
FAMILY HOME AT 1545 RALSTdN AVENUE ZONED R-1
Robert Louth is requesting a parking variance in order to make an
802 SF, 3 bedroom/2 bath second story addition to the existing
two bedroom house at 1545 Ralston Avenue, zoned R-1. One of the
existing bedrooms will be converted to a family room. With the
proposed addition, the total number of bedrooms on the property
will increase to four. The applicant proposes to retain the
existing 17�x 17� (inside dimensions) garage where the cade
requires a 20'x20' garage (Code Section 25.70.030). There i� a
30� long driveway which leads to the garage, with sufficient
room (22-1/2�) for a vehicle to park behind the 7-1/2� side
setback required for this corner lot.
The existing house is currently connected to the garage by a
studio apartment. The applicant proposes to remove this
apartment and convert the garage back into a detached structure.
The existing house and apartment on the property, ineluding the
324 SF garage, total 1,943 SF. The proposal involves removing
338 SF and adding 802 SF for a net addition of 464 SF. The
remodelled house will be 2,407 SF (including the 324 SF garage),
ar 24� larger.
Staff Review
City staff have reviewed this request. The Fire Marshal
(November 28, 1988 memo) had no comments. The City Engineer
(December 5, 1988 memo) notes that since there is room on the
property to provide a garage of the required dimensions, he
cannot �upport the requested variance. The Chief Building
Inspector (December 5, 1988 memo) notes that if the project is
approved the garage walls closer than 3� to property lin� would
have to be of one-hour fire resistive construction.
Planning staff would note that there is no record of how the
apartment on this property came to be. The applicant believes
that a breezeway at one time connected the house to the garage
and over the years this breezeway was converted to a separate
living unit. The propo5ed addition to this property meets all
setback, lot coverage and height requirements and conforms to the
requirements of the declining height ordinance.
Ax�plicant's Letter
In his letter of November 21, 1988 the applicant notes that the
property is smaller than most in the area sinee about one-third
of the lot was sectioned off years ago to create a separate
parcel to the rear of this property. (A copy of the Ass�ssor�s
Parcel Map of the area is enclosed in the x�eport to hel�
illustrate this point.) The applicant goes on to explain that

because of the small size of the lot, to enlarge the garage to
the minimum code dimensions would increase the lot coverage and
thus would reduce the usable yard area on the property. He
explains that most of the back yard is already taken up by the
driveway and existing garage. They would like to keep as much
open space as possible for outdoor use for their children. He
also explains that the garage currently functions as a two car
garage and it would create a hardship to have to tear it down
simply to increase its size by two feet. The variance should nat
affect other property owners since the existing garage and
driveway provide sufficient room for vehicles to park on the
property.
Findincrs for a Variance
To grant a variance the Planning Commission must find that the
following conditions exist on the property (Code Section
25.54.020):
a. there are exceptional or extraordinary circumstances or
conditions applicable to the property involved that do not
apply generally to property in the same district;
b. the granting of the application is necessary for the
preservation and enjoyment of a substantial property right of
the applicant, and to prevent unreasonable property loss or
unnecessary hardship;
c. the granting of the application will not be detrimental or
injurious to property or improvements in the vicinity and
will not be detrimental to the public health, safety, general
welfare or convenience;
d. that the use of the property will be compatible with the
aesthetics, mass, bulk and character of existing and
potential uses of properties in the general vicinity.

The Planning Commission should hold a public hearing. The
reasons for any action should be clearly stated. At the public
hearing the following conditions should be consideredz
l. that the conditions of the Chief Buildinq Tnspector's
December 5, 1988 memo shall be met;
2. that the project as built shall be consistent with the plans
submitted to the Planning Department and date stamped
November 21, 1988, which shall include the removal of the
studio apartment on the property; and
3. that there shall be only one dwelling unit on this property.

A) The property itself is small because a third of the lot was previously
sectioned off to create another parcel.. All of the other lots in the
block are much deeper and increasing the lot coverage makes the usable
property.even smaller.
B) The garage is functioning fine now as a two car garage and it woul.d be
a waste of resources to tear it down and rebuild another one in order
to gain only two feet of space. Increasing our lot coverage would take
away from our ability to use and enjoy our rear yard area which is great-
ly taken up now by driveway and garage. We would like to keep as much _

etc. while at the same time keeping the necessary off street parking
which now �xists. . .

.Request for variance of ordinance requiring 20' x 20' dimension for two
car garage.
The property which we purch�sed has a fully enclosed two car garage which
measures 17'-10" x 17'-10". We would like this structure to be accepted as
the required two car garage for the following reasons.
A) The property itself is small because a third of the lot was previously
sectioned off to create another parcel. All of the other lots in the
block are much deeper and increasing the lot coverage makes the usable
property.even smaller.
B) The garage is functioning fine now as a two car garage and it would be
a waste of resources to tear it down and rebuild another one in order
to gain only two feet of space. Increasing our lot coverage would take
away from our ability to use and enjoy our rear yard area which is great-
ly taken up now by driveway and garage. We would like to keep as much
open space as possible on the property for outdoor use for our children
etc, while at the same time keeping the necessary off street parking
which now �xists.
C) Since there is already an existing two car garage and a driveway, there
wouldn't be any necessity to park on the street and therefore this variance
would not affect other property owners or the general public.
