Categorically Exempt per Section: 15303, Class 3—(a) construction of a limited number of new, small facilities or structures including (a) one single family residence or a second dwelling unit in a residential zone. In urbanized areas, up to three single-family residences maybe constructed or converted under this exemption. History: This proj ect was reviewed by the Planning Commission as a Design Review Study item on January 22, 2007 and as an action item on March 26, 2007. At their March 26, 2007 review the Commission continued the item to the consent calendar after the applicant had addressed several items. Current Project (based on plans date stamped January 12, 2007 and March 28, 2007): The applicant is proposing to demolish an existing two-story house with attached garage to build a new two-story single family dwelling and detached two-car garage. The proposed house and detached garage will have a total floor area of 3,416 SF (0.57 FAR) where 3,420 SF (0.57 FAR) is the maximum allowed. The proposed floor area is 4 SF below the maximum allowed FAR. The applicant applied for a permit to remove an oak tree in the center of the backyard. The tree removal application was denied by the City Arborist on November 17, 2006. The applicant has noted, and the landscape plan indicates that the tree will remain after construction and will be properly protected during construction (see condition number 16). The proj ect includes a detached garage (427 SF, 20'-8" x 20'-8") which provides the required one covered parking space for the proposed four-bedroom house. One uncovered space (9' x 20') is provided in the driveway. All other zoning code requirements have been met. The applicant is requesting the following: • Design review for a new two-story single family dwelling and detached two-car garage (CS 25.57.010). Please note that over the past year, the property owners have applied for two tree removal permits on the property. The first one was approved on August 16, 2006, for an oak tree on the left side of the rear yard and it has been removed. The Parks Department has granted an extension to August 16, 2007 for the required replacement tree. The second tree removal permit for an oak tree was denied on November 17, 2006. The applicants noted at the January 22°d Planning Commission meeting that they are planning to keep that tree, which is located in the middle of the backyard, and have noted so on the proposed landscape plan. January 22, 2007 Design Review Study Meeting: At the Planning Commission design review studymeeting on January 22, 2007, the Commission had comments regarding the removal of one oak tree in the backyard, roof shingles, landscaping, and suggested adding design elements such as a front porch, french doors at the rear, and an attic vent. The Commission moved to place the item on the consent calendar at a time when the applicant had addressed the Commission's comments and there is space on the agenda. The applicant submitted a response letter to the Planning Commission on March 6, 2007 and there were no changes made to the plans. March 26, 2007 Action Meeting: At the Planning Commission action hearing on March 26, 2007, the Commission had comments regarding the rafters, fireplace, jasmine, curved windows, and the protected oak in the rear yard. The Commission moved to place the item on the consent calendar at a time when the applicant has � Design Review 1473 Cortez Avenue addressed the Commission's comments and there is space on the agenda. The applicant submitted two response letters to the Planning Commission on March 28, 2007. One addressed the comments made by the Planning Commission at their January 22, 2007 meeting and the other addressed comments made at their March 26, 2007 action hearing. The applicant also submitted a revised front elevation, right elevation, and landscape plan (sheets A.4 and L1.0 date-stamped March 28, 2007). The following is a list of comments made by the Commission at the March 26, 2007, meeting and responses by the applicant: Consider extending the rafters up on the roof at a pitch in order to avoid flat areas, particulaYly on the smallest flat area; taY and gravel is a lot of work and water can pond. The architect noted that the shingle roofing will wrap around the ridge at the flat roof area, as the Planning Commission previously suggested, and that the flat roof is commonly used to allow more articulation to minimize mass and bulk (response letters from architect dated March 28, 2007). (Staff notes the rafters were not extended to form a pitched roof over the flat roof areas.) 2. The proposed chimney along the right side elevation has an insufficient setback to the property line and needs to move at least 6" towards the house. The architect noted, per Burlingame Municipal Code Section 25.28.073, 3b(2), that "a new chimney shall be set back a minimum of two feet from the property line" (response letter from architect dated March 28, 2007). Planning staff confirmed that in the past the zoning code has been interpreted to mean a new chimney just two feet from a side property line is permitted. 3. The jasmine vines along the left sideproperty line need to beplanted closer together and there should be more of them in order to create a landscape barrier between the two properties. The architect noted that the landscape plan has been shared with the neighbor to the left and they are satisfied with the current spacing of jasmine vines as shown, no changes were made to the spacing between plants (response letter from architect dated March 28, 2007). 4. The curved windows proposed on the house shall be retained during constYuction and shall not be replaced with rectangular windows. As originally proposed, curved windows are shown on the front and right elevations (front and right elevations date-stamped March 28, 2007). S. During construction, the applicant should coordinate with the next door neighbor to share a debris box, oY at least avoid having two debris boxes on the street. • No response in writing from architect. Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the Council on Apri120, 1998 are outlined as follows: Compatibility of the architectural style with that of the existing character of the neighborhood; 2. Respect for the parking and garage patterns in the neighborhood; Design Review Architectural style and mass and bulk of structure; 4. Interface of the proposed structure with the structures on adjacent properties; and 5. Landscaping and its proportion to mass and bulk of structural components. 1473 Cortez Avenue Findings: Based on the findings stated in the attached minutes of the Planning Commission's January 22, 2007 design review study meeting, that the applicant has done a nice job with the design, and that it is consistent with the mass and bulk in the neighborhood, and that some of the proposed revisions noted by the Planning Commission on January 22, 2007 and March 26, 2007 have been incorporated, including wrapping the shingle roofing, adding an attic vent, and switching the location of the bay laurel with the strawberry trees, the proj ect is found to be compatible with the requirements of the City's five residential design review guidelines. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be by resolution and include findings made for design review. The reasons for any action should be clearly stated for the record. At the public hearing the following conditions should be considered: that the project shall be built as shown on the plans submitted to the Planning Department date stamped January 12, 2007, sheets A.1 through A.3, A.S, A.6 and L1.0, and March 28, 2007, sheets A.4 and L1.0, and that any changes to building materials, exterior finishes, footprint or floor area of the building shall require an amendment to this permit; 2. that the conditions of the Chief Building Official's November 27, 2006 memo and January 3, 2007 memo, the City Engineer's November 29, 2006 memo, the Fire Marshal's November 28, 2006 memo, the City Arborist's November 30, 2006 memo, the Recycling Specialist's November 26, 2006 memo, and the NPDES Coordinator's November 27, 2006 memo shall be met; that demolition for removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 4. that any changes to the size or envelope of the basement, first or second floors, or garage, which would include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to Planning Commission review; 5. that prior to scheduling the foundation inspection a licensed surveyor shall locate the property corners and set the building footprint; 6. that prior to underfloor frame inspection the surveyor shall certify the first floor elevation of the new structure(s) and the various surveys shall be accepted by the City Engineer; 7. that prior to scheduling the framing inspection the project architect or residential designer, or another architect or residential design professional, shall provide an architectural certification that the architectural details shown in the approved design which should be evident at framing, such as window locations and bays, are built as shown on the approved plans; architectural certification documenting framing compliance with approved design shall be submitted to the Building Division before the final framing inspection shall be scheduled. Design Review 1473 Cortez Avenue that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof ridge and provide certification of that height to the Building Department; 9. that prior to final inspection, Planning Department staff will inspect and note compliance of the architectural details (trim materials, window type, etc.) to verify that the proj ect has been built according to the approved Planning and Building plans; 10. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination and installed on the portions of the roof not visible from the street; and that these venting details shall be included and approved in the construction plans before a Building permit is issued; 11. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2001 Edition, as amended by the City of Burlingame; 12. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; 13. that during demolition of the existing residence, site preparation and construction of the new residence, the applicant shall use all applicable "best management practices" as identified in Burlingame's Storm Water Ordinance, to prevent erosion and off-site sedimentation of storm water runoff; 14. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management and Discharge Control Ordinance; and 15. that the project is subject to the state-mandated water conservation program, and a complete Irrigation Water Management Plan must be submitted with landscape and irrigation plans at time of permit application. 16. that a certified arborist's report showing how the oak tree in the back yard will be protected during construction, to be approved by the Parks Department, shall be prepared and implemented; 17. that the tree protection measures detailed in the certified arborist's report will be installed before a building permit is issued; 18. that for purposes of these conditions a certified arborist means a person certified by the International Society of Arboriculture as an arborist; and 19. that the 24" box size replacement tree required as part of the tree removal permit issued on August 16, 2006 must be planted before final inspection. Dear Planning Commissioners: Feb. 16, 2007 After much discussion on whether to add a porch to our design we have decided against it. We really like the look of our home with out the porch. We also have two young boys a��d the porch railing is just one more thing for them to climb on and jump off. We plan on spending a lot of time in our backyard with our family and friends.
