CEQA Status: Article 19. Categorically Exempt per Section: 15303, Class 3—(a) construction of a limited
number of new, small facilities or structures including (a) one single family residence or a second dwelling unit in
a residential zone. In urbanized areas, up to three single-family residences maybe constructed or converted
under this exemption.
History: This project was reviewed by the Planning Commission as a design review study item on January 22,
2007 and as an action item on March 26, 2007. At their March 26, 2007 review the Commission continued the
item to the consent calendar after the applicant had addressed several additional items. On April 9, 2007, the
Planning Commission approved an application for Design Review to allow for construction of a new, finro-story
single family dwelling and detached garage (April 9, 2007, P.C. Minutes). A building permit was issued on July
30, 2007, and construction is nearing completion.
On April 28, 2008, the Planning Commission reviewed proposed changes to the project as an FYI item. The
Commission decided to place this item on a Regular Action calendar for further discussion (April 28, 2008 P.C.
Minutes).
Proposed Revisions: The applicant is requesting an Amendment to Design Review for changes to a previously
approved new single family dwelling and detached garage at 1473 Cortez Avenue, zoned R-1. The applicant is
requesting approval for changes to all four building elevations (see Previously Approved and Proposed Building
Elevations, sheets FYI.1 through FYI.4, date stamped April 20, 2008). The proposed changes are detailed in
two letters from the applicant (dated April 20, 2008) and include:
1. Leaded Windows: Eight leaded windows were not installed throughout all four elevations. Instead,
the approved leaded windows were replaced with clad windows that match what was approved
throughout the rest of the house.
2. Window Headers: The approved 3x8 cedar headers over several windows were changed to 2x4
headers (per prior discussion with Planning staff). However, the headers were eliminated on many of
the windows throughout the house.
3. Corbels and Rafter Tails: Enclosed eave and gutter returns were constructed where corbels and
exposed rafter tails were approved.
4. Decorative Trim: The approved trim between the first and second stories on rear elevation was
changed to a wooden belle trim along the rear and sides of the master bedroom overhang.
5. Planter Boxes: Planter boxes were approved on all four elevations, but the applicant is proposing to
eliminate them on the right side and rear elevations.
The applicant is requesting the following:
■ Amendment to Design Review for changes to a previously approved new single family dwelling and
attached garage (CS 25.57.010).

Summary (includes proposed revisions): The applicant demolished an existing two-story house with attached
garage and built a new two-story single family dwelling and detached two-car garage. The new house and
detached garage have a total floor area of 3,416 SF (0.57 FAR) where 3,420 SF (0.57 FAR) is the maximum
allowed. The proposed floor area is 4 SF below the maximum allowed FAR.
The applicant applied for a permit to remove an oak tree in the center of the backyard. The tree removal
application was denied by the City Arborist on November 17, 2006. The applicant has noted, and the landscape
plan indicates that the tree will remain after construction and will be properly protected during construction (see
condition number 16).
The project includes a detached garage (427 SF, 20'-8" x 20'-8") which provides the required one covered
parking space for the new four-bedroom house. One uncovered space (9' x 20') is provided in the driveway. All
other zoning code requirements have been met.

Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;

2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.

Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped January 12, 2007, sheets A.1 through A.3, A� and A.6 �^�o-, ar�d-March 28, 2007,
sheets � L1.0, and April 20, 2008 (Sheets FYI.1 through FYI.4), and that any changes to
building materials, exterior finishes, footprint or floor area of the building shall require an amendment
to this permit;
2. that the conditions of the Chief Building Official's November 27, 2006 memo and January 3, 2007
memo, the City Engineer's November 29, 2006 memo, the Fire Marshal's November 28, 2006 memo,
the City ArborisYs November 30, 2006 memo, the Recycling Specialist's November 26, 2006 memo,
and the NPDES Coordinator's November 27, 2006 memo shall be met;
3. that demolition for removal of the existing structures and any grading or earth moving on the site
shall not occur until a building permit has been issued and such site work shall be required to comply
with all the regulations of the Bay Area Air Quality Management District;
4. that any changes to the size or envelope of the basement, first or second floors, or garage, which
would include adding or enlarging a dormer(s), moving or changing windows and architectural
features or changing the roof height or pitch, shall be subject to Planning Commission review;
5. that prior to scheduling the foundation inspection a licensed surveyor shall locate the property
corners and set the building footprint;
6. that prior to underfloor frame inspection the surveyor shall certify the first floor elevation of the new
structure(s) and the various surveys shall be accepted by the City Engineer;
7. that prior to scheduling the framing inspection the project architect or residential designer, or another
architect or residential design professional, shall provide an architectural certification that the
architectural details shown in the approved design which should be evident at framing, such as
window locations and bays, are built as shown on the approved plans; architectural certification
documenting framing compliance with approved design shall be submitted to the Building Division
before the final framing inspection shall be scheduled.
8. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof
ridge and provide certification of that height to the Building Department;
9. that prior to final inspection, Planning Department staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been built
according to the approved Planning and Building plans;
10. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single

termination and installed on the portions of the roof not visible from the street; and that these venting
details shall be included and approved in the construction plans before a Building permit is issued;
11. that the project shall meet all the requirements of the California Building and Uniform Fire Codes,
2001 Edition, as amended by the City of Burlingame;
12. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction
plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior,
shall require a demolition permit;
13. that during demolition of the existing residence, site preparation and construction of the new
residence, the applicant shall use all applicable "best management practices" as identified in
Burlingame's Storm Water Ordinance, to prevent erosion and off-site sedimentation of storm water
ru noff;
14. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance;
15. that the project is subject to the state-mandated water conservation program, and a complete
Irrigation Water Management Plan must be submitted with landscape and irrigation plans at time of
permit application;
16. that a certified arborisYs report showing how the oak tree in the back yard will be protected during
construction, to be approved by the Parks Department, shall be prepared and implemented;
17. that the tree protection measures detailed in the certified arborist's report will be installed before a
building permit is issued;
18. that for purposes of these conditions a certified arborist means a person certified by the International
Society of Arboriculture as an arborist; and
19. that the 24" box size replacement tree required as part of the tree removal permit issued on August
16, 2006 must be planted before final inspection.

RE. FYI reasons for change
1. Leaded glass windows were replaced with simulated
true divided light clad windows to allow more natural
light into the bathroom areas and to be consistent
with rest of house.
2. The 3X8 ceder headers with replaced with 2X4
header over a brick mould trim on the curved windows
and front french door to still give the effect of a
header but be more in proportion with the house. Brick
mould was used on all of the windows due to the boxed
in eave there was not significant room for the 2"
header.
3. The corbels were replaced at the bottom of eave
with an enclosed eave and gutter return to provide a
cleaner finished look.
4. The wooden belle trim was continued around the
rear master bedroom area over nook and kitchen to
relieve stress on the stucco smooth finish and to be a
continuation of the master bedroom overhang band.
5. Right elevation and rear elevation planters were
removed because of inability to access planter for
maintenance and watering. Master bath planter requires
climbing over the 4' tub. Stair well planter access is
limited and the planter is not visible except from 4'
side pathway.

Since there was no appeal to or suspension by the City Council, the Apri19, 2007, Planning Commission

Reimbursement of the design review deposit has been processed and will be mailed to you under separate
cover. All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be issued. One
extension of up to one year may be considered by the Planning Commission if application is made �etore
the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within
90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.

comments. Thirteen conditions were suggested for consideration.
Chair Brownrigg opened the public hearing. Charles and Laura Cammarata, 1605 Quesada Way,
represented the project; discussed changes made to plans based on commission comments. There were no
further comments and the public hearing was closed.

Chair Brownrigg opened the public hearing. James Chu, 55 W. 43ra Ave San Mateo, architect; Jason and
Denise Payne, property owners; Pat Giorni, 1445 Balboa Ave, spoke. Issues noted: front porch area; flat
areas on roof; fireplace insufficient setback; Jasmine on landscape plan; curved windows; one car garage
required; tree protection; and construction site maintenance requirements. The applicant submitted a single
copy of a reduced sheet of new proposed revisions at the public hearing. The public hearing was closed.
Commissioners had the following comments regarding the project:
■ May want to extend the rafters up on the roof at a pitch in order to avoid flat areas, particularly on the
smallest flat area; tar and gravel is a lot of work and water can pond;
■ The proposed fireplace along the right side elevation has an insufficient setback to the property line, it
needs to move at least 6" in towards the house;
■ The Jasmine vines along the left side property line need to be planted closer together and there should be
more of them, in order to create a landscape barrier between the two properties;
■ The curved windows proposed on the house shall be retained during construction and shall not be
replaced with rectangular windows;
■ An arborist report, prepared by a licensed arborist, shall be submitted with tree protection measures for
the protected Oak tree in the rear yard, and the City Arborist shall review and approve the arborist
report; the protection measures should be installed before a building permit is issued;
■ During construction, the applicant should coordinate, if possible, with the next door neighbor to share a
debris box or at least avoid having two debris boxes on the street at the same time; the applicant shall
abide by the new construction site maintenance requirements.

remove one oak tree that was denied, but another tree was removed from the rear yard; was a permit issued
for that removal? Talked to owner to gain access to the rear yard and saw the location of the removed tree
and the remaining oak. There were no further questions from the Commission.
Chair Brownrigg opened the public comment. James Chu, 55 W. 43rd Avenue, San Mateo, and Jason and
Denise Payne, property owners, stated: decided to keep the oak tree which was denied a removal permit on
the property; agree with staff to hire a licensed arborist for a tree protection plan; obtained a tree removal
permit to remove the oak in order to accommodate the construction of the detached garage. Commission
commented:
■ Did a great job on the design; the right elevation looks nicer when the second floor plate comes
down; the design is handsome;
■ There are a couple of flat spots on the top of the roof; should not use curb in these areas; wrap
shingles to the ridge to trick the eye;
■ House has the potential to add a front porch; could extend roof element off to one side; front porch is
important to extend the house to the neighborhood;
■ At the rear elevation, any thought to French doors instead of the window on the first floor?
■ Compliment profile of corbels on plans; could include an attic vent on the elevation;
■ Clarify the permits issued for the tree removal and for the tree to be retained; and
■ In front driveway side, strawberry tree should be replaced with a larger scale tree like a Bay laurel to
help screen the house, and the Bay laurel shown on the plans at the front could be swapped with the
strawberry tree shown.
The applicant responded: French doors were not added in location of window on first floor so that there
would be more useable living space inside the house in that location; and the tree in the back was approved
for a tree removal permit by Steve Porter because it was a shallow based oak. There were no other
comments from the floor and the public hearing was closed.
C. Cauchi made a motion to place this item on the consent calendar at a time when the requested revisions
have been made and plan checked. This motion was seconded by C. Vistica.
Comment on motion: in favor of porch on this project, would like to see it a little larger; prepared to
approve motion with understanding that porch element be added to plans; porch needs to be brought forward

slightly; with respect to the porch, if the front patio area gets used at all, you do not want to create a porch
with a railing, generally make an entry porch to bring house forward towards the street; here want to create a

advisement.

1) All construction must comply with the 2001 California Building Codes (CBC), the Burlingame
Municipal and Zoning Codes, and all other State and Federal requirements.
2) Provide fully dimensioned plans.
3) When you submit your plans to the Building Division for plan review provide a completed
Supplemental Demolition Permit Application. NOTE: The Demolition Permit will not be
issued until a Building Permit is issued for the project.
4) Comply with the new, 2005 California Energy Efficiency Standards for low-rise residential
buildings. Go to http://www.enerqv.ca.qov/title24 for publications and details.
5) Obtain a survey of the property lines for any structure within one foot of the property line.
6) Roof eaves must not project within two feet of the property line.
7) Exterior bearing walls less than three feet from the property line must be constructed of one-
hour fire-rated construction and no openings are allowed.
�'8) Rooms that can be used for sleeping purposes must have at least one window or door that
complies with the egress requirements. Note: The "Den" must comply with this requirement.
9) Provide guardrails at all landings. NOTE: All landings more than 30" in height at any point are
considered in calculating the allowable floor area. Consult the Planning Department for details
if your project entails landings more than 30" in height.
10) Provide handrails at all stairs where there are four or more risers.
11) Provide lighting at all exterior landings.
12) The fireplace chimney must terminate at least two feet above any roof surface within ten feet.
13) NOTE: Plans that specifically address item 8 must be re-submitted before this project
can move forward for Planning Commission action.

1) Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution including but not
limited to ensuring that all contractors implement construction Best Management
Practices (BMPs) and erosion and sediment control measures during ALL phases
of the construction project (including demolition). Include appropriate stormwater
BMPs as Project Notes. These BMPs include but are not limited to the following:
• Store, handle, and dispose of construction materials and wastes properly
to prevent contact and contamination of stormwater;
• Control and prevent the discharge of all potential pollutants, including
pavement cutting wastes, paints, concrete, petroleum products, chemicals,
wash water or sediments, and non-stormwater discharges to storm drains
and watercourses;
• Use sediment controls or filtration to remove sediment when dewatering
site and obtain all necessary permits;
• Avoid cleaning, fueling, or maintaining vehicles on-site except in a
designated area where wash water is contained and treated;
• Protect adjacent properties and undisturbed areas from construction
impacts using vegetative buffer strips, sediment barriers or filters, dikes,
mulching, or other measures as appropriate;
• Perform clearing and earth moving activities only during dry weather;
• Limit and time application of pesticides and fertilizers to prevent polluted
runoff;
• Limit construction access routes and stabilize designated access points;
• Avoid tracking dirt or other materials off-site; clean off-site paved areas
and sidewalks using dry sweeping method;
• The Contractor shall train and provide instruction to all employees and
subcontractors regarding the construction BMPs.

WHEREAS, a categorical exemption has been proposed and application has been made for a

10. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a
single termination and installed on the portions of the roof not visible from the street; and
that these venting details shall be included and approved in the construction plans
before a Building permit is issued;
11. that the project shall meet all the requirements of the California Building and Uniform
Fire Codes, 2001 Edition, as amended by the City of Burlingame;
12. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects
to submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
13. that during demolition of the existing residence, site preparation and construction of the
new residence, the applicant shall use all applicable "best management practices" as
identified in Burlingame's Storm Water Ordinance, to prevent erosion and off-site
sedimentation of storm water runoff;
14. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance;
15. that the project is subject to the state-mandated water conservation program, and a
complete Irrigation Water Management Plan must be submitted with landscape and
irrigation plans at time of permit application;
16. that a certified arborist's report showing how the oak tree in the back yard will be
protected during construction, to be approved by the Parks Department, shall be
prepared and implemented;
17. that the tree protection measures detailed in the certified arborist's report will be installed
before a building permit is issued;
18. that for purposes of these conditions a certified arborist means a person certified by the
International Society of Arboriculture as an arborist; and
19. that the 24" box size replacement tree required as part of the tree removal permit issued
on August 16, 2006 must be planted before final inspection.
